IN SUKAWERA VILAGE KERTASEMAYA SUBDISTRICT INDRAMAYU REGENCY

ABSTRACT
Every man has a right to convey or express his love and affection to the opposite
gender. We are as a religious and cultured man have a way to legitimate the love which is
legalized by religious law and state law, that is by undergo a marriage. However in reality
there are many couples can't keep their marriage till death do them apart. There are variety
factors as the cause of a divorce. In government's regulation, No. 9 of 1975, a divorce is
agreed when the reasons fit to the government's regulation No. 9 of 1975. Yet in reality there
are divorces have been done with unreasonable and vague reasons. That's what happen with
people of Sukawera who undergo that sort of divorce (unreasonable a nd vague divorce),
Sukarewa is part of district of kertasmaya, Indra mayu regency. The divorve called Tamba
divorce. Based on the ba ckground of the study that have been expalined above, the analyst
formulates 2 problem formulations; the first one is the validity of Tamba divorce related to
the regulation of goverment No.71 of 1974 and related to the compilation of the Law of
Islam. The second is about security for the women who undergoesTamba divorce related to
the compilation of Law Islam.
The method of the writing used by the analyst is descriptive analysis, this is a method
which is depicting and explaining clearly and accurately about the subject which is
discussing, in this case the discussion is about Tamba divorce. Tamba divorce will be
analyzed based on the regulation of government which is still valid right now. The approach
of the study uses Normative Yuridical. The conclusion based on the research that has been
done by the analyst shows that the validity of Tamba divorce is not rightful because Tamba
divorce against the Law of Islam, regulation of government No. 71 of 1974 and No. 9 of
1975. The protection for the women who conduct Tamba divorce can be done when the
husband of the women couldntfuilfill his vow and didnt marry the women. Why this thing can
happen because basically to get a security from the goverent is the right of all the citizen and
that is guaranted by the constitution of Republic of Indonesia 1945.
