PEMERINTAH REPUBLIK YAMAN
MENGENAI PEMBENTUKAN KOMISI BERSAMA
DI BIDANG
KERJASAMA EKONOMI, ILMU PENGETAHUAN,
TEHNIK DAN PERDAGANGAN
Pemerintah Republik Indonesia dan pemerintah Republik Yaman, selanjutnya disebut sebagai "Para Pihak",
Berk~inginan unti.Jk memperluas dan mengembangkan kerjasama Ekonomi, llmu Pengetahuan, Teknik dan Perdagangan yang kokoh berdasarkan prinsip persamaan dan saling menguntungkan.
Merujuk pada Pasal 8 Persetujuan Kerjasama Ekonomi, Perdagangan, llmu Pengetahuari dan Teknik yang ditandatangani kedua belah pihak pada tanggal 24 Januari 1994, Telah menyetujui sebagai berikut :
Pasal 1
Pemerintah Republik Indonesia dan Pemerintah Republik Yaman membentuk Komisi Bersama Indonesia - Yaman untuk Kerjasama Ekonomi, llmu Pengetahuan, Teknik dan Perdagangan (selanjutnya disebut sebagai "Komisi'" yang akan terdiri dari wakil-wakil Pemerintah kedua negara.
Pasal2
Komisi Bersama yang dibentuk berdasarkan Pasal 1 mempunyai tugas sebagai berikut :
a) Membicarakan berbagai hal yang berhubungan dengan kerjasama Ekonomi, llmu Pengetahuan, Teknik dan Perdagangan antara kedua negara dalam rangka untuk mendorong dan melanjutkan kerjasama seperti menindaklanjuti dan memantau pelaksanaan persetujuan-persetujuan yang telah ditandatangani oleh kedua negara dibidang-bidang tersebut.

-b) Mempersiapkan rekomendasi-rekomendasi yang diperlukan oleh Pemerintah kedua negara, dengan tujuan untuk peningkatan pertukaran perdagangan, ekonomi, teknik dan ilmu pengetahuan di masa mendatang.
c) Mengembangkan berdasarkan informasi yang berhubungan dengan berbagai hal sebagaimana menjadi pokok-pokok kerjasama antara kedua belah pihak di bidang ekonomi, ilmu pengetahun, teknik dan perdagangan.
d) Mendorong pihak swasta kedua negara untuk berpartisipasi di dalam berbagaibidang investasi dalam rangka memperkuat hubungan antara kedua dunia usaha.
Pasal 3
Komisi terdiri wakil - wakil dari Indonesia dan Yaman. Masing-masing pihak menunjuk Ketua Komisi dengan posisi setingkat Menteri, walaupun, jika memungkinkan dari waktu ke waktu, ketua delegasi dapat dipimpin oleh Wakil Menteri atau Direktur Jenderal. Kedua ketua akan memberitahukan nama-nama sebagai anggota Komisi.
Masing-masing pihak turut aktif berpartisipasi di dalam sidang-sidang komisi dengan disertai oleh sejumlah pakar dan konsultan secukupnya.
Pasal4
Komisi bersidang bergantian tempatnya baik di Indonesia maupun di Yaman dimana waktunya disepakati bersama dan akan diberitahukan melalui saluran diplomatik ..
Pasal5
Hasil-hasil persidangan akan dituangkan di dalam .bentuk Kesepakatan Bersama ditandatangani oleh kedua ketua delegasi.
Pasal6
Untuk mendukung pelaksanaan tugas sebagaimana diatur pada pasal 2 Memorandum Saling Pengertian ini, sidang-sidang komisi akan dilakukan secara pleno (lengkap). Kelompok kerja dimungkinkan pembentukannya dengan persyaratan-persyaratan tertentu dan laporan akan disampaikan kepada pleno (lengkap) untuk pertimbangan. Masing-masing Pleno mengundang para pakar untuk hadir pada sidang.
Pasal7
Masing-masing Pihak menanggung seluruh biaya atas keikutsertaan kegiatan dan partisipasinya didalam Komisi Bersama.

Memorandum sating Pengertian ini berlaku sejak tanggal ditandatangani.
Sebagai bukti, yang bertandatangan dibawah ini, yang diberi kuasa oleh Pemerintah
masing-masing, telah menandatangani Memorandum Saling Pengertian ini.
Dibuat di Jakarta pada tanggal 20 Pebruari 1998 dalam rangkap dua dalam bahasa
Indonesia, Arab dan lnggris, semua naskah mempunyai kekuatan hukum yang sama.
Apabila terdapat perbedaan penafsiran atas Memorandum ini, maka naskah bahasa lngris yang berlaku.

MEMORANDUM OF UNDERSTANDING BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND
THE GOVERNMENT OF THE REPUBLIC OF YEMEN ON THE ESTABLISHMENT OF A JOINT COMMISSION FOR ECONOMIC, SCIENTIFIC AND COMMERCIAL COOPERATION
The Government of the Republic of Indonesia and the Government of the Republic of Yemen (hereinafter referred to as the "Parties").
Desiring to strengthen and develop the economic, scientific, technical and commercial cooperation on firm and strong basis in accordance with the principle of equality and mutual benefit.
Referring to Article 8 of the Economic, Commercial, Scientific and Technical Agreement concluded between them on January 24, 1994;
Have agreed as follows :
ARTICLE 1
The Government of the Republic of Indonesia and the Government of

the Republic of Yemen shall establish a Joint Indonesian - Yemen Commission for Economic, Scientific, Technical and Commercial Cooperation (hereinafter referred to as "The Commission", to be composed of representatives appointed by their respective Governments).
ARTICLE 2
The Commission that has been established in accordance with Article shall undertake the following functions :
a} Reviewing matters relating to the economic, scientific, technical and
commercial cooperation between the two countries with a view of enhancement and continuation of the respective cooperation as well as following up and monitoring of the implementation of the agreements concluded between the two countries in these fields.
b} Preparing necessary recommendations to the Governments of the two
countries, with the aim of developing the commercial exchange and economic, technical and scientific cooperation in the future .

c) Expanding the base of information related to matters which are likely
to become a subject of the joint cooperation in the economic, scientific, technical and commercial fields.
d) Encouraging the private sectors in both countries to participate in the
various investment fields in a manner that strengthens the ties between the people of the two countries;
ARTICLE 3
The Commission consists of both the Indonesian and the Yemeni representatives. Each party appoints its chairman to the Commission with the rank of Minister, however, it is possible that from time to time, both delegations could be headed by authorized Deputy Ministers or Directors General. Both chairmen shall

-notify each other about the names of the members to the Commission from its part Each Party has the right to participate in the meetings of the Commission with a sufficient number of experts and consultants.
ARTICLE 4
The Commission shall meet alternately in Indonesia and Yemen on dates mutually agreed upon which will be communicated through diplomatic channels.
ARTICLE 5
The result of each session will be laid down in Agreed Minutes to be signed by the heads of d~legations.
ARTICLE 6
To facilitate the achievement of the functions r~Jerred to in Article 2 of this Memorandum Of Understanding, the sessions of the Commission will be held in plenary. Working Groups may be set up with specific terms of refer~nce and will submit their reports to the plenary sessions for consideration. Each Party may invite experts to attend the session.
ARTICLE 7
Each Party shall bear the costs of its own participation and activities in the Commission.

ARTICLE 8
This Memorandum of Understanding shall enter into force after the date· of its signing.
In witness whereof, the undersigned being duly authorized by their respective
Governments, have signed this Memorandum of Understanding.
