PRESIDENTIAL DECREE NO. 54/2002 DATED JULY 23, 2002

ON

THE COORDINATING TEAM FOR

ENHANCING THE SMOOTHMESS OF EXPORT AND IMPORT OF GOODS

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Considering :

a. that in the framework of supporting and enhancing the smoothness of export and import of goods as well as to enhance competitiveness of Indonesian economy, it is deemed necessary to integrated and coordinated policies between players, including law enforcement;

b. that in the framework of increasing state revenue, it is deemed necessary to intensify efforts to eliminate smuggling;

c. that in the framework of formulating and implementing the policies as meant in letters a and b above, it is deemed necessary to establish a coordinating team for enhancing the smoothness of export and import of goods.

In view of :

1. Article 4 paragraph (1) of the Constitution of 1945 as already amended by the Third Amendment to the Constitution of 1945;

2. Law No. 10/1995 on customs affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612);

3. Law No. 11/1995 on excise affairs (Statute Book of 1995 No. 76, Supplement to Statute Book No. 3613);

DECIDES : To stipulate :

THE PRESIDENTIAL DECREE ON THE COORDINATING TEAM FOR ENHANCING THE SMOOTHNESS OF EXPORT AND IMPORT OF GOODS.

Article 1

In order to support the enhancement of smoothness of export and import of goods as well as to enhance law enforcement for violation against provision of laws integratedly, the Coordinating Team for Enhancement of the Smoothness of Export and Import of Goods hereinafter called the Coordinating Team shall be established.

The coordinating team shall be assigned :

a. to coordinate efforts to enhance the smoothness of law enforcement for violation against provisions of laws on exported and imported goods as well as their transport equipment; b. to coordinate the intensification of efforts to eradicate all kinds of smuggling;

c. to coordinate the formulation of strategies to enhance the smoothness of export and import of goods;

d. to coordinate the planning, implementation as well as evaluation of activities to enhance the smoothness of flow of exported and imported goods.

Article 3

(1) The membership composition of the coordinating team as meant in Article 1 shall be as follows :

a. Chairman : The Coordinating Minister for Economy; b. Vice Chairman : The Minister of Finance;

c. Members : 1. The Minister of Industry and Trade 1. The Minister of Communications 2. The Indonesian Military Commander 3. The Indonesian Police Chief

4. The Attorney General

d. Secretary : The Secretary of the Coordinating Minister for Economy

(2) In executing its daily tasks, the coordinating team shall be assisted by an executive team consisting of :

a. Chairman : The Vice Secretary of the Cabinet;

b. Members : 1. The Director General of Customs and Excise, Ministry of Finance

2. The Director General of Taxation, Ministry of Finance

3. The Director General of Foreign Trade, Ministry of Industry and Trade

4. The Director General of Sea Transport, Ministry of Communications

5. The Director General of Air Transport, Ministry of Communications

6. The Chief of Military Staff

7. The Deputy for the Indonesian Police Chief in Charge of Operational Affairs

8. The Junior Attorney General in Charge of Intelligence Affairs

9. The Chairman of the Indonesian Chamber of Commerce and Industry

c. Secretary : The Secretary of the Directorate General of Customs and Excise, Ministry of Finance

Article 4

The coordinating team shall be subordinate and responsible to the President. Article 5

In order to execute its tasks, the coordinating team shall be assisted by a secretariat with the organizational structure and working arrangement stipulated by the chairman of the coordinating team.

Article 6

In executing its tasks, the coordinating teams can seek assistance from the Indonesian Military and the Indonesian Police or other institutions to help eradicate all kinds of smuggling.

Article 7

In executing the tasks as meant in Article 2, the coordinating team can invite and/or ask for opinions from government institutions concerned and/or other parties deemed necessary.

Article 8

The coordinating team shall report working programs as well as progresses of its activities to the President.

Article 9

All costs needed for implementing the tasks of the coordinating team shall be borne the State Budget of Revenue and Expenditure.

Article 10

Further provisions needed for the implementation of this presidential decree shall be stipulated by the Coordinating Minister for Economy as the chairman of the coordinating team.
