Department of Local Government Brisbane, 25th June, 1987 HIS Excellency the Governor, acting by and with the advice of the Executive Council, and in pursuance of the provisions of the Sewerage and Water Supply Act 1949-1985, has been pleased to make the following regulations.

PART I-PRELIMINARY

1. Short Title. These regulations may be cited as the Sewerage and Water Supply Regulations 1987.

2. Repeal. The Sewerage and Water Supply Regulations of 1949 are hereby repealed.

3. Commencement. These regulations shall commence on 1st July 1987.

4. Arrangement. These regulations are arranged as follows- PART I-PRELIMINARY (Regulations 1-6);

PART II-EXAMINATIONS AND LICENCES (Regulations 7-16);

PART III-MEETINGS AND PROCEEDINGS OF THE BOARD (Regulations 17-24);

PART IV-MISCELLANEOUS (Regulations 25-28);

PART V -JOINT COMMITTEE, APPLICATION AND EVALUATION (Regulations 29 and 30);

SCHEDULES.

5. Forms. (1) The forms set forth in the First Schedule hereto shall be used for the purposes for which they are respectively applicable.

(2) A form prescribed by these regulations shall be completed in accordance with such directions as are specified in the prescribed form.

(3) In these regulations a reference to a form by number is a reference to a form in the First Schedule hereto which bears that

number. ·

6. Fees. The fees set forth in the Second Schedule shall be the prescribed fees payable to the Board in respect of the matters specified therein.

PART II-EXAMINATIONS AND LICENCES

7. Examiners. The Board may appoint or approve of examiners to conduct the examination of candidates for licences.

8. Times of Examination. Examinations for licences shall be held at such times and places as the Board approves.

9. Manner of Examination. The Board shall determine the manner ofthe examinations conducted by it, or on its behalf, and may determine that oral, written, or practical tests, or any or all of these, shall be employed.

10. Application for Examination. A person desirous of sitting for an examination conducted by or on behalf of the Board shall make application to the Board in Form 1. The application shall be accompanied by the prescribed fee.

11. Application for Licence. (1) A person who seeks to be granted . a Plumber's Licence, Country Plumber's Licence, Water Plumber's Licence or Drainer's Licence shall make application to the Board in Fomn 2. The application shall be accompanied by the prescribed fee.

(2) A person who seeks to be granted a Restricted Water Plumber's Licence shall make application to the Board in Form 3. The application shall ·be accompanied by the prescribed fee.

12. Grant of Licences. (1) Every licence granted by the Board shall, unless sooner cancelled or suspended, be in force for a period not exceeding 12 months, as specified in the licence.

(2) An interim licence granted by the Board shall remain in force from the date of granting until such time as the Board may determine.

The date of expiry shall be shown on the licence.

13. Renewal of Licences. (1) Every licence may, before the date of expiration thereof, be renewed upon application to the Board and payment of the prescribed renewal fee:

Provided that the Board may within 12 months after the date of expiration of a licence, grant an application for the renewal upon payment of the outstanding renewal fee and the prescribed reinstatement fee.

(2) Every licence shall, upon being duly renewed and unless sooner cancelled or revoked, be in force for a period not exceeding 12 months, as specified in the certificate of renewal of licence.

14. Issue of Licences. (1) A licence granted by the Board shall be in Form 4.

(2) An interim licence granted by the Board shall be in Form 5.

(3) A licence or an interim licence granted by the Board shall be signed by the Secretary ·and the Chairman or other member of the Board.

15. Register of Licences. The Board shall cause to be kept a register of all licences and matters affecting licences issued by it.

16. Replacement Licence. If any licence is lost or destroyed, the holder, or some person having knowledge of the facts and circumstances, may make a statutory declaration with respect thereto and the Board if it is satisfied with such declaration, may issue a replacement licence on payment of the prescribed fee.

The replacement licence shall be endorsed with a memorandum setting out the reasons for the issue thereof, and thereafter such licence shall be available as if it were the original licence.

PART III-MEETINGS AND PROCEEDINGS OF THE BOARD 17. Ordinary Meetings. (1) The Board shall meet at such time and place as the Board directs.

(2) Notice of the time and place of an ordinary meeting, and of the business for such meeting, shall be given by the Secretary to the Chairman and every other member at least seven days before the date of the meeting.

18. Special Meetings. (1) A special meeting may be called by the Chairman, either at his discretion or at the request of any two members.

(2) If the Chairman fails to call a special meeting after a request has been made by 2 members, the members of the Board, other than the Chairman, may call the meeting.

(3) Notice of the time and place of a special meeting and of the business for such meeting, shall be given by the Secretary to the Chairman and every other member at least seven days before the date of the meeting.

19. Quorum. If a quorum is not present within fifteen minutes after the notified time of any meeting, the meeting shall lapse and the Secretary shall record the names of the members present in the minute book.

20. Voting. (1) The Board shall exercise or perform a power, authority, function or duty by the majority vote of members present at a meeting.

(2) The Chairman shall have a deliberative vote and also in the event of an equality of votes on any matter, a casting vote.

(3) If any member present at a meeting refuses to vote, his vote shall be recorded for the negative.

21. Procedure at Meetings. (1) The Chairman shall preside at all meetings of the Board and in his absence an Acting Chairman shall preside.

(2) An Acting Chairman shall have all the powers, authorities and responsibilities, and shall perform all the duties of the Chairman.

(3) The Board may adjourn the meeting to any subsequent time.

(4) No business shall be transacted at a meeting unless it was specified in the notice for that meeting.

22. Order of Business. (1) Unless otherwise determined by the Board, the order of business for each ordinary meeting shall be-

( a) Apologies;

(b) Confirmation of the minutes of the preceding meeting;

(c) Matters arising from the minutes of the preceding meeting;

(d) Correspondence;

(e) Consideration of licences;

and

(f) Other business.

(2) At all meetings of the Board, there shall be no discussion of the minutes of the preceding meeting of the Board, except as tq their accuracy, prior to their confirmation. The minutes when confirmed shall be signed by the Chairman.

23. Minutes. (1) The Board shall cause to be kept full and accurate minutes of each meeting of the Board.

(2) A copy of the minutes of each meeting of the Board shall be forwarded by the Secretary to each member as soon as possible after such meeting.

24. Duties of the Secretary. The Secretary shall- (1) Issue notices of meetings of the Board;

(2) Keep minutes of meetings;

(3) Conduct correspondence;

( 4) Keep records of examinations;

(5) Cause the register to be duly and punctually entered up with a record of the issue, cancellation and suspension of licences and [alternations]* and amendments;

( 6) Collect fees;

(7) Perform such other duties pertaining to the business of the Board as the Board may direct.

PART IV-MISCELLANEOUS

25. Evidentiary Provisions. (1) In any proceedings for an offence defined in this Act the production of a certificate purporting to be signed by the Secretary certifying that-

(a) a person named therein was or was not, at a date or during a period specified therein, the holder of a licence issued pursuant to this Act;

(b) a person named therein was on a date specified therein removed from the register of licences~

or

(c) the licence issued to a person named therein was suspended for the period specified therein, ,

shall be evidence of the matters contained in the certificate and in the absence of evidence to the contrary, shall be conclusive evidence.

(2) A certificate purporting to be signed by the secretary to the Industry and Commerce Training Commission certifying that a person named therein was or was not, at a date or during a period specified therein, an apprentice as defined in the Industry and Commerce Training Act 1979-1986, shall be evidence of the matters contained in the certificate, and in the absence of evidence to the contrary, shall be conclusive evidence.

· 26. Service of Notice. Any notice, order or other document required or authorised to be given or served to or upon any person may be given or served by sending it by registered post.

27. Licensee to Notify Board of Change of Address. A licensee shall notify the Board of any change of address within one month thereof

28. Notice for Breach of Water Restriction etc. (1) The notice which may be given by a Local Authority pursuant to Section 18 (4) of the Act shall be in Form 7.

(2) The sum prescribed of money which may be paid by way of penalty for a contravention of any limitation, restriction or prohibition imposed by By-law 5 of the Standard Water Supply By-laws shall be

$50.00 for each offence.

PART V-JOINT COMMITTEE, APPLICATION AND EVALUATION

29. Fees. The fees set forth in the Third Schedule shall be the prescribed fees payable to the Joint Committee in respect of the matters specified therein.
