Unless otherwise provided, this law shall enter into force on a date to be announced by the Governor in Council by proclamation published in the Government Gazette. All officials appointed under the repealed Act and who exercise their duties on the entry into force of this Act shall be deemed to have been appointed under this Act. 34; Chief Fire Officer” - The chief fire officer of the rural fire district appointed under and for the purposes of this Act;

Each member of the board shall, by virtue of his office, have with respect to each rural fire district all the powers, authorities and jurisdiction of a chief fire marshal under this Act. I). The provisions of this part of this Act shall apply only within any rural fire district.

Such an application, which pursuant to this section is submitted to a chief fire marshal, must be forwarded by the latter to the fire marshal for the fire marshal's possible district, where the fire is to be lit, for the exercise. under this sub-section of the latter's discretion thereon. Within fourteen days after he is notified of the fire marshal's refusal of a permit, the applicant may submit to the board the question of such refusal, and the board may authorize an inspector to investigate the question of the application and the refusal. In any event, but without prejudice to the validity and enforceability of this decision, the decision of the Chief Fire Warden or Fire Marshal, as the case may be, shall be communicated in writing to the person requesting the prohibition and the person intending to light the rural fire.
The conditions under which a permit is granted under this section shall be specified in the permit and the permit shall only authorize the burning, maintenance and use of fire during the period for which such permit exists on land or part of land specified and for the purpose and subject to of all the conditions stated there. If the chief fire marshal prohibits the burning of any rural fire under this subsection, he may, after the termination of that prohibition either by reason of the time, event or occurrence of the circumstances specified in the prohibition, issue a permit for such period and on such terms as he thinks fit. The conditions under which a permit is granted under this section are set out in the pen¢t and the permit only authorizes the lighting, maintenance and use of fire during the period for which such permit exists, on land or part of land specified and for the purpose and subject to all conditions stated therein.
Where a permit authorizing the lighting of a national fire has previously been issued under this Act and remains in force immediately prior to the issuance of the order and the chief fire chief requires compliance with special conditions under this paragraph when lighting, maintaining , maintenance, and use of that fire, then these special conditions are deemed to be specified in that permit. For any purpose for which the Council (which is hereby authorized) has, by notice published in the Government Gazette, imposed a prohibition in respect of the whole or any part or parts of the State as specified therein; or. Without limiting the generality of the above provision, such condition may include the provision of fire breaks as deemed necessary by the Council. If any person creates a fire hazard by felling, pruning or brushing trees or other vegetation or otherwise, which is in the opinion of the Council or the chief fire officer of the rural fire district where the fire hazard arises. An inspector has and may exercise all the powers and authority conferred by this section on the Council or a chief fire officer and for that purpose a reference in this section to the Council or a chief fire officer shall be construed as a reference to an inspector.
2) (i) The Board shall, as soon as practicable after the registration of a bushfire service, publish in the Gazette a description of the district within which, except as provided in this Act, the service in question may operate. ii) Bush Fire Service District. Subject to this Act, a forest fire brigade operating outside its district and within another forest fire district is subject to the direction and control of the first officer of the forest fire brigade for the district in which it operates. All costs and expenses incurred in the administration of this Act shall be defrayed from moneys to the credit of the Fund. All proceedings in respect of offenses against this Act, except such offense as is declared to be a crime by this Act, shall be summarily heard and determined under the Judges Acts, 1886 to 1945, on complaint by the Board, or by any inspector, fire chief, fireman, forest officer, member of the Police Force, or any person authorized by the Council:.

The Secretary shall cause a proper record to be kept of all proceedings of the Board, and the names of the members present at each meeting shall be entered in a book to be kept for that purpose. The work schedule must be determined by the board's decision or, in the absence of such a decision, as determined by the chairman. Any application for registration as a bushfire service by a body of persons appointed by a local authority shall be in or to the effect of the following form:-. Subject to these rules hereafter, provided that any person above the age of sixteen shall be eligible for membership of a bush fire service. The first officer, second officer, third officer, and such other officers of a bush fire service as may be considered necessary, shall be elected by a meeting of the members called for that purpose.
At the first meeting of a forest fire brigade, the members present at that meeting elect a chairman from among themselves for that meeting. Immediately after the election of an officer of a forest fire brigade, such brigade shall notify the Rural Fires Board of the name of the officer elected and the office to which he has been elected for entry in a register to be maintained by such board. Provided that the Brigade may, subject to the approval of the Council, appoint officers for a term of less than three years.
A forest fire brigade shall meet at such times as may be determined by decision of the members. Unless otherwise expressly provided in these Rules, the senior officer of a forest fire department present at a meeting shall preside over that meeting. The forms contained in these Regulations, with such modifications as circumstances may require, shall be used for the purposes for which they respectively apply: Provided that no form shall be deemed invalid if it conflicts with the proper form contained in these Regulations.
