ELECTION OF ELECTIVE MEMBERS OF THE BOARD OF PROFESSIONAL ENGINEERS
Roll of Electors
1. The Registrar shall prepare a roll of electors, for the purposes of each and every election. Such roll of electors shall comprise the names of all persons who are duly registereJ as professional engineers on the date of the publication of the notice of any election.

Such roll of electors shall be certified by the Chairman of the Board by writing under his hand to be correct, and when so certified shall be the roll of electors to be used at such election, and shall, subject to these Regulations, be conclusive evidence of the rig-ht of all such per~onsand no other persons to vote thereat.
The names on such roll shall be in alphabetical order, and numbered progressively from one onwards.

(I) In the month of June, in the year 1932, and in the month of April in the year' I 934, and in each alternate year thereafter the Board shall determine the dats of the election of tbe elective members of the Board to be held in each such year and the date for th~t receipt of nomina- tions therefor, and the Registrar shall give at least one month's notice by advertisement in the Gazette of intention to hold each such election.(2) Every notice of election shall specify the date fixed for the election, and the date determined by the Board as the final date for the receipt of nominations of candidates in respect of such election.

Nomination and Election of Elective Members of the Board
4.Every candidate for election must be a registered professional enginee1.
5. Any five or more persons whose names are included in the roll of electors, and who are desirous of nominating any eligible person as a candidate at the said election, may fill up and sign a nomination-paper in the prescribed form or to the like effect, and such nomination-paper shall be signed by the person therein named as a candidate accepting such nomination. Such nomination-paper shall be in the hands of the Registrar before four o'clock in the afternoon of the day fixed by the Registrar for receiving nominations.
6. The Registrar shall, in the event of there being not more than three persons nominated, make a return to the Minister, and shall declare such persons to have been duly elected for appointment as members of the Board of Professional Engineers as the representatives of the practising professional engineers.
Ifthe number of eligible persons nominated be greater than three, an election shall be held and the Registrar shall, as soon as practicable, cause voting-papers to be prepared in the prescribed form or to the like effect, and shall forward or cause. to be forwarded, in a sealed envelope, to every person included in the roll of electors, and at least fourteen days before the holding of the election, an open envelope addressed to the Registrar, and marked "Voting-paper only," and a voting- paper setting out the names of the candidates. Ea,ch such voting-paper shall be numbered with the number allotted on the aforesaid roll to the person to whom such voting-paper is forwarded, and the said number shall be securely hidden from view by fastening down the corner of the voting- paper with gum or other adhesive substance. The Registrar shall, before forwarding, plainly initial each voting-paper on the back thereof.
7. If any person who shall have become a candidate for such election shall be desirous of retiring from such candidature before the day of holding such election, such candidate, not later than eighteen days before the day of holding such election, may sign and deliver to the Registrar a notice, in the prescribed form or to the like effect, stating that such candidate so retires, and the Registrar, on receipt of such notice, shall omit the name of such person so retiring from the voting-paper, and if the number of candidates shall, by such retirement, be reduced to three, the Registrar shall declare the remaining candidates duly elected for appoint- ment as members of the Board of Professional Engineers as representatives of the practising professional engineers.
8. Each voter shall vote for three candidates, and indicate his vote on the voting-paper by placing a cross in the square opposite the name of each of the three candidates for whom he votes, and, if any voter shall vote for more or less than three candidates, or make any other mark or writing on the voting-paper, the vote given by such voter on such voting- paper shall be deemed to be informal, and shall not be counted by the·
Registrar.
The voter shall enclose such voting-paper in the envelope furnished
to him as hereinbefore provided, addressed to the Registrar and marked as
aforesaid, and shall stamp and post the same, or deliver or cause to be
delivered the same, so that it shall be received by the Registrar before
four o'clock in the afternoon of the day fixed for holding such election.

9. Every voting-paper when returned to the Registrar shall be . deposited in a locked ballot-box with a cleft or opening therein capable of
receiving the voting-papers.
10. Each candidate shall be entitled to appoint, in writing, one scrutineer to be present when the Registrar shall open the envelopes containing the voting-papers on the day of the holding of the election. Such appointment shall be notified to the Registrar not less than five days prior to the date of the election.
11. The Registrar shall, at four o'clock in the. afternoon of the day specified for holding the election, proceed, in the presence of tlie scrutineers, if any, appointed by the candidate, to open the envelopes addressed to the Registrar and marked as aforesaid, and which have been returned to him, and take out and examine the voting-papers therein contained; and he shall proceed to ascertain the number of votes for each candidate, at the same time rejecting informal voting-papers; When necessary, the Registrar shall in the presence of any witnesses who may have been appointed determine by lot which shall be elected of two or more candidates who shall have received an equal number of votes.
12. At the examination of the voting-papers, every voting-paper which-
( a) Does not bear the initials of the returning officer; or (b) Is manifestly irregular; or
(c) Contains a greater or less number of names voted for than the members to be elected; or
(d) Is so imperfectly executed that the intention of the voter cannot with certainty be ascertained-
shall be rejected.
13. The Registrar shall make out a written statement signed by himself, and countersigned by any scrutineers who are present and consent to sign the same, containing the numbers in words as well as figures of the votes for each candidate as counted as aforesaid, and shall at the same time and place declare to have been duly elected the three candidates who have received the greatest number of votes. He shall forthwith thereafter certify to the Minister, by writing under his hand, the names of the can- didates so elected, and the number of votes given to each candidate, and the date of the declaration of the result of election.
Destruction of Voting-papers
14. Not less than six months after holding the election the Registrar, subject to the direction to the Board, shall destroy, by burning, all voting- papers used at such election.
BUSINESS OF THE BOARD
Conduct of Business of the Board
15. The Board may from time to time appoint from amongst themselves sub-committees, and may, by resolution at any time, abolish any sub-committee so appointed. The convener, to be appointed by the Board, of sub-committee meetings shall act as chairman at such meetings.
The rules and regulations prescribed for the conduct of the business of
the Board shall apply, so far as they are applicable, to the conduct of
the business of each such sub-committee.

Fees for Board Members
16. The fees payable to the chairman and each member of the Board for attendance at each meeting thereof shall be $8 and $6, respect- ively, provided that the maximum amount payable for any calendar year shall be to the chairman $48, and any member $36.

Duties of Registrar
17. The Registrar shall prepare and keep the register, declarations, and other forms and documents prescribed by the Act, and bring before the Chairman and the Board all matters and things necessary for the due administration of the Act. The Registrar shall summon all meetings of the Board ·and sub-committees, and attend thereat, prepare a business paper for each meeting of the Board and of a sub-committee, and take and record the minutes of proceedings at the same; when required by the Chairman so to do he shall sign notices to members of any special meetings .of the Board. The Registrar shall conduct all correspondence; keep a record in the proper form of all attendances at Board meetings, accounts, receipts, payments, vouchers, reports, documents, papers, and proceedings in connection with the Board's business, or as the Board may direct; and generally do all the clerical work of the Board, and arrange for the super- intendence of all examinations, business, and affairs under the Board's direction. Where desirable, in view of the provisions of the Act, he shall make a report of engineering matters that come under his cognisance for the information of the Board and sub-committees. He shall consult the Chairman of the Board on business requiring attention between the various meetings, and shall be responsible for the safe cutody of all t:eceip.ts, ;papers, cheques, .cheque-books, bookS, ·.documents, certificates, and property belonging to the Board, which shall be under his charge, and they shaH be always available to the Board, or any member thereof.
18. The Registrar shall receive all fees, fines, subscriptions, dona- tions, and other moneys which may become due or payable to the Board,
and shall give a receipt for the same from the book of official receipt forms provided for the purpose, and shall at the same time write and shall keep a duplicate of each such receipt; and shall receive and pre- serve all forms of certificates or other documents for use under these Regulations.
18A. During any inc'\pacity .of or absence from Brisbane of the Registrar the chairman or a member of the Board authorised in that behalf by the Board or by the chairman shall perform the duties of the Registrar set out in Regulations 18 and 19 and shall also receive aiJ.d conduct the correspondence of the Board.

Banking and Application of Moneys
19. The Registrar shall deposit all moneys received by him on
account of the Board forthwith with the Commonwealth Bank, in Brisbane,
or such other bank as may from time to time be determined upon by
the Board, .to the credit ·of .the .Board, to an account to be called "The
Board of Professional Engineers Account." All accounts rendered to
the Board and passed by it for payment shall be paid by cheque, signed
by any two members of the Board and the Registrar, or otherwise as
the Board may from time to time by resolution direct.

20. The Registrar shall present to the Board at each ordinary meeting a statement, showing the receipts and disbursements since the last preceding meeting, and shall obtain and produce the bank passbook at each regular meeting, and at any other meeting if required to do so in the requisition for the holding of such meeting. He shall also, in the month of July in each year, prepare and present to the Board a state- ment of receipts and disbursements for the preceding twelve months
showing the exact financial position of the Board.
Registrar's Fidelity Insurance Policy
21. The Registrar shall cause to be issued in favour of the Board a fidelity insurance policy in respect of himself in the sum of five hundred dollars with the State Government Insurance Office, or an insurer under
"The Insurance Acts, 1916 to 1923," the premium upon which shall
be paid by the Board.

Surplus Funds
22. The Board may from time to time direct to be placed on fixed deposit, or invested in approved trustee securities, any funds on hand over and above what is required for the purposes of subsection (2) of section 10 of the Act, in such manner as may be authorised by a resolution of the Board.
Communications to Board
23. All communications for the Board shall be addressed to the Registrar.
Issue of Certificates of Registration
24. All certificates issued by the Board shall have affixed thereto the seal of the Board and shall bear the signatures of the Chairman and any other two members of the Board and the Registrar.
Each certificate shall be of such application as shall appear on the face thereof.
Seal
25. The Registrar shall have the custody of the seal of the Board, which shall not be used, except as hereinafter provided.
26. The seal of the Board may be affixed in the presence of any member of the Board by the Registrar to any instrument or writing, when such fixing is authorised by a resolution of the Board passed for that purpose and entered in the minutes of the proceedings of the Board.
REGISTRATION OF PROFESSIONAL Er-.:GINF.ER.S
Applications for Registration
27. Any person who desires to be registered as a professional engineer shall furnish to the Board an application accompanied by certifi- cate or certificates, in the prescribed form or to the like effect, and shall pay to the Board therewith the sum of $5 for the registration fee. Upon proof to the satisfaction of the Board that he is entitled to be registered as a professional engineer, the Board shall register such person as a professional engineer, and, subject to the Act and Regulations thereunder, issue to him a certificate of registration.

28. The amount paid for registration fee by any applicant shall be repaid lo 'him subject to a deduction of $1
ifthe Board refuses to grant him a certificate of registration or an interim certificate, or $2 should the applicant withdraw his application.

29. Before finally dealing with any application for registration, the Board may from time to time require further ,proof that the applicant properly fulfils the conditions entitling him to registration, and.- may, if thought so desirable, appoint a time and place for any applicant for
regis~tration to appear before the Board or any sub-committee appointed for
~that
particular purpose, and answer questions and give further information relative to his claim for registration.
30. The Board may also require proof by statutory declaration or otherwise of any statements set out in any application made under any part of section
15of the Act, or in verification of any of the facts necessary to be established in connection with any such application.
Jl. The certificate of registration issued by the Board shall be in the form prescribed in the Schedule or to the like effect. Every professional engineer registered by examination or otherwise shall obtain from the Board the certificate of registration of the Board, for which he shall pay the prcscrihed fee, if any.
Appointment of Examiners and Holding of Examinations
32. The Board shall from time to time appoint an examiner or examiners and/or make such other arrangements on its own behalf as it .may .consider
e~pedientafld necessary .for the purpose of holding and controlling examinations of candidates for certificates of registration.
33. The Board may fix and pay such remuneration to the examiner or examiners as the Board thinks fit.
34. The standard of examination of candidates for certificates of registration shall be approximately equal to the standard required for admission as a corporate member of any of the following institutions, or such of the said standards as in the opinion of the Board should be applied to the division or divisions of engineering in which any candidate is
examined:-
( a)
The Institution of Civil Engineers, London; or
(b)The Institution of Electrical Engineers, London; or (c) The Institution of Mechanical Engineers, London; or (d) The Institution of Engineers, Australia; or
(e)
The Australasian Institute of Mining and Metallurgy (Incor- porated) (Engineering Section) ; or
(f)
Such other Institution or body as the Board may from time to time detl!rmine.
35. The subjects of examination of candidates for a certificate of
registration ·as a professional 'engineer shall be such as shall be set out in
the syllabus or rules or regulations as the case may be for the time being
in force relating to the examination of candidates for admission as a
corporate member of any of the Institutions mentioned in the preceding
Regulation:

Provided that the Board may waive all or any of these requirements, and may as
itthinks fit determine that any candidate may be exempted from passing any specified subjects of such examinations.
Examination fees
36. With every application for examination for registration as a professional engineer there shall be paid by the candidate the prescribed examination fee.
Candidates to state where they desire to be examined
37. Each candidate shall state in his application for examination
the town or place at which it will be most wnvcnient for him to be examined; but the Board shall not necessarily hold examinations at such town or place.
Supervisors, etc.
38. The Board may employ and pay supervisors and hire examina- tions rooms, and any such supervisor may requi:re any candidate presenting himself for examination to furnish such proof of identity as such
supcrvi~ormay require.
Examination Results
39. No examiner shall disclose the result
ofany examination or any matter connected therewith except to the Board through the Registrar or as the Board may direct.
40. The Board shall decide as to whether any candidate has passed or has not passed the examination, and the Registrar shall in due course send by post to every candidate a notification as to such decision of the Board.
41. The decision of the Board as to the result of an examination shail
be final.
SCALE OF FEES
42. The fees mentioned in the Schedule hereto, so far as they are
applicable, shall
bepayable to the Registrar by persons applying to be examined or obtaining copies of certificates of registration or inspecting
the register, respectively.
Keeping of Regi.1ter
43. The register shall contain the name of each registered profeshional engineer, his address, also the date of registration, the number of the certificate granted to him, and the division of engineering endorsed thereon.
44. The entries in the register shall be made subject to the provisions
of the Act and the Board's direction, and the certificates granted by the Board to persons whose names are so entered shall be numbered progressively from one onwards.
Interim certificates shall not be so recorded, but shall be recorded in the minutes of the Board's proceedings, which shall be regarded as sufficient evidence of such issue.
CHANGE OF ADDRESS
45. During the month of December in each year every registered
Professional Engineer shall file with the Registrar a memorandum under
his hand setting out any change in his business address.

PRESCRIBED FoRMS
46. The forms in the Schedule, or to the like effect, shall be used for the purposes for which they are respectively applicable.
PENALTY
47. The penalty for any breach of these Regulations shaJI be not more than forty dollars for each such breach.

REPEAL
48. The Regulations made under "The Professional Engineers Act of
1929" on 27th March, 1930, 19th June, 1930, and 23rd July, 1931, and
published in the Gazette on the 29th March, 1930, 21st June, 1930, and
25th July, 1931, respectively, are hereby repealed.

HIS Excellency the Governor, acting by :md with the advice of tht. Executive Coum:il and in pursuan•ce of the provisions of the Projessionul Engineers Act 1929·-1975, ha~ been pleasd to amend "The Professional Engineers Regulations of 1932"
in the manner set out hereunder.

t. In Regulation 2 the words "and numbered progres- sively from one onwards" are deleted.
2. In Regulation 3 the words and figures "In the month of June, in the year 1932 and in the month of April, in the year I 934" are deleted and the following words and figures are inserted in lieu thereof "In the month of April, in the year 1976".
3. In Regulation 6 the words "Each ~uch voting-paper shall be numbered with the number allotted on the aforesaid roll to the person to whom such voting-paper is forwarded, and the said number shall be securely hidden from view by fastening down the corner of the voting-paper with gum or other adht:sive substance. The Registrar shall, before forward- ing, plainly initial each voting-paper on the back thereof"
are deleted.
4. In Regulation I 1 the words "In no circumstances how- ever shall a candidate be elected by lot If such candidate shall have a lesser number of votes than any other candidate not elected" are inserted after the word "votes" where it occurs in the last line of this Regulation.

"27A. Any body corporate desiring approval as an approved professional .::ngineering company shall furnish to the Board an application in the prescribed f0rm or to the like effect and shall pay to the Board therewit!J the prescribed fee.
Upon proof to the satisfaction of the Board that the body corporatt: is entitled to be registered as an approved profes- sional engineering company, the Bow·d shall register such corporate body as an approved professional engineering com- pany ;md subject to the Act and Regulations thereunder issue a Certificate of Approval.
27B. Any body corporate desiring renewal of approv·1l as an approved professional engineering company shall fu<nish to the Board an applicatiun in the prescribed form and shall pay to the Board therewith the prescribed annual roll fee, and supply other such information as the Board may require.
Upon proof to the satisfaction of the Board that the body corpor<t~te is still entitlt:d to be registered as an approved professional engineering company the Board shall grant ~
renewal of the Certificate of Approval.'' 9. Regulation 28 is deleted.
10. Regulation 29 is deleted and the following Regulation is inserted in lieu thereof:-
"29. Before finally dealing with any applkation for regis- tration or approval, the Board may from time to time require further proof that the applicant properly fulfils the conditions entitling him or the body corporate to registration or approval and may, if thought so desirable, appoint a time and plact:
for any applicant for registration or approval to appear before the Board or any sub·committee appointed for that particular purpose, and answer questions and give further informa!ion relative to the claim for registration or approval. A body corporate may be represented by counsel solicitor or auth..Jrised agent."
11. Immediately following Regulation 31 the following Regulation is inserted:-
"31 A. The Certificate of Approval issued by the Board shall be in the form prescribed in the Schedule or to the like effect. Every approved professional engineering company shall obtain from the Board the Certificate of Approval of the Board for which it shall p:1y the prescribed fee if any."
12. Regulation 34 is ddeted and the following Regulation is inserted in Hcu thereof:---
"34. The standard of examination of camlidates for certificates of n:gistration shall be equivalent to the standard required for admission as a corporate· member of any of the institutions, cst<tblished for th·~ purpose of promoti!1g the study and pn•ctice of Engineering of which the Board shall appr<>Ve, or such of the ~aid standards as in the opinion of the Board should be applied to the division or divbions of engineering in which any candidate is examined."
13. Regulation 42 is deleted and the following Regulation inserted in lieu thereof:-
"42. The fees set forth in the Schedule hereto ~hall be the prescribed fees with respect to the purposes specified."
14. In Regulation 47 the word "forty" is lkletcd and the word "fifty" is inserted in lieu thereof.
