34; Zone" - The divisions into which the city is respectively divided by the plan for the purposes of the plan. A reference in this Act to a zone by its name refers to the aforesaid division of the city designated by that name. Such statements must be made within thirty days of the notification by the Council in accordance with paragraph (14) of this section.
(1) The Brisbane City Council may at any time and from time to time apply to the Minister for amendment of the plan. Such notice must describe any changes to the Plan notified therein in such a way that it can be identified. Each certificate must be signed by the municipal clerk or by an official of the Council authorized by ordinance.
Provided that the Council, before deciding to take the land, must obtain the consent of the Minister (which consent the Minister may give or refuse to give). Subject to this Act, any person applying for permission to open a new road or to subdivide land may appeal to the Tribunal against the decision of the Council or its delegate. Subject to this Act, any person aggrieved by a decision of the Council or its delegate under an order made under this Act may appeal from such decision to the Court.
In the case of an appeal, in making its decision, the Council or its delegate is bound by the determination of the appeal. In the event of an appeal, in approving the plans for the proposed building, the Council or its delegate shall be bound by the determination of the appeal.
