KEWAJIBAN NEGARA TERHADAP PERLINDUNGAN HUKUM PENGUNGSI YANG MENJADI KORBAN PERDAGANGAN ORANG MENURUT UNTOC 2000 DAN REFUGEE CONVENTION (STUDI KASUS WARGA KOREA UTARA DI TIONGKOK)

ABSTRAK
Pengungsi memiliki hak untuk mendapatkan perlindungan dari negara dimana ia berada dan tidak boleh dikembalikan ke negara asalnya dari negara tersebut (non-refoulement) seperti yang diatur dalam Pasal 33 1951 Convention Relating to the Status of Refugees, tidak terkecuali pengungsi yang menjadi korbanperdagangan orang. Korban perdagangan orang dapat diberikan status sebagai pengungsi sebagaimana yang diatur dalam UN Protocol To Prevent, Surpress And Punish Trafficking In Persons, Especially Women And Children sebagai pelengkap dari United Nations Convention Against Transnational Organized Crime 2000. Adanya instrumen-instrumen hukum internasional tersebut menimbulkan adanya kewajiban internasional bagi negara pesertanya untuk melindungi pengungsi khususnya yang menjadi korban perdagangan orang. Penelitian ini bertujuan untuk menganalisis tindakan yang melanggar kewajiban internasional tersebut melahirkan kewajiban negara seperti yang diatur dalam ILC Articles on State Responsibility for Internationally Wrongful Acts 2001.
Metode penelitian yang digunakan Penulis untuk menjawab pertanyaan dalam tugas akhir ini adalah metode penelitian yuridis normatif dengan melakukan penelitian kepustakaan dan data sekunder yang berkaitan dengan regulasi mengenai kewajiban negara terhadap perlindungan pengungsi yang menjadi korban perdagangan orang.

ABSTRACT
Refugees have the right to protection from the country where he/she was and not expelled from the country (non-refoulement) as stipulated in Article 33 of the 1951 Convention Relating to the Status of Refugees, not least the refugees who are victims of trafficking. Victims of human trafficking may be granted status as refugees as stipulated in the UN Protocol To Prevent, surpress And Punish Trafficking In Persons, Especially Women And Children as a complement of the United Nations Convention Against Transnational Organized Crime, 2000. The presence of the international legal instruments that give rise to the international obligations for the State to protect the refugees, especially those who are victims of human trafficking. This research aims to analyze that the act in violation of international obligations give rise to state responsibility as stipulated in ILC Articles on State Responsibility for Internationally Wrongful Acts 2001.
The methods used in this research is a juridical normative by researching on literal data and the secondary data which are related to the regulation regarding state responsibility to protect refugees who are victims of human trafficking.
