THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND
THE GOVERNMENT OF AUSTRALI A
RELATING TO THE AUSTRALIAN LANGUAGE CENTRE IN INDONESIA
1 . THIS MEMORANDUM expresses the undersbmdings of the Government of the Republic of Indo-nesia and the Government of Australia con-cerning the responsibilities respectively of the two Governments in regard tu the Australian Language Centre (hereinafter referred to as the Project) located in Jakarta . The Project is intended to provide tuition in Engli sh as further described in Annex 1 to this Memorandum .
2 . The Executing Authorities for this Project will be
For the Indonesian Government : The Counterpart Authority will be the Cabinet Secre -tariat.
For the Australian Government : The Australian Development Assistance Bureau of the Department of Foreign Affairs . The Australian Development Assistance Bureau may nominate suitably qualified agents to undertake any part of its functions on its behalf.
3. This Memorandum will take effect from the date of its signature and the Project will be deemed to have commenced from that date .
PROJECT ORGANISATION
The Australian contribution to the Project and all undertakings given herein will cease 5 year(s) after the date of signature of this Memorandum or on such other date as may subsequently be arranged between the two Governments .
4. Advice on the development and direction of the Project will be provided by a Project Advisory Board, whose chairman will be appointed by the Indonesian Government. Membership of the Board will include
the Australian Project Director and Australian Team Leader who are to be appointed by the Australian Government i n consultation with
the Indonesian Government . Membership of
the Project Advisory Board will also include representatives of the Indonesian Government or nominated at the discretion of the
Indonesian Government, as well as nominees designated by the Australian Embassy, Jakarta. The Board will meet not less than twice each year.
5. Functions of the Project Advisory Board will include :
(a) reviewing and reporting on progress to the two Governments; and
(b) recommending to the Indonesian and Australian Governments changes in
program, budget and future development;
(c) recommend action concerning
implemen-tation of the Centre's program .

6. Overall responsibility for this Project will rest with the Government of Indonesia . The final authority for decisions on imple-mentation of the program will rest with the Cabinet Secretariat after considering advioe from the Project Advisory Board .
7. The contribution of the Australian Government is detailed in Annex 1 and is estimated to value $A.S.7 Million .
Disbursement of this contribution will be subject to the normal parliamentary approval of annual appropriations.
8. An evaluation of progress of the Project may be made at times arranged between and mutually convenient to, the Indonesian and Australian Governments . Such an evaluation would be undertaken by a joint investigation team appointed by the two Governments and independent of staff involved in the Project. 9 . For the purposes of this Project, the
Indonesian Government will, in accordance with prevailing laws and regulations,
facilitate the employment by the Australian Government or its agent of personnel as required for the Project and established between the two Governments by:
(a) granting exemption from income or other taxes on project salaries and allowances;
(b) granting exemption from import and other duties on personal and household effects;

(c) granting exemption from taxes and duties on the purchase in Indonesia of a locally assembled motor vehicle per expert on condition that it either be re-exported , sold to a person who has the same privi-leges, or duty paid on its assessed value at time of sale within Indonesia. The expert's assignment should be on a long term basis of at least twelve (12) consecutive months period;
(d) granting to Australian project personnel all rights and entitlements accorded to the aid personnel of any other donor country; and
(e) expediting the issue of all documentation required for the entry of, and performance of work by, project personnel, including work permits or certificates for eligible persons .
10. (a) The Indonesian Government will, in accordance with prevailing laws and regulations either exempt from import duties and other taxes or pay such duties on all goods supplied for the project;
(b) The Indonesian Government will facilitate movement of project equipment and supplies by providing appropriate customs and wharfage facilities in the port of entry ; and
(c) Project equipment and supplies provided by Australia will be available for the
unrestricted use of the Project and will

not be withdrawn from such use, and the Australian Project Manager will exercise administrative control over such supplies for the duration of the Project .
11 . The Indonesian Government will be responsible for dealing with any claims which may be
brought by third parties against Australia and its experts, agents or Australian personnel and will hold harmless Australia and its ｾＬ＠ agents and personnel in case of any claims or
liabilities resulting from operations under this memorandum.
This provision will not relieve any person from liability for any criminal, grossly negligent or fraudulent act.
12. The Indonesian Government will arrange for any protection deemed necessary to ensure the safety of Australian personnel, project and personnel equipment both at the project location, in transit i n Indonesia, and on
any other official representational activity in Indonesia.
The Australian Government will take reasonable precautions to ensure that ａｵｳｴｲ｡ｬｩ｡ｮｾＡ＠
have due regard for local traditions and customs.
SETTLEMENT OF 13 . Any disputes arising out of the interpretation DIFFERENCES or implementation of the Memorandum will be
settled amicably by consultation or negotiation between the two Governments .
AMENDMENTS 14. Amendments to this Memorandum may be made at any time by an Exchange of Letters between the two Governments .
ANNEXURES to this Memorandum form an integral part of it. SIGNED at Jakarta , in duplicate , this seventh day of
April 1983.

THE AUSTRALIAN LANGUAGE CENTRE PROJECT
A. Objectives
The objectives of the Centre are :
To assist Australia ' s aid program to Indonesia by :
conducting relevant pre-sessional English language and cultural orientation classes for Indonesians nominated for Australian fellowships and for counterpart project staff chosen to go to Australia for study or training; acting as a resource centre for Australian Aid Projects. Centre staff would be able to liaise with and give
support to Australian Aid Project English teaching personnel and would also be able to develop and teach courses in English for Specific Purposes for those Aid Projects which have no English language teacher .
To provide other English language learning activities which will contribute to the social and economic development of Indonesia as determined by the Indonesian Government . Specifically, the Centre could :
analyse the English language training needs of nominated Government Departments or other enterprises , and develop special, skills-specific programs for those agencies.
These programs could include intensive language instruction, materials production, and other staff development activities . provide pre-sessional English language and cultural orien-tation courses for fellows sponsored by other agencies for study in Australia;
provide English language training for Government employees who are, at present, ineliCJible for fellowship merely because of their inadequate English;
other programs as requested by the Indonesian Government and within the Centre ' s capacity .
act as a resource centre to assist English training units in Government Departments .
An important approach of the Language Centre will be to provide training in the use of media and library resources as preparation for candi dates who will undertake formal academic studies in Australia .
B.
(1) Australian Contribution
Australia will completely support the Centre with funds totalling about $A . 5 . 7 million (at 1982 costs) up until June 30, 1988 .
Australia will provide accommodation and remuneration for all Australia- based personnel assigned to the centre namely :
(a) up to ten full time academic staff
(b) one administrative officer
(c) one librarian
(d) one technical officer
(e) term assignments as needed.
(2) Remuneration for :
(a) up to five locally engaged native English speaking teachers
(b) up to fifteen locally engaged staff.
(3) Audio visual equipment (including language laboratories,
video recorders and film projectors) and resources (text
books, audio and video programs) to support written
materials produced by the Centre for teaching English as a foreign language .
( 4) up to 5 passenger vehicles for use by Centre staff.
