HE MINISTRY of Energy and Mineral Resources (ESDM) has announced the names of six candidates for the Director General of Mineral and Coal (Dirjen Minerba). This position was vacant after Bambang Gatot Ariyono retired early May 2020.

The names that passed the administrative selection are Agung Pribadi, currently Agung serves as the Head of the Communication, Public Information and Cooperation Bureau and previously was the Director of Coal Development and Business.

Then Mohammad Priharto Dwinugroho is the Head of PPSDM Geominerba, Ridwan Djamaluddin Deputy for Infrastructure Coordination the Ministry of Maritime and Investment, Yohannes Yudi Prabangkara, Assistant Deputy for Infrastructure Supporting Industries.

Then there are Sujatmiko Director of Coal Business Development and Yunus Saefulhak Director of Mineral Business Development.

Ahmad Redi Gunadarma University Minerba Law Observer said the challenge faced by the Director General of Mineral and Coal in the future is the Minerba Law which currently has many problems, so it needs a clear figure to put in place a new Minerba policy.

EMENTERIAN Energi dan Sumber Daya Mineral (ESDM) telah mengumumkan enam nama calon Direktur Jenderal Mineral dan Batubara (Dirjen Minerba). Jabatan ini kosong setelah Bambang Gatot Ariyono pensiun awa awal Mei 2020.

Adapun nama-nama yang lolos seleksi administrasi adalah Agung Pribadi, saat ini Agung menjabat sebagai Kepala Biro Komunikasi, Layanan Informasi Publik dan Kerjasama dan sebelumnya adalah Direktur Pembinaan dan Pengusahaan Batubara.

Kemudian Mohammad Priharto Dwi- nugroho adalah Kepala PPSDM Geominerba, Ridwan Djamaluddin Deputi Bidang Koor- dinasi Infrastruktur Kemenko Maritim dan Investasi, Yohannes Yudi Prabangkara, Asisten Deputi Industri Pendukung Infra- stuktur.

Kemudian ada Sujatmiko Direktur Pem- binaan Pengusahaan Batu Bara dan Yunus Saefulhak Direktur Pembinaan Peng- usahaan Mineral.

Ahmad Redi Pengamat Hukum Minerba Universitas Gunadarma mengatakan, tan- tangan Dirjen Minerba yang akan datang adalah UU Minerba yang saat ini banyak masalah, sehingga perlu sosok yang jernih menempatkan kebijakan Minerba baru.

"Kebijakan perencanaan pertambangan (mining policy) menjadi kunci tata kelola pertambangan yang baik, 5 tahun terakhir ini tidak berjalan," imbuh dia kepada Kontan.co.id, hari ini.

"Ini memerlukan sikap kenegarawanan Dirjen Minerba. Jelas gennya ialah kepen- tingan Merah Putih," ujar dia.

According to him, the mining industry really needs legal certainty for the continuity of the company's operations.

Ido deserves a sigh of relief. The issuance of this new regulation will also end the polemic surrounding the extension of the coal mining company license of the holder of the Contract of Work (KK) and the Coal Mining Business Agreement (PKP2B).

There are 7 PKP2B companies whose contracts will expire this year until 2025.

Now, approaching the end of the contract, they are overshadowed by their inability to continue operations.

ENYUM sumringah Ido Hutabarat terus mengembang. Presiden Direktur PT Arutmin Indonesia ini penuh semangat menjawab pertanyaan seputar revisi Undang-Undang Pertambangan Mineral dan Batubara (UU Minerba) yang baru disahkan di DPR belum lama ini.

"Tentu kami pelaku industri tambang sangat menyambut baik revisi UU Minerba itu," kata Ido, gembira. Menurutnya, industri pertambangan sangat membutuh- kan kepastian hukum demi kelangsungan operasional perusahaan.

Ido patut menarik nafas lega. Terbitnya aturan main baru ini sekaligus mengakhiri polemik seputar perpanjangan izin perusahaan tambang batubara pemegang Kontrak Karya (KK) dan Perusahaan Perjanjian Karya Pertambangan Batu Bara (PKP2B).

Tercatat ada 7 perusahaan PKP2B yang kontraknya akan berakhir pada tahun ini hingga 2025. Nah, mendekati habis kontrak, mereka dibayangi kekhawatian tak bisa melanjutkan operasinya.

This is because the old version of the Minerba Law, Law No. 4/2009, stipulates that the permit extension process is quite complicated for the first generation mining companies whose contracts have expired.

For example, Article 27 of the Law regulating the concession areas of former PKP2B companies is determined to be a state reserve area (WPN). Furthermore, the implementation of mining business activities in WUPK is carried out in the form of a Special Mining Business License (IUPK).

IUPK can be given to business entities that have Indonesian legal entities, in the form of SOEs, ROEs, or private business entities.

SOEs and ROEs have priority in obtaining IUPK.

While private business entities that want to get IUPK must take part in the WIUPK auction. This is clearly regulated in Article 27, Article 29, and Article 74 of the Mining Law.

In addition, the old version of the Minerba Law also stipulates a maximum concession area of 15,000 hectares. This is regulated in Article 62 of the Minerba Law.

The articles governing the mechanism for extending the permit suddenly make the forehead of the mining entrepreneur wrinkle. The reason is that the mechanism is considered complicated while providing uncertainty for mining companies.

The Ministry of Energy and Mineral Resources must also work around this regulation so that the PKP23B company continues to run.

One of the moves played to secure the extension of the PKP2B is by proposing a revision of PP 23 of 2010 concerning Mining Business Activities. This MEMR step has the full support of coal entre- preneurs.

Pasalnya, UU Minerba versi lama, yakni UU Nomor 4 Tahun 2009, menetapkan alur perpanjangan izin yang cukup rumit bagi perusahaan tambang generasi pertama yang habis masa kontraknya.

Contohnya, Pasal 27 UU itu yang mengatur wilayah konsesi bekas perusahaan PKP2B ditetapkan menjadi wilayah pencadangan negara (WPN). Selanjutnya, pelaksanaan kegiatan usaha pertambangan di WUPK dilakukan dalam bentuk Izin Usaha Pertambangan Khusus (IUPK).

IUPK dapat diberikan kepada badan usaha yang berbadan hukum Indonesia, baik berupa BUMN, BUMD, maupun badan usaha swasta. BUMN dan BUMD mendapat prioritas dalam mendapatkan IUPK.

Sementara badan usaha swasta yang ingin mendapatkan IUPK harus mengikuti lelang WIUPK. Hal ini diatur secara jelas dalam Pasal 27, Pasal 29, dan Pasal 74 UU Minerba.

Selain itu, UU Minerba versi lama juga mengatur batas luas wilayah konsesi maksimal 15.000 hektare. Hal ini diatur dalam Pasal 62 UU Minerba.

Pasal-pasal yang mengatur seputar mekanisme perpanjangan izin itu sontak membuat dahi pengusaha tambang ber- kerut. Pasalnya, mekanisme itu dianggap rumit sekaligus memberikan ketidak pastian bagi perusahaan tambang.

Kementerian Energi Sumber Daya Mineral juga mesti berakrobat menyiasati regulasi tersebut agar perusahaan PKP23B tetap berjalan.

Salah satu jurus yang dimainkan untuk mengamankan perpanjangan PKP2B itu adalah dengan mengusulkan revisi PP 23 Tahun 2010 tentang Kegiatan Usaha Pertambangan. Langkah ESDM ini men- dapat dukungan penuh dari kalangan pengusaha batubara.

However, the discussion on the revision of the PP was stalled because it was opposed by the then Minister of SOEs, namely Rini Soemarno, who still wanted the Minerba Law to be applied in the extension of the PKP2B permit, involving SOE participation.

After being stuck, the PP revision was finally discussed again earlier this year.

However, it was unclear how it would proceed, suddenly the DPR approved the revision of the Minerba Law. Supposing, the one asked for silver, but the one given gold.

Honestly, the business people suddenly happy. The revision of the new law has eliminated all articles which are deemed difficult for the permit extension process.

Instead, in the revised Act, the House of Representatives and the government slipped Article 169 A which regulates the extension of permits without auctions.

In fact, in Article 169 A, an extension of a permit is given with an automatic context, aka almost without evaluation because it is given the word "given guarantee". Even though the previous regulation was only given a diction that could be extended.

Article 169 A Paragraph 1 reads: KK and PKP2B as referred to in Article 169 are granted a guarantee of extension to IUPK as a Continuation of Contract/Agreement Operation by fulfilling the provisions.

Article 169 A also gives an extension period in the form of IUPK as much as 2 times 10 years, so that the total concession period can reach 40 years.

Then, Article 169 B regulates that PKP2B holders can request an extension of 5 years before the contract expires. Previously, in Government Regulation No. 77 of 2014, the extension of the new PKP2B could be given at the earliest 2 years before the contract expires.

Namun, pembahasan revisi PP sempat mangkrak karena ditentang Menteri BUMN kala itu, yakni Rini Soemarno, yang tetap menginginkan UU Minerba diterapkan dalam perpanjangan izin PKP2B, dengan melibatkan partisipasi BUMN.

Setelah sempat mandek, revisi PP akhirnya dibahas lagi awal tahun ini. Namun, belum jelas kelanjutannya, tiba-tiba DPR menge- sahkan revisi UU Minerba. Ibaratnya, yang diminta perak, tapi yang dikasih emas.

Terang saja kalangan pengusaha men- dadak sumringah. Revisi UU yang baru telah melenyapkan seluruh pasal yang dinggap menyulitkan proses perpanjangan izin. Sebagai gantinya, dalam UU hasil revisi, DPR dan pemerintah menyelipkan Pasal 169 A yang mengatur perpanjangan izin tanpa lelang.

Bahkan, dalam Pasal 169 A, perpanjangan izin diberikan dengan konteks otomatis alias nyaris tanpa evaluasi karena dibubuhi kata “diberikan jaminan”. Padahal aturan sebelumnya hanya diberi diksi “dapat di- perpanjang”.

Pasal 169 A Ayat 1 berbunyi: KK dan PKP2B sebagaimana dimaksud pada Pasal 169 diberikan jaminan perpanjangan men- jadi IUPK sebagai Kelanjutan Operasi Kontrak/Pernjanjian dengan memenuhi ketentuan.

Pasal 169 A juga memberi jangka waktu perpanjangan dalam bentuk IUPK sebanyak 2 kali 10 tahun, sehingga total masa konsesi bisa mencapai 40 tahun.

Kemudian, di Pasal 169 B diatur bahwa pemegang PKP2B dapat meminta per- panjangan 5 tahun sebelum kontrak berakhir. Sebelumnya, dalam Peraturan Pemerintah Nomor 77 Tahun 2014, per- panjangan PKP2B baru dapat diberikan paling cepat 2 tahun sebelum kontrak berakhir.

What also makes business people able to breathe a sigh of relief, in this new regulation there are no provisions regarding the maximum limit of 15,000 hectares of concession area.

This means that the permit holder can receive an area as large as the beginning of the concession, and can even submit even greater. Just so you know, the seven coal mining companies whose contracts will expire on average have narrowed the concession area far above that.

Call it PT Arutmin Indonesia, whose contract period expired on November 1, 2020, has a land area of 57,107 hectares.

PT Kendilo Coal Indonesia (KCI) was used up on September 13, 2021 with an area of 1,869 hectares.

Then PT Kaltim Prima Coal was completed on December 31, 2021 with an area of 84,938 hectares; PT Multi Harapan Utama ran out on October 1, 2022, with an area of 39,972 hectares.

Then there is also PT Adaro Indonesia whose contract expires on October 1, 2022, narrowing the land area to 31,380 hectares. Then there is also PT Kideco Jaya Agung whose contract expires on March 13, 2023 with an area of 47,500 hectares;

and PT Berau Coal with an area of 108,009 hectares expired on April 26, 2025.

Of the seven companies, only KCI narrowed the area under 15,000 ha. While others cover tens of thousands of hectares.

Now, with the passing of the revised Minerba Law, it is certain that such a large concession will still fall into their hands.

In fact, the coal reserves contained in the concessions of the coal tycoons are very large. The amount of proven coal reserves managed by the seven PKP2B companies reaches 180 million metric tons per year.

Yang juga membuat kalangan pengusaha bisa menarik nafas lega, dalam aturan baru ini tak ada lagi ketentuan mengenai batas maksimal luas wilayah konsesi 15.000 hektare.

Artinya, pemilik izin dapat menerima luas sama besarnya dengan awal konsesi, bahkan dapat mengajukan lebih besar lagi.

Asal tahu, tujuh perusahaan tambang batu- bara yang akan habis masa kontraknya ini rata-rata mengempit luas lahan konsensi jauh di atas itu.

Sebut saja PT Arutmin Indonesia yang habis masa kontraknya pada 1 November 2020 memiliki luas lahan 57.107 hektare. PT Kendilo Coal Indonesia (KCI) habis 13 September 2021 dengan luas 1. 869 hektare.

Lalu PT Kaltim Prima Coal selesai 31 Desember 2021 dengan luas lahan 84.938 hektare; PT Multi Harapan Utama habis di 1 Oktober 2022 memiliki luas lahan 39.972 hektare.

Kemudian ada juga PT Adaro Indonesia yang kontraknya habis pada 1 Oktober 2022 mengempit luas lahan 31.380 hektare.

Lantas ada pula PT Kideco Jaya Agung yang kontraknya berakhir pada 13 Maret 2023 dengan luas areanya mencapai 47.500 hektare; dan PT Berau Coal luas lahan 108.009 hektare habis 26 April tahun 2025.

Dari tujuh perusahaan itu hanya KCI yang mengempit luas lahan di bawah 15.000 ha.

Sementara yang lain luasnya mencapai puluhan ribu hektare. Nah, dengan disah- kannya revisi UU Minerba, bisa dipastikan konsesi sebesar itu tetap jatuh ke tangan mereka.

Padahal, cadangan batubara yang terdapat di lahan konsesi para taipan batubara itu sangat besar. Jumlah cadangan terbukti batubara yang dikelola tujuh perusahaan PKP2B itu mencapai 180 juta metrik ton per tahun.

Meanwhile, remaining reserves of proven resources amount to another 1.5 billion metric tons. With such a large amount of reserves they truly control almost 70% of national production.

"So the condition was an emergency, indeed, so it was returned to the old PKP2B owner. And finally, it was managed by those companies alone," said Yusri Usman, Executive Director of the Center of Energy and Resources Indonesia (Ceri).

SOEs are excluded

In fact, the spirit of the old Minerba Law is very clear that the natural resources must be controlled by the state. Therefore, there is a mechanism for PKP2B holders to return their assets to the state as WPN, which will then be handed over to SOE management.

This is where the SOE gets a red carpet to manage it as Article 27 paragraph 3 says before it is revised: "State-Owned Enter- prises and Regional-Owned Enterprises as referred to in paragraph (2) shall receive priority in obtaining IUPK."

"Now the SOEs opportunity has disappeared to participate in managing the mining area.

Everything will be managed by foreigners forever," Yusri explained.

In fact, the ease of licensing regulated in the revised Minerba Law is the same as the Omnibus Law on Job Creation draft.

In the draft of Job Creation, the government began by changing the term PKP2B which was extended from the Special Mining Business License (IUPK) to the Special Mining Business Agreement or PBKP.

IUPK land resulting from the extension must become a state reserve area (WPN).

The permit must be auctioned first to the SOE before being contested by the private sector. The area of the extended coal production operation permit is only limited to 15,000 hectares.

Sementara itu, sumber daya sisa cadangan terbukti sebesar 1,5 miliar metrik ton lagi.

Dengan jumlah cadangan sebesar itu mereka benar-benar menguasai hampir 70% pro- duksi nasional.

"Jadi kondisinya darurat, memang, makanya dikembalikan ke pemilik PKP2B lama. Dan akhirnya, dikelola perusahaan-perusahaan itu saja,” kata Yusri Usman, Direktur Eksekutif Center of Energy and Resources Indonesia (Ceri).

BUMN tersisih

Sejatinya, semangat UU Minerba yang lama sangat jelas ingin agar sumber daya alam harus dikuasai oleh negara. Maka itu, ada mekanisme pemegang PKP2B harus mengembalikan aset- nya kepada negara sebagai WPN yang kemudian pengelolaannya akan diserahkan ke BUMN.

Di sinilah BUMN mendapat karpet merah untuk mengelolanya sebagaimana bunyi Pasal 27 ayat 3 sebelum direvisi: "Badan Usaha Milik Negara dan Badan Usaha Milik Daerah sebagaimana dimaksud pada ayat (2) men- dapat prioritas dalam mendapatkan IUPK."

"Sekarang pupus sudah peluang BUMN untuk ikut mengelola lahan tambang itu. Semuanya akan dikelola asing selama-lamanya," jelas Yusri.

Sejatinya, kemudahan perizinan yang diatur dalam revisi UU Minerba ini sama dengan rancangan Omnibus Law Cipta Kerja.

Dalam rancangan aturan Cipta Lapangan Kerja, pemerintah memulainya dengan meng- ubah istilah PKP2B yang diperpanjang dari Izin Usaha Pertambangan Khusus (IUPK) menjadi Perjanjian Berusaha Pertambangan Khusus atawa PBKP.

Lahan IUPK hasil perpanjangan wajib menjadi wilayah pencadangan negara (WPN). Izinnya harus dilelang terlebih dahulu ke BUMN sebelum diperebutkan swasta. Luas lahan izin operasi produksi batubara yang diperpanjang pun hanya dibatasi seluas 15.000 hektare.

However, after becoming a PBKP, PKP2B can be obtained without permission to reduce land. The area of their territory adjusts the agreement agreed in the contract. The PKP2B permit did not go through an auction process, so that the opportunity for SOEs to manage the mines owned by large entre- preneurs was lost.

Seeing the similarity of substance, it is not surprising that many people consider the process of discussing the revision of the Minerba Law as a coating if the Omnibus Law has not been scored in this period.

Especially the discussion of the revised Minerba Law is super fast. New rolling in March 2020, May has been ratified.

Meanwhile, the fate of the design of the world wide broom is still a question mark in the midst of the outbreak of the corona virus.

"They have not had no time to wait for Omnibus Law, so this reckless promulgation,"

said economist Faisal Basri.

Faisal himself did not agree with the council's move to discuss the revision of the regulation.

In line with Yusri, he is more supportive of the government returning and prioritizing consistency in the application of the Minerba Law which had previously been in force.

However, the accusation was quickly denied by the DPR as the party proposing the revision of the Act. Chairman of the Working Committee on the Minerals and Coal Bill (Minerba Bill) House of Representatives Commission VII Bambang Wuryanto emphasized that this bill had been prepared a long time ago. Even the Problem Inventory List (DIM) has been prepared since 2016, and until the end of the 2014-2019 DPR period reached 938 problems.

"So this is a very long process, the DPR and the government do not arbitrarily discuss this. Do not be associated with the Omnibus or corona, there is no connection," he said.

Namun setelah menjadi PBKP, perpanjangan izin dapat diperoleh PKP2B tanpa penciutan lahan. Luas wilayah mereka menyesuaikan perjanjian yang telah disepakati dalam kontrak. Izin PKP2B pun tak melalui proses lelang, sehingga kesempatan BUMN untuk mengelola tambang milik pengusaha besar itu hilang.

Melihat kesamaan subtansi itu, tak heran banyak kalangan menilai proses pembahasan revisi UU Minerba memang disiapkan sebagai pelapis bila Omnibus Law belum gol di periode ini. Terlebih pembahasan revisi UU Minerba super cepat. Baru bergulir lagi Maret 2020, Mei sudah disahkan.

Sementara, nasib rancangan beleid sapu jagat masih tanda tanya di tengah mewabah- nya virus korona ini. "Mereka tidak sudah tidak sempat menunggu Omnibus Law, makanya nekat diundangkan ini," kata ekonom Faisal Basri.

Faisal sendiri tidak setuju dengan langkah dewan menggeber pembahasan revisi beleid itu. Senada dengan Yusri, ia lebih men- dukung pemerintah mengembalikan dan mengutamakan konsistensi penerapan UU Minerba yang sebelumnya telah berlaku.

Namun, tudingan itu buru-buru dibantah DPR sebagai pihak pengusul revisi UU ter- sebut. Ketua Panja Rancangan Undang- undang Mineral dan Batubara (RUU Minerba) Komisi VII DPR Bambang Wuryanto menegaskan, bahwa RUU ini sudah disiapkan sejak lama. Bahkan Daftar Inventarisasi Masalah (DIM) sudah disiapkan sejak 2016, dan sampai akhir DPR periode 2014–2019 mencapai 938 masalah.

"Jadi ini proses yang sudah sangat lama, DPR dan pemerintah tidak sembarangan mem- bahas ini. Jangan dikaitkan dengan Omnibus atau korona, tidak ada hubungannya,"

Coal Entrepreneurs Ask for Relaxation on Royalty Payments

INING entrepreneurs have called for the relaxation of coal royalty payments amid pressure arising from the Covid-19 outbreak.

Indonesian Coal Mining Association (APBI) Executive Director Hendra Sinadia said that when the market conditions were oversupplied so commodity prices continued to be depressed, the company had difficulty managing cash flow.

According to him, this happened due to the widening disparity between the coal benchmark price (HPB) and the actual FOB coal selling price.

"Many buyers prefer the selling price to use a reference price according to the index or known as index-linked," he told Bisnis on Thursday (5/28/2020).

Meanwhile, based on the Minister of ESDM Decree No. 1823K/30/MEM/2018 concerning Guidelines for the Imple- mentation of Imposition, Collection and Payment/Deposit of Non-Tax Mineral and Coal State Revenues, for payment of royalties to the state, it must refer to the HPB.

According to Hendra, with market conditions like this, the actual selling price of coal is getting lower so that the company is burdened with the difference that becomes an obligation to be paid.

"As for the difference between the Actual Selling Price and the HPB experienced by our members, some even reach US$ 5 per ton," he said.

ARA pengusaha tambang meminta ada- nya relaksasi pembayaran royalti batu bara di tengah tekanan yang muncul akibat wabah Covid-19.

Direktur Eksekutif Asosiasi Pertambangan Batu Bara Indonesia (APBI) Hendra Sinadia mengatakan di saat kondisi pasar yang kelebihan pasokan sehingga harga komoditas terus tertekan, perusahaan mengalami kesulitan dalam mengelola cash flow. Hal itu menurutnya terjadi akibat semakin melebarnya disparitas selisih antara harga patokan batubara (HPB) dengan harga jual batubara FOB aktual.

"Banyak pembeli lebih prefer harga jual menggunakan acuan harga sesuai indeks atau dikenal dengan istilah index-linked,"

ujarnya kepada Bisnis, Kamis (28/5/

2020).

Adapun, berdasarkan Keputusan Menteri ESDM No. 1823 K/30/MEM/2018 tentang Pedoman Pelaksanan Pengenaan, Pemungutan, Dan Pembayaran/Penye- toran Penerimaan Negara Bukan Pajak Mineral dan Batubara, untuk pembayaran royalti ke negara harus mengacu kepada HPB.

Menurut Hendra, dengan kondisi pasar seperti ini, harga jual aktual batubara semakin rendah sehingga perusahaan terbebani dengan selisih tersebut yang menjadi kewajiban yang harus dibayar.

"Adapun selisih antara Harga Jual Aktual dengan HPB yang dialami anggota kami bahkan ada yang mencapai US$5 per ton,"

katanya.

APBI requests that the government, in this case the Ministry of ESDM, revise the Minister of ESDM Decree No. 1823K/30/

MEM/2018 concerning Guidelines for the Implementation of Imposition, Collection and Payment/Deposit of Non-Tax Mineral and Coal State Revenues.

"We, APBI has submitted an application letter to the Minister of ESDM asking for support so that the company can survive during the Pandemic period, the govern- ment revised the regulation," said Hendra.

The proposed revision will be in the form of a change in the formula for calculating royalties in the interim, whereby the payment of royalties to the government uses the actual selling price which generally uses index-linked.

"So it is not the current system, which uses the Coal Benchmark Price (HPB), because the price trend continues to decline due to oversupply. The company bears a heavy financial burden because the HPB is higher than the actual selling price, some can even reach US$ 5 per ton," he said.

In addition, APBI also proposed a temporary revision of the Minister of ESDM' decision related to the royalty payment system so that it could be done at least a month after shipment. The reason is that the regulation stipulates that royalty payments will be made prior to shipment.

"Companies are also experiencing cash flow difficulties because royalty payments must be paid before shipping, whereas before depositing royalties to the country can be done 1 month after shipment. At least what is expected by business actors to relax this rule applies for a while about 6 months so the company can survive in the middle the condition of the co-19 pandemic," explained Hendra.

APBI meminta agar pemerintah dalam hal ini Kementerian ESDM merevisi Keputusan Menteri ESDM No. 1823 K/30/MEM/2018 tentang Pedoman Pelaksanan Pengenaan, Pemungutan, Dan Pembayaran/Penye- toran Penerimaan Negara Bukan Pajak Mineral dan Batubara.

"Kami, APBI telah mengajukan surat permohonan ke Menteri ESDM minta dukungan agar perusahaan bisa survive di masa Pandemi pemerintah merevisi beleid itu," ucap Hendra.

Revisi yang diusulkan berupa perubahan formula penghitungan royalti untuk sementara, di mana pembayaran royalti ke pemerintah menggunakan harga jual aktual yangumumnya menggunakan index- linked.

"Jadi bukan dengan sistem sekarang yaitu menggunakan Harga Patokan Batubara (HPB), karena trend harga yang terus menurun akibat oversupply. Perusahaan menanggung beban keuangan yang berat karena HPB lebih tinggi dari harga jual aktual, bahkan ada yang bisa mencapai US$5 per ton," tuturnya.

Selain itu, APBI juga mengusulkan adanya revisi sementara keputusan Menteri ESDM terkait sistem pembayaran royalti agar dapat dilakukan paling tidak sebulan sesudah pengapalan. Pasalnya, dalam beleid itu diatur pembayaran royalti di- lakukan sebelum pengapalan.

"Perusahaan juga kesulitan cash flow karena pembayaran royalti harus disetor sebelum pengapalan, sedangkan sebelum- nya penyetoran royalti ke negara bisa dilakukan 1 bulan setelah pengapalan.

Paling tidak yang diharapkan oleh pelaku usaha agar relaksasi aturan ini berlaku untuk sementara sekitar 6 bulan agar perusahaan bisa survive di tengah kondisi pandemi covid-19," terang Hendra.

He added that despite the current difficult conditions, mining entrepreneurs have so far not proposed changes or reductions in royalty rates or delayed payment of royalties.

Nevertheless, he considered that the royalty rate especially for holders of Coal Mining Agreement (PKP2B) permits of 13.5 percent made Indonesia uncompe- titive in competing with coal exporters from other countries such as Australia and Russia.

However, on the other hand, his party also understands the currently difficult state finances and the PNBP of the coal subsector which covers 80 percent of the mineral and coal sector PNBP is also very important.

Although in difficult conditions and royalty rates for PKP2B are not competitive, it still wants to contribute to state revenue.

"There is a 0 percent royalty, basically 13.5 percent is actually not competitive," said Hendra.

Namun, di sisi lain, pihaknya juga me- mahami kondisi keuangan negara yang sedang sulit dan PNBP dari subsektor batubara yang mancakup 80 persen dari PNBP sektor minerba juga sangat penting.

Meski dalam kondisi yang sulit dan tarif royalti untuk PKP2B tidak kompetitif, pihaknya tetap berkeinginan untuk ber- kontribusi terhadap penerimaan negara.

"Ada yang 0 persen royalti, intinya 13,5 persen itu tidak kompetitif sebenarnya,"

ujar Hendra.

Adaro donates $169,000 to university to produce, distribute ventilators

OAL mining giant PT Adaro Energy has donated Rp 2.5 billion (US$169,000) to the University of Indonesia (UI) to produce and distribute ventilators for COVID-19 patients.

Adaro, in a statement issued on Thursday, said the funds were enough to produce 100 COVENT-20 ventilators, which would be built by the university’s engineering faculty. The funds are to be channeled via Adaro’s charity arm, the Adaro Builds the Nation Foundation (YABN).

“More than 2,000 ventilators are needed by hospitals around the country,” said engineering faculty dean Hendri D.S. Budiono, adding that the university and the faculty were working together in research and innovation to develop various medical equipment.

“The need for ventilators in Indonesian hospitals is quite big, and the government cannot work alone,” said Adaro director and YABN board member M. Syah Indra Aman.

The homegrown ventilator, which the university says costs less than others in the market, had passed clinical trials under the Health Ministry in April, said the head of the COVENT-20 development team, Basari.

The university reinstated its commitment to not commercialize the ventilator, as its production and distribution would be entirely financed through donations coordinated by the university's alumni.

Indonesia, as of Thursday afternoon, recorded 24,538 COVID-19 cases and 1,496 deaths, official data show.

N THE MIDST of a volatile stock market, PT Bukit Asam Tbk (PTBA) decided to take action to buy back shares without the mechanism of a general meeting of shareholders (GMS). The coal mining issuer has allocated funds of up to Rp 300 billion to hold this corporate action.

Corporate Secretary of Bukit Asam Hadis Surya Palapa said, until now PTBA has realized a buyback of Rp 12.5 billion.

Sekretaris Perusahaan Bukit Asam Hadis Surya Palapa mengatakan, hingga saat ini PTBA telah merealisasikan buyback senilai Rp 12,5 miliar.

Launching information disclosure on the Indonesia Stock Exchange (BEI) website, the issuer based in South Sumatra will conduct a buyback in a period of three months, with a period of share buying from 17 March 2020 to 16 June 2020.

"PTBA will carry out this buyback program by entering the market gradually," continued the Hadis.

Since the beginning of the year or on a year- to-date basis, PTBA shares have still dropped 20.68%. However, since a month of trading the shares of the state-owned issuer began to move in the green zone and grew 11.11%.

In his research last week (5/20), Indonesian Securities Analyst Samuel Dessy Lapagu changed the PTBA stock recommendation from buy to sell. The reason is that PTBA's performance is vulnerable to exposure to corona (Covid-19).

The global coal market will still be depressed due to the Covid-19 pandemic sentiment.

Weakening occurred on the supply and demand sides.

As a result, Samuel Sekuritas Indonesia projects PTBA coal production volume this year to fall from 29.1 million tons in 2019 to 24.2 million tons. While PTBA production volume is predicted to rise slightly to 24.4 million tons in 2021.

However, there is a niche for PTBA share- holders, namely the potential dividend payout ratio (DPR) which is attempted the same as last year, which is in the range of 75%.

Dessy lowered PTBA's recommendation to sell (sell) with a target price of Rp 1,860 per share. This recommendation was taken by considering the estimated decline in growth (earnings per share/EPS) in 2020 and 2021 respectively in the range of -35.0% and - 33.8% with the pressure of lower production volumes and the weakening trend in coal prices.

Alhasil, Samuel Sekuritas Indonesia mem- proyeksikan volume produksi batubara PTBA tahun ini turun dari 29,1 juta ton pada 2019 menjadi 24,2 juta ton. Sementara volume produksi PTBA diprediksi sedikit naik men- jadi 24,4 juta ton pada 2021 mendatang.

Meski demikian, ada ceruk cuan bagi peme- gang saham PTBA, yakni potensi ratio pembayaran dividen atau dividen payout ratio (DPR) yang diusahakan sama dengan tahun lalu, yakni di kisaran 75%.

Dessy menurunkan rekomendasi PTBA menjadi jual (sell) dengan target harga Rp 1.860 per saham. Rekomendasi ini diambil dengan menimbang estimasi penurunan pertumbuhan (earning per share/EPS) pada 2020 dan 2021 masing-masing di kisaran - 35,0% dan -33,8% dengan tekanan volume produksi yang turun serta tren pelemahan harga batubara.

T INDO Tambangraya Megah Tbk. while maintaining sales targets and production volume guidelines that were set at the beginning of this year despite facing business challenges due to the Covid-19 pandemic.

Indo Tambangraya's Director of Investor Relations Megah Yulius Gozali said that until now there had been no change in the business plan that had been originally set.

In 2020, the issuer coded ITMG stock is targeting sales of 2020 in the range of 22.4 million to 23.5 million tons.

Meanwhile, the production volume is expected to be in the range of 19 million to 20.1 million tons. ITMG also allocated 2020 capital expenditure (capex) of US$ 49.9 million.

"Currently, the target sales volume, production volume target, and capex have not changed," Yulius told Bisnis on Thursday (5/28/2020).

In the first quarter of 2020 the company produced 4.5 million tons of coal, or around 23.6 percent of this year's production target.

Meanwhile, the company recorded sales of 5.8 million tons or 25.8 percent of the target in the first three months of this year.

The largest sales contribution still came from China with a total sales of 1.6 million tons, followed by Japan of 1.5 million tons.

T INDO Tambangraya Megah Tbk. tetap mempertahankan target penjualan dan panduan volume produksi yang sudah ditetapkan pada awal tahun ini kendati menghadapi tantangan bisnis akibat pandemi Covid-19.

Direktur Hubungan Investor Indo Tambangraya Megah Yulius Gozali mengatakan hingga saat ini belum ada perubahan rencana bisnis yang sudah ditetapkan semula. Pada 2020, emiten berkode saham ITMG itu menargetkan penjualan 2020 berada di kisaran 22,4 juta hingga 23,5 juta ton.

Adapun, volume produksi diharapkan pada kisaran 19 juta hingga 20,1 juta ton. ITMG juga mengalokasikan belanja modal atau capital expenditure (capex) 2020 sebesar US$49,9 juta.

“Saat ini, target volume penjualan, target volume produksi, dan capex tidak ber- ubah,” ujar Yulius kepada Bisnis, Kamis (28/5/2020).

Pada kuartal I/2020 perseroan telah memproduksi 4,5 juta ton batu bara atau sekitar 23,6 persen daripada target produksi tahun ini.

Sementara itu, perseroan mencatatkan penjualan sebesar 5,8 juta ton atau 25,8 persen dari target pada periode tiga bulan pertama tahun ini.

Kontribusi penjualan terbesar masih berasal dari China dengan total penjualan sebesar 1,6 juta ton, kemudian disusul oleh Jepang sebesar 1,5 juta ton.

In addition, Yulius said that in the midst of the Covid-19 pandemic and restrictions on access to several export destinations, the company would continue to maintain existing markets especially in Asia while exploring new emerging markets such as Vietnam, Bangladesh, Myanmar, and the domestic market.

Yulius also claimed there was no cancellation of the purchase contract due to the Covid-19 pandemic. However, a number of buyers requested to reschedule the shipment. ITMG has replaced the new schedule so that the company's sales are still according to plan.

Facing further challenges due to current macro conditions, ITMG will also imple- ment disciplined cash disbursements by cutting costs in each department and ready to carry out further cost optimization to deal with uncertain situations.

On the other hand, in the first quarter of 2020 the company recorded a 19.23 percent decrease in revenue to US$ 365.9 million compared to the same period last year of US$ 453.02 million.

The company also recorded an average decline in coal selling prices of 17 percent from US$ 71.1 per ton to US$ 58.7 per ton year-on-year. This sharp fall in coal prices was caused by the fall in coal demand caused by the spring and exacerbated by the pandemic situation.

As a result, the current year's profit attributable to owner entities in the first quarter of 2020 shrank by 61.2 percent to US$ 15.4 million compared to the same period last year of US$ 39.74 million.

Yulius juga mengaku tidak terdapat pem- batalan kontrak pembelian akibat pandemi Covid-19. Namun, sejumlah pembeli meminta penjadwalan ulang pengapalan. ITMG telah menggantikan jadwal yang baru sehingga penjualan perseroan masih sesuai dengan rencana.

Menghadapi tantangan lebih lanjut akibat kondisi makro saat ini, ITMG juga akan menerapkan pengeluaran kas secara disiplin dengan melakukan pemotongan biaya di setiap departemen dan siap melakukan optimasi biaya lebih jauh untuk menghadapi situasi yang tidak pasti.

Di sisi lain, pada kuartal I/2020 perseroan mencatatkan penurunan pendapatan hingga 19,23 persen menjadi sebesar US$365,9 juta dibandingkan dengan pencapaian periode yang sama tahun lalu sebesar US$453,02 juta.

Dikutip dari siaran pers ADRO beberapa pekan lalu, Adaro Indonesia telah mem- produksi batubara sebanyak 12,75 juta ton per kuartal I-2020 lalu atau naik 4% (yoy) dibandingkan periode yang sama di tahun sebelumnya.

Not only that, Adaro Indonesia's coal sales also rose 5% (yoy) to 13.77 million tons in the first quarter of 2020.

On the other hand, total stripping from three Adaro Indonesia mines fell 18%

(yoy) to 45.58 million bank cubic meters (bcm) in the first quarter. This is due to the fact that the Adaro Indonesia mine experiences a rainy season that is higher than usual conditions. As a result, the stripping ratio obtained by the company reached 3.57 times.

Tak hanya itu, penjualan batubara Adaro Indonesia juga naik 5% (yoy) menjadi 13,77 juta ton pada kuartal I-2020.

Di sisi lain, total pengupasan lapisan penutupan dari tiga tambang Adaro Indonesia turun 18% (yoy) menjadi 45,58 juta bank cubic meter (bcm) di kuartal pertama lalu. Hal ini disebabkan tambang Adaro Indonesia mengalami musim hujan yang lebih tinggi daripada kondisi biasa- nya. Alhasil, nisbah kupas yang diperoleh perusahaan tersebut mencapai 3,57 kali.

Di tengah pandemi virus corona, Adaro Indonesia tetap fokus menjalankan operasi tambang batubara di Kalimantan Selatan dan Kalimantan Tengah seluas 31.380 hektar (Ha) yang aman dan andal.

Perusahaan ini tetap berupaya melindungi kesehatan dan keselamatan para karyawannya dengan memperhatikan protokol Covid-19.

“Strategi bisnis kami untuk sektor batu- bara yaitu mempertahankan profitabilitas sebagai penopang utama grup melalui usaha penambangan yang optimal dan operasi yang efisien,” ungkap dia, Rabu (27/5).

Sekadar informasi, kepemilikan saham atas Adaro Indonesia terdiri dari perusahaan listrik asal Thailand, Electricity Generating Authority of Thailand International Company Limited (EGATi) sebanyak 11,5%

Handling Corona, Bukit Asam Distributes Ventilators & PPE

S a support for the handling of the Covid- 19 outbreak, the Bukit Asam family through the Bukit Asam Foundation distributed a number of medical equip- ment assistance to the Provinces of South Sumatra, Lampung, West Sumatra and the SOEs Foundation.

The assistance was handed over by Arviyan Arifin as the Trustee of the Bukit Asam Foundation, who is also the President Director of PT Bukit Asam Tbk to Representatives from each of the recipient Parties at the SOEs Ministry Building, Thursday (5/28). The handover was witnessed by the Minister of SOEs, Erick Thohir.

Hadis Surya Palapa, PTBA Corporate Secretary, explained that medical equip- ment assistance consisted of 29 sets of Invasive Ventilators and PPE in the form of 2800 face shields, 24,000 surgical masks, 2,000 coveralls with hoods, 1,500 high risk isolation gowns, 4,400 PE isolation gowns, and 5,500 bouffant caps.

This assistance was obtained through a donation program compiled by Bukit Asam together with China Huadian and Ishihara Foundation which are Bukit Asam business partners. Also present at the event were the Regional Secretary of Lampung Province, Fahrizal Darminto; Head of South Sumatra BPBD, Iriansyah; Head of the West Sumatra Liaison Agency, Andre Setiawan and Chairman of the Management of the SOEs Foundation, Harjawan Balaningrath.

Indika's revenue decline was due to the declining contribution of its subsidiary, PT Kideco Jaya Agung. Kideco recorded revenues of US$ 376.4 million in the first quarter of 2020, down 8.2 percent compared to the quarter I/2019 position.

The decline in income could not be separated from the selling price of coal which was also warped. The selling price in the three-month period of 2020 reached US$ 43 per ton, lower than the three-month period of 2019 of US$ 45.7 per ton.

Meanwhile, the income of another subsidiary, PT Petrosea Tbk. (PTRO) also fell 10.1 percent to US$ 103.6 million in the first quarter of 2020. PT Mitrabahtera Segara Sejati Tbk.

MITEN pertambangan PT Indika Energy Tbk. membukukan pendapatan sebanyak US$

641,5 juta pada kuartal I/2020, turun 8,5 persen secara tahunan (year on year/yoy).

Penurunan pendapatan menjadi salah satu penyebab perseroan menderita kerugian di periode tiga bulan pertama 2020.

Penurunan pendapatan Indika disebabkan oleh kontribusi anak usaha PT Kideco Jaya Agung yang menurun. Kideco mencetak pendapatan sebanyak US$376,4 juta pada kuartal I/2020, turun 8,2 persen diban- dingkan posisi kuartal I/2019.

Penurunan pendapatan tak lepas dari harga jual batu bara yang juga lungsur. Harga jual pada periode tiga bulan 2020 mencapai US$43 per ton, lebih rendah dari periode tiga bulan 2019 sebesar US$45,7 per ton.

Sementara itu, pendapatan anak usaha lain, PT Petrosea Tbk. (PTRO) juga turun 10,1 persen menjadi US$103,6 juta di kuartal I/2020. Pendapatan PT Mitrabahtera Segara Sejati Tbk. (MBSS) juga lungsur 21,6 persen menjadi US$16,4 juta. Adapun pendapatan PT Tripatra Engineers and Contractors (Tripatra) meningkat 4 persen menjadi US$100,3 juta.

Azis Armand, Deputy Director of Indika Energy said the corona virus pandemic (Covid-19) caused the global economy to slow down and impact on the mining sector. He added, the company was in a healthy financial position which at the end of the quarter I/2020 still had cash and cash equivalents of US$ 728.2 million.

"In the midst of challenging economic and industrial conditions, our priority is to maintain cash position and optimize capital expenditure," he said through a press release, Thursday (05/28/2020).

Azis said the company also continued to focus on maintaining production efficiency and controlling operational costs. During the first quarter the company produced 9.3 million tons of coal consisting of Kideco which produced 8.8 million tons and PT Multi Tambangjaya Utama (MUTU) which produced 500 thousand tons.

During the first quarter of 2020, the company recorded a gross profit of US$

104.9 million - a decrease of 10.8 percent compared to the first quarter of 2019.

Then the company's operating profit fell 16.9 percent to US$ 68.7 million.

With interest costs plus foreign exchange losses which were mostly unrealized, the company posted a loss attributable to the Owners of the Parent Entity of US$ 21.0 million. The loss position is inversely compared to the first quarter of 2019 which still posted a profit of US$ 11.7 million.

Capital Expenditures

On the other hand, during the first 3 months of 2020, the company used capital expenditure of US$ 43.3 million for the construction of fuel storage in Kariangau, East Kalimantan.

Sepan- jang triwulan pertama perseroan mem- produksi 9,3 juta ton batubara yang terdiri dari Kideco yang menghasilkan 8,8 juta ton dan PT Multi Tambangjaya Utama (MUTU) yang memproduksi 500 ribu ton.

Sepanjang kuartal I/2020, perseroan men- catat laba kotor sebesar US$104,9 juta – menurun 10,8 persen dibandingkan kuartal I/2019. Kemudian laba operasi perseroan turun 16,9 persen menjadi US$68,7 juta.

Dengan adanya biaya bunga ditambah kerugian kurs mata uang asing yang sebagian besar unrealized, perseroan membukukan rugi yang diatribusikan kepada Pemilik Entitas Induk sebesar US$21,0 juta. Posisi rugi tersebut ber- banding terbalik dibandingkan dengan kuartal I/2019 yang masih mencetak laba US$11,7 juta.

Belanja Modal

Di sisi lain, sepanjang 3 bulan pertama tahun 2020, perseroan menggunakan belanja modal sebesar US$43,3 juta untuk pembangunan fuel storage di Kariangau, Kalimantan Timur.

Moody's Investor Service analyst Stephanie Cheong said the ranking was a reflection of the performance of UNTR which has a strong cash balance and a strong market share in the mining and heavy equipment service industry.
