To : All Customers From : PT Bank Sumitomo Mitsui Indonesia Date : 28 October 2016 Re : New Bank Indonesia Regulation on Monitoring Foreign Currency Flow for Bank and Customer (Bank Indonesia Circular Letter (BICL) No. 18/23/DSta) Dear valued Customer, Nasabah yang terhormat, In the relation to the issuance Bank Indonesia Circular Letter (BICL) No. 18/23/DSta regarding Monitoring of Foreign Exchange Movement (LLD) Activities of Banks and Customers which is issued on 26 October 2016, herewith we inform the regulation.
A. Background
Background of the issuance this regulation: 1. Refer to Bank Indonesia Regulation (BIR) No.
18/10/PBI/2016 dated 29 June 2016 regarding Monitoring of Foreign Exchange Movement (LLD) Activities of Banks and Customers.
2. To increase transparency and availability of information regarding the use of foreign exchange by strengthening the LLD Reports.
B. Main regulation
1) Customer have to submit underlying documents for the below transaction:
a. Outward remittance (outgoing transfer) in foreign currency;
b. The outward remittance conducted in foreign currency with amount equivalent to > USD 100.000,00;
c. With or without foreign exchange.
d. The maximum amount of transaction is the amount specified in the underlying document with tolerance more than 2.5% from nominal of underlying document.
e. For outgoing transfer with underlying document which is not listed in appendix of Bank Indonesia Circular Letter, customer should submit a statement letter complete with the underlying document. Bank will provide the template of statement letter.
2) Regulation to submit underlying document can be except for:
a. Transaction which conduct by the bank for bank’s interest; and
b. Fund transfer to the same customer within the country.
Sehubungan dengan telah diterbitkannya Surat Edaran Bank Indonesia (SEBI) No. 18/23/DSta tentang Pemantauan Lalu Lintas Devisa (LLD) Bank dan Nasabah yang telah diterbitkan pada tanggal 26 Oktober 2016, berikut kami sampaikan informasi mengenai ketentuan tersebut.
A. Latar Belakang
Latar belakang diterbitkannya surat edaran ini: 1. Merujuk pada Peraturan Bank Indonesia No.
18/10/PBI/2016 tanggal 29 Juni 2016 tentang Pemantauan Lalu Lintas Devisa (LLD) Bank dan Nasabah.
2. Untuk meningkatkan transparansi dan meningkatkan ketersediaan informasi atas penggunaan devisa dengan memperkuat laporan lalu lintas devisa.
B. Pokok‐pokok pengaturan
1) Nasabah wajib menyampaikan dokumen pendukung untuk transaksi berikut :
a. Merupakan transaksi transfer dana keluar (outgoing transfer) dalam mata uang asing; b. Transfer dana keluar dalam valuta asing
dilakukan dengan nilai setara > USD 100.000,00;
c. Dengan atau tanpa pertukaran valuta asing. d. Nilai transaksi maksimal sama dengan nilai
dokumen pendukung dengan nilai toleransi lebih sebesar 2.5% dari nilai yang tercantum pada dokumen pendukung.
e. Untuk outgoing transfer dengan dokumen pendukungnya tidak terdapat dalam lampiran Surat Edaran Bank Indonesia, nasabah harus menggunakan surat pernyataan beserta dokumen pendukungnya. Bank akan menyiapkan template surat pernyataan tersebut.
2) Ketentuan menyampaikan dokumen pendukung dapat dikecualikan untuk:
a. Transaksi yang dilakukan oleh bank untuk kepentingan bank itu sendiri; dan
b. Transaksi yang bertujuan untuk pemindahan simpanan oleh nasabah yang sama di dalam Summitmas II, 9th ‐ 11th Floors Jl. Jend. Sudirman Kav. 61 ‐ 62 Jakarta 12190
C. Customer’s Obligation
1) Customers shall provide information, data and/or underlying documents to the Bank correctly. Underlying document shall be submitted to Bank before the settlement of transaction.
2) In the event of Bank Indonesia examination of LLD report correctness, customer shall provide information, evidence, data, underlying document and/or other document within period time specified by Bank Indonesia.
D. Bank’s Obligation
1) Bank shall only accept the fund transfer instruction for LLD transaction which has been supported with underlying document.
2) Bank shall request information, data and/or underlying document to customer who conduct LLD activities through bank.
3) Bank shall verify the conformity between outgoing transfer and the underlying which are recipient’s name and nominal of payment. negeri. C. Kewajiban Nasabah
1) Nasabah wajib menyampaikan keterangan, data, dan/atau dokumen pendukung kepada bank dengan benar. Dokumen pendukung harus disampaikan ke Bank sebelum pelaksanaan penyelesaian transaksi.
2) Dalam rangka penelitian kebenaran laporan LLD oleh Bank Indonesia, nasabah harus memberikan penjelasan, bukti, catatan, dokumen pendukung, dan/atau dokumen lainnya dalam jangka waktu yang ditentukan oleh Bank Indonesia.
D. Kewajiban Bank
1) Bank hanya dapat melakukan pengaksepan perintah transfer dana untuk transaksi LLD sepanjang dilengkapi dengan dokumen pendukung.
2) Bank wajib meminta keterangan, data dan/atau dokumen pendukung kepada nasabah yang melakukan kegiatan LLD melalui bank.
3) Bank harus melakukan verifikasi terhadap kesesuaian antara perintah outgoing transfer dengan dokumen pendukung nya, yaitu terkait nama penerima dan nilai pembayaran. E. Sanction E. Sanksi Violation Pelanggaran Sanction Sanksi Bank Acceptance LLD transaction without

Exemption of Administrative Sanction in form of Penalties
A bank or a customer that has been imposed an administrative sanction in form of penalties may be given exemption of the administrative sanction in the form of penalties with the requirements as follows:
1) The bank or the customer applies for a request for exemption of the administrative sanction in the form of penalties within a specified period of time. The said request is required to be submitted to Bank Indonesia by the end of the following month of the “imposition letter of administrative sanction in the form of financial penalty” issuance month at the latest; and
2) Based on Bank Indonesia’s examination, the

1) Bank atau nasabah mengajukan permohonan pembebasan sanksi dengan dalam waktu yang ditentukan. Permohonan tersebut wajib disampaikan paling lambat akhir bulan berikutnya setelah bulan diterbitkannya surat penetapan sanksi administratif berupa denda;

1) The obligation to submit the supporting documents as referred to in point B will be effective from November 2016.
2) The provisions regarding sanctions in relation with the obligation to submit supporting documents will be effective for transactions that will be conducted starting from March 2017 which will be reported by Bank in April 2017.

G. Ketentuan Penutup
1) Keharusan penyampaian dokumen pendukung sebagaimana dimaksud pada poin B berlaku mulai November 2016.
2) Ketentuan mengenai sanksi sehubungan dengan kewajiban penyampaian dokumen pendukung berlaku untuk transaksi yang dilakukan mulai bulan Maret 2017 yang dilaporkan oleh Bank pada bulan April 2017.
