PROCLAMATION.

By His Excellency Sir AETHUE EDWAED KXNNEDY,

Knight Commander of the Most Distinguished Order of St.

Michael and St. George, Com- A. E. KENNEDY, panion of tho Most Honourable Order of the Bath, Governor and Commander-in-Chief of the Colony of Queensland and its Dependenciea.

HEREAS, b Letters Patent under the

Great Sear of the United Kingdom of Great Britain and Ireland, bearing date the tenth day of October, in the forty-second year of the reign of H e r Majesty Queen Victoria, H e r said Majesty did authorise the Governor for the time being of the Colon of Queens- land, by Proclamation under his d u d and the Public Seal of the Colony, to declare that from and after a day to be therein mentioned, certain Islands, which are described in the Schedule hereto, should be annexed to and form part of the said colony: And in the said Letters Patent i t was provided that the said Governor is not to issue such Proclamation as aforesaid until the Legislature of the said colony shall have passed a law providin that the said Islands shall, on the da aforesaif, become part of the said colony, and su&ect to the laws i n force therein; and in the said Letters Patent it was also provided that the ap lica- tion of the said laws to the said Islands miggt be modified either by such Proclamation as. aforesdd, or b any law or laws to be Gom time to time passed by t t e Legislature of the said colony for the govern- mentof the said Islands so annexed : And whereas by an Act passed by the Legislature of the said Colony of Queensland in the forty-third year of, the reign of H e r Majesty Queen Victoria, entitled An Act to provide that certain Islands i n Torres Straits and I ing between the Continent of Australia and the h a n d qf New Uuinea shall become part of the Colony 4 Queensland and suhject t o the law8 in

force therein," it is enacted that from and after 'such a da as His Excellency the Governor of Q u e e n s l a n ~ s h d l b Proclamation under his Hand and the Public SeaTof the Colony, as is authorised by the said Letters Patent, mention and a p oint for that pur ose, the Islands described in the {chedule hereto si, be annexed to and become part of the Colony of Queensland: Now, therefore, I, the Governor aforesaid, in pursuance of the power 80

vested in me, and b and with the advice of the Executive Council, i o hereby notify and proclaim that from and after the first day of August, in the year of our Lord one thousand eight hundred and seventy-nine, the Islands described in t h e Schedule hereto shall be annexed to and become part of the Colony of Queensland, and shall be and become subject to the laws in force therein.

SCHEDULE.

Certain Islands in Torres Straits and lying between the Continent of Australia and Island of New Quinea, that is to my, all Islands included within a line b w n from Sandy Cape northward t o the south-eastern limit of Great Barrier Reefs ; thence following the line of the

&eat Barrier Reefs to their north-eastern extremity near the latitude of nine and a half degrees south ; thence in a north-westerly direction embracing East Anchor and Bramble Ca s ; thence fromBramble Cays in a line west by south 6outh seventy-nine degrees west) true, embracing Warrior Reef, Saibai, andTuanIslanda ; thence diverging in a north-westerly direction EO as to embrace the group known an the Talbot Islands ; thence to and embracing the Deliverance Islands, and onwardu in a

west-by-south direction (true) to the meridian of one hundred and thirty-eight degrees of east longitude.

Given under my Hand and the Great Seal of the Colony, at Government House, Brisbane, this eighteenth day of Jul in the year of our Lord one thousand eigft hundred nnd seventy-nine, and in the forty-third year of Her Majesty's reign,

Tasmania, by whom it has been transferred to the Anglo-Australian G w n o Company. Some enquiry has been made about renewing this license, but I am not able to inform you how far the negooiation for suoh renewal has proceeded; and I would suggest, therefore, that you should, a t an early opportunity, communicate with the Qovernor of New South Wales upon the subject. The commiwion of 1863 to Sir John Young, and a late one of 1868, addressed to the Governor of New South Wales for the time being, a copy of which I enclose for your information, included all the islands reforred to in the present Letters Patent ;.you will

rceive that the power to deal with them will cease upon their coming within the jurisdiotion of the

&eensland Government. I trust that the transfer under the Letters Patent will be made without any delay, b u t in tho meanwhile, I think it will be convenient that any negooiation or agreement with respeot to any of these islands should be conducted and made by you as Governor of the Islands under theee L e t k m Patent rather than by the Governor of New South Wales under his commission.

I may add that any rent or profit derived from these Islands will form part of Imperial revenue until such annexation hrts been effected.

Dated 30th May, 1872.

VICTORIA, b y the Grace of God, of the United TCingdom of Great Britain and Ireland, Queen, Defender of the Faith, to dl to whom these Presents shull comc, greeting.

Whereas me did, by certain Letters Patcnt, under the Great Peal of our United Kingdom, bearing date a t Westminster the 6 t h day of June, 1859, in the twenty-secaud year of our reign, ereot oertain territories therein dcscribed, together with all and every the adjacent Islands, their members and appurtenances in the Pacific Ocean, into R colony by the name of the Colony of Queensland.

And whereas i t is expedient that all the Islands lying and bein within 60 miles of the coasts of the said Colon;p ahould be annexed to, and form part of, the said Colony of &eensland, if the Legislative Counoil and Assembly thereof should desire suoh annexation.

And whereas i t i s expedient that, until such annexation, the affairs of the said Tslanda Rhould be administered by a Governor, to be for that purpose appointed by US :

Now know ye, t,hat, in considerations of the premises, We, of our special grace, mere )notion, and oertain knowledge, have thought fit to constitute and appoint, and by these presects do constitute and appoint, t h e Goveinor and Commander-in-Chief for the time being of Our said Colony of Queensland, to be the Governor of the said Islands, and We do hereby vest in him all the powers and authorities which by these presents are given and granted to tho Go-mnor for the time being of the asid Islands.

Temporary administration during the Governor's absence.

And We do hereby fwthcr d c o l ~ i c Our plcasuro to t o , tlitlt iu the event of thc death or incapacity of the said Governor and Commander-in-Chief for the said Colony of Queensland, or, in the evcnt of his absenting himself from the said Colony otherwise than for the purpose of visiting the said Islands, then, and in either of these caes, the officer for the time being r h o may be administering the Government of the said Colony shall bo and he is bereby constituted and appointed Govcrnor for thc time being of the said Islnnds.

Power lo make rules, &c.

And We do hereby further authorise and empower the Enid Governor of the Islands to make all such rules and regulations as may lawfully be made by Our uuthority for the order, peace, and good government of the s d d Islands, subject nevertheless to any instructions which may from time to time be hereafter given him, under Our sign manual aiid signet, or through one of Our principal Secretaries of State

And We do hereby further ttuthorisc and empower the said Governor of the said Islands, so long as he shall be Governor thereof, by any instrument under his hand and seal, t o make leases and other dispositions for a term or term o f years, of any of the said Islands as aforesaid, or any part or parts thereof, and to iesue lioenses anthorising the person or persons designated thcreiu to take minerals or guano, or other fertilising substances, or other produce from the said Islands, or any of them, and to insert i n such leases, dispositions, or licenses, as the case may be, all such reservations by way of rent or royalty, or otherwise, and all such conditions, exceptions, and stipulations as may to him seem advisable : Provided idways, that in the execution of the powers hereby conforred on him, he shall conform to such instructions za he may from time t o time

And We do hereby further authorise and empower the mid Governor, as he may deem expedient, unddr hishand and seal, to confirm any grant, disposition, lease, or liccnse, which may have been nude or isaued before the date of these presents, to any person or persons i n respect of the said Islands, or any of them, or any part thereof, by any Governor of Our Coloay of New South Wales, or to aocept a surrender of any suoh grant, disposition, lease, or license, and to make and issue any now disposition, lease, or license to the permm mrrendering the same, or their nominees, under the powers and in the manner hereinbefore deolared.

And We do hereby further deolare Our plcasure to bo that, if a t any time hereafter the T,egislative Council and Assembly of the said Colony of Queensland shall, by resolution or otherwise, request the &d Governor of the said Islands to transfer the &me to the said Colony of Queensland, for the purpose of their being annexed to and forming part of the said Colony, then the said Governor shall, and he is hereby authorised and empowered to transfer to the said Colony the said Islands ; and from and after the date of 8uoh trander the said Islands so. transferred shall be deemed and taken to be, and shall be, annexed to and form part of the said Colony of Queensland.

Proclamation of the surrender of the Islands.

And We further declare Our pleasure to be that the said Governor of the said Islands shall declare by proclamation the said transfer, and from and after the date of such proclamation these presents shall cease and

of none effeot, so far aa relates t o the appointment of G Governor of the said Islnnds and his pomers t h e r e under, but not further or otherwiee, and not so as to affect any instruments, acts, matters, or thibga made or done by him while such Governor as aforesaid, in pursuance of the powers hereby conferred on him.

VICTORIA, by the Qrace of God, of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith, to Our Trusty and Well-bcloved Our Governor and Commander- in-Chief in and over Our Colony of New South Wales, greeting.

Whereas it may happen that guano and other fertilising substances may from time t o time be diecovered on Iblands and other place8 belonging to Us, Our heirs and suocessors, being within the limita hereinafter described, but not within the jurisdiction of any Colonial Crovcrnment ; and whereas it i s expedient to make provision for the disposal and use of such Islands : Now know you that We have thought fit to authorise, and do hereby authorise and empower you Our Governor or Officer Administering the Government of Our said Oolony of New 8outh Wales, by any instrument under your or his hand and seal, to make leases and other dispositions for a term or terms of genrs of any such Islands as aforesaid, or of any part or parts thereof, and to issue licenses authorising t h e person or persons designated therein to take guano or other fertilising substancen from the said Islands, and to insert therein such conditions and stipulations aa may seem to you advisable : Provided that, in the excoution oE the pawers hereby conferredpn you, you shall oonforrn to such instructions as you may from tirne to time rcccive from Us under Our signet and sign manual, or through one of Our principal Secretaries of State.

And We do further declare that the aforesaid powers shall be excrcisabh by you with respect to all suoh Islands as aforesaid situate i n that part of the Indian and South Pacific Oce,.ms which is bounded as follms, that is to say:-On the north by the 10th parallel of south latitude, on the east by the l i O t ? i meridian of west longitude, on thc socith by the Butarctie Circle, and on the west b y t h e 75th meridian of emt longitude.
