Kreditur lain memiliki peran yang sangat penting dalam perkara kepailitan meskipun bukan merupakan pihak dalam persidangan tingkat pertama. Kedudukan kreditur lain dalam perkara kepailitan adalah sebagai unsur yang harus dipenuhi oleh pihak pemohon pailit dalam mengajukan permohonan pailit yaitu syarat dari ketentuan Pasal 2 ayat (1) UUKPKPU yang mengharuskan adanya dua atau lebih kreditur lain dalam mengajukan permohonan pailit. Namun dalam perkembangan perkara kepailitan, adakalanya kreditur lain menolak dan keberatan dengan kepailitan debitur sehingga berseberangan dengan keinginan pihak pemohon pailit. Hukum kepailitan perlu menyediakan upaya hukum yang dapat digunakan oleh kreditur lain dengan adanya keberatan kreditur lain tersebut, maka perlu dibahas tentang bagaimana upaya hukum dalam perkara kepailitan, bagaimana kedudukan kreditur lain dalam mengajukan upaya hukum pada perkara kepailitan serta bagaimana putusan Mahkamah Agung dalam upaya hukum kasasi yang diajukan kreditur lain pada perkara kepailitan.
Metode penelitian yang digunakan adalah penelitian yuridis normatif yang bersifat deskriftif yang mengacu pada asas-asas hukum dan peraturan hukum yang berhubungan dengan hukum kepailitan di Indonesia dengan sumber data berupa data sekunder.
Dengan demikian, upaya hukum yang disediakan dalam perkara kepailitan terdiri dari upaya hukum biasa yaitu kasasi dan upaya hukum luar biasa yaitu peninjauan kembali. Upaya hukum kasasi juga dapat digunakan oleh kreditur lain meskipun bukan merupakan pihak pada persidangan tingkat pertama dalam hal keberatan dengan putusan hakim sebelumnya. Hal ini merupakan kekhususan dalam perkara kepailitan dan juga sebagai wujud kepastian hukum atas asas keseimbangan yang melahirkan kesetaraan kedudukan antara kreditur lain dengan para pihak yang berperkara pada persidangan tingkat pertama (debitur dan para kreditur). Putusan Mahkamah Agung Nomor : 24PK/N/1999, Nomor : 075K/Pdt.Sus/2007 dan Nomor : 331K/Pdt.Sus/2012 telah memperbaiki putusan hakim terdahulu yang meskipun bagus dan efisien namun tidak menjamin keadilan bagi semua pihak dan ada pihak yang dikorbankan yaitu kreditur lain dan debitur sendiri. Putusan-putusan Mahkamah Agung tersebut telah melahirkan putusan yang adil bagi semua pihak sesuai dengan konsep keadilan Jhon Rawls.

ii ABSTRACT
Another creditor does not refer to the creditor who applies for bankruptcy in a bankruptcy case. However, he/she has an essential role in bankruptcy case. His/her position is a requirement to be met by an applicant who applies for bankruptcy before a court; it is a requirement stipulated in Article 2 paragraph (1) of the UUKPKPU (the Law on Bankruptcy and Suspension of Obligation for Debt Payment) which obliges the presence of two or more other creditors in applying for bankruptcy. However, in the development of bankruptcy cases, the other creditor does not always
meet the wish of the applicant’s creditor. The other creditor occasionally refuses and
objects to the debtor’s bankruptcy. Consequently, the bankruptcy law requires to
make legal efforts that can be used by other creditor to oppose against Judge’s
Ruling; thus, it needs to study how the legal efforts in bankruptcy case are, how the position of other creditor in applying for legal efforts in bankruptcy case are, and how the Verdict of the Supreme Court is in an appeal requested by the other creditor against a bankruptcy case in the Verdict of the Supreme Court No.27K/N/1999, No:075K/Pdt.Sus/2007 and No. 331K/Pdt.Sus/2012.
The research used normative judicial method which was descriptive referring to the legal principles and regulations related to the bankruptcy law in Indonesia with secondary data as the data resources.
Therefore, the legal efforts provided in the bankruptcy case consisted of an appeal and a review. An appeal can also be used by the other creditor to refuse the
judge’s previous ruling which was specialized in bankruptcy case. An appeal by the
other creditor who was not one of the parties involved in the first level court reflected a position equity between the other creditor and the bankruptcy applicant (the debtor themselves or the creditor) who were involved in the first level court. The Judge in investigating and handing down the ruling to the appeal requested by the other
creditor who objected to the debtor’s bankruptcy against the Verdicts of the Supreme
Court No: 24PK/N/1999, No: 075K/Pdt.Sus/2007, and No: 331K/Pdt.Sus/2012 had provided an equal justice for the other creditor and all parties who related to bankruptcy case which was accordance with a theory of justice by Jhon Rawls.
