MEMORANDUM SALING PENGERTIAN ANTARA

PEMERINTAH REPUBLIK INDONESIA DAN

PEMERINTAH KERAJAAN KAMBOJA TENTANG

KERJASAMA KEBUDAYAAN

Pemerintah Republik Indonesia dan Pemerintah Kerajaan Kamboja, yang selanjutnya disebut "Para Pihak";

BERKEINGINAN untuk memperkuat hubungan persahabatan yang telah ada dan kerja sama kedua negara di bidang kebudayaan;

MENIMBANG perlunya mengembangkan dan meningkatkan hubungan kebudayaan dan kerja sama kedua negara;

MERUJUK pada Persetujuan antara Pemerintah Republik Indonesia dan Pemerintah Kerajaan Kamboja tentang Kerjasama Ekonomi dan Teknik yang ditandatangani di Jakarta pada 21 Juni 1994;

BERDASARKAN pada hukum dan peraturan perundang-undangan yang berlaku di kedua negara;

Telah menyetujui hal-hal sebagai berikut:

Pasal 1 Tujuan Kerja Sama

a. Meningkatkan kerjasama di bidang oudaya dan seni untuk merr1pererat hubungan antara Para Pihak;

b. Meningkatkan pengembangan sumber daya manusia di bidang budaya dan seni;

c. Meningkatkan saling pengertian dan dukungan masyarakat Para Pihak; d. Mengembangkan jaringan kerjasama di bidang pelestarian warisan

sejarah, seni dan budaya;

e. Mendorong saling kunjung di antara pejabat dan warga negara ke masing-masing negara;

Pasal2

Lingkup Kerja Sama

1. Para Pihak akan mendorong organisasi yang terkait di bidang budaya untuk membangun Janngan dan program-program dan untuk mengembangkan kerja sama lebih lanjut dan proyek bersama yang dapat memberikan kontribusi pada penguatan hubungan budaya antara Para Pihak;

2. Kegiatan-kegiatan dalam Memorandum Saling Pengertian ini meliputi, tetapi tidak terbatas pada hal-hal berikut ini:

a. Penelitian dan Pengembangan b. Pendidikan dan Pelatihan c. Promosi budaya dan seni d. Pengelolaan Warisan budaya e. Dialog budaya dan seni f. Pertukaran lnformasi

g. Bentuk kerja sama lain yang disepakati bersama oleh Para Pihak.

Pasal3 lnstitusi Pelaksana

1. Para Pihak berkomitmen untuk menjaga hubungan baik di bidang budaya melalui institusi pemerintah yang berkompeten, yang akan menjadi pelaksana Memorandum Saling Pengertian ini.

2. lnstitusi pemerintah yang bertanggungjawab untuk melaksanakan Memorandum Saling Pengertian ini:

a. Untuk Pemerintah Republik Indonesia adalah Departemen Kebudayaan dan Pariwisata;

b. Untuk Pemerintah Kerajaan Kamboja adalah Kementrian Budaya dan Seni.

Pasal4 Pelaksanaan

Kegiatan-kegiatan yang dirumuskan dalam Memorandum Saling Pengertian ini dapat dilaksanakan melalui pengembangan pengaturan khusus, program atau proyek khusus antara lembaga atau organisasi yang tepat dari Para Pihak. Pengaturan, program atau proyek dimaksud harus merinci antara lain, tujuan kegiatan, pengaturan keuangan dan hal rinci lainnya yang terkait dengan partisipasi pihak-pihak yang terlibat untuk pelaksanaan kegiatan tersebut.

Pasal5 Prosedur

1. Para Pihak sepakat untuk membentuk kelompok kerja untuk memfasilitasi pelaksanaan dari Memorandum Saling Pengertian ini.

2. Kelompok Kerja wajib menyusun rencana prosedur dan merekomendasikan program kerja sama ke arah pencapaian tujuan melalui institusi yang berwenang sebagaimana dimaksud dalam Pasal 3. 3. Kelompok Kerja wajib meninjau pelaksanaan Memorandum Saling

Pengertian ini secara berkala dan menyerahkan laporannya kepada lnstitusi Pelaksana.

4. Kelompok kerja wajib melakukan pertemuan tahunan secara bergantian di Indonesia atau di Kamboja. Jika pertemuan tidak dapat dilakukan karena keadaan tertentu, maka sebagai penggantinya akan dilakukan pertukaran dokumen.

Pasal6

Perlindungan Hak Cipta

Setiap hasil dari kegiatan di bidang ilmu pengetahuan, seni, literatur, sumber genetis, pengetahuan tradisional, dan tradisi yang dilakukan berdasarkan Memorandum Saling Pengertian ini, wajib diatur dalam pengaturan khusus yang sesuai dengan hukum dan perundang-undangan yang berkaitan dengan hak cipta di masing-masing negara.

Pasal 7

Penyelesaian Sengketa

Setiap sengketa diantara Para Pihak terkait penafsiran dan/atau pelaksanaan Memorandum Saling Pengertian ini akan diselesaikan secara bersahabat melalui konsultasi dan/atau negosiasi.

Pasal8 Perubahan

Memorandum Saling Pengertian ini dapat ditinjau kembali atau diubah sewaktu-waktu berdasarkan persetujuan tertulis Para Pihak melalui saluran diplomatik. Perbaikan-perbaikan atau perubahan-perubahan tersebut akan mulai berlaku pada tanggal yang ditetapkan oleh Para Pihak dan merupakan bagian yang tidak terpisahkan dari Memorandum Saling Pengertian ini.

Pasal 9

Mulai Berlaku, Masa Berlaku dan Pengakhiran

1. Memorandum Saling Pengertian ini akan mulai berlaku pada tanggal penandatanganan.

2. Memorandum Saling Pengertian ini akan berlaku selama 5 (lima) tahun dan akan diperbarui secara otomatis untuk jangka waktu 5 (lima) tahun berikutnya, kecuali jika salah satu Pihak memberitahukan secara tertulis keinginannya untuk mengakhiri Memorandum Saling Pengertian ini, melalui saluran diplomatik, paling lambat 6 (enam) bulan sebelum pengakhiran dimaksud.

3. Pengakhiran Memorandum Saling Pengertian ini tidak akan mempengaruhi keabsahan dan masa berlaku dari program-program maupun kegiatan-kegiatan yang sedang berjalan berdasarkan Memorandum Saling Pengertian ini sampai selesainya program-program atau kegiatan-kegiatan tersebut.

SEBAGAI BUKTI, yang bertandatangan di bawah ini, telah menandatangani Memorandum Saling Pengertian ini.

Dibuat dalam rangkap dua di Kuta, Bali pada tanggal dua puluh enam bulan Februari tahun dua ribu sembilan, dalam bahasa Indonesia, Kamboja dan lnggris, setiap naskah memiliki kekuatan hukum yang sama. Dalam hal terjadi perbedaan penafsiran Memorandum Saling Pengertian ini, maka naskah bahasa lnggris yang berlaku.

MEMORANDUM OF UNDERSTANDING

BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA

AND

THE GOVERNMENT OF THE KINGDOM OF CAMBODIA

ON

The Government of the Republic of Indonesia and the Government of the Kingdom of Cambodia, hereinafter referred to as the "Parties";

DESIRING to strengthen the existing friendly relations and closer cooperation between the two countries in the field of culture;

CONSIDERING the need to further develop and foster the cultural relations and cooperation between the two countries;

REFERRING to the Agreement between the Government of the Republic of Indonesia and the Government of the Kingdom of Cambodia on Economic and Technical Cooperation signed at Jakarta, 21st June 1994;

PURSUANT to the prevailing laws and regulations in the two countries;

Have agreed as follows:

Articles 1 Aims of Cooperation

The aims of co-operations of this Memorandum of Understanding are: a. Promoting the cooperation in the field of culture and arts in order to

strengthen the relation of The Parties;

b. Promoting human resources development for culture and arts;

c. Promoting mutual understanding and supporting peoples of both Parties; d. Developing cooperation links in areas of preservation of historic, artistic,

cultural heritages;

Articl1

es 2 Areas of Cooperation

1. The parties shall encourage organization .i;nvolved in the field of culture to establish links and programs and to develop further cooperation and joint projects contributing to the strengthening of cultural relations between the Parties.

2. The activities under this Memorandum of Understanding shall include, but not limited to the following :

a. Research and Development; b. Education and Training; c. Cultural and Arts Promotion; d. Cultural Heritage Management; e. Cultural and Arts Dialogue; f. Exchange of Information;

g. Any other forms of cooperation mutually agreed upon by the Parties.

Articles 3 Executing Agency

1. The Parties are committed to keep close relations in the field of culture through their competent official agencies, which shall be the executive of this Memorandum of Understanding.

2. The official agencies responsible for the implementation of this Memorandum of Understanding are:

a. For the Government of the Republic of Indonesia shall be the Ministry of Culture and Tourism;

b. For the Government of The Kingdom of Cambodia shall be the Ministry of Culture and Fine Arts.

Articles 4 Implementation

Activities described in this Memorandum of Understanding may be implemented through the development of specific arrangements, programs of projects between the appropriate institutions or organizations of the Parties. Such arrangements, programs or projects should specify inter alia, the objectives, financial arrangement and other details relating to specific undertakings of all participation involved.

Article 5 Procedures

1. The Parties agreed to establish a working group to facilitate the implementation of this Memorandum of Understanding.

2. The Working Group shall establish the procedure plans and recommend programs of cooperation towards achieving its aim through the competent agencies as mentioned in article 3.

3. The Working Group shall review the implementation of this Memorandum of Understanding regularly and submit the report to the Executing Agencies.

4. The Working Group shall meet annually alternately in Indonesia or in Cambodia. Otherwise, in certain circumstances where the meeting could not be held, documents shall be exchanged in lieu of such meeting.

Article 6

Protection of Copyright

Any result act in the fields of science, arts, literature, genetic resources, traditional knowledge, folklore which are performed under this Memorandum of Understanding shall be subject to special arrangements in accordance with the laws and regulations concerning copyright in their respective countries.

Article 7

Settlement of Dispute

Any dispute between the Parties concerning the interpretation and/or implementation of this Memorandum of Understanding shall be settled amicably through consultations and/or negotiations.

Article 8 Amendment

The Memorandum of Understanding can be reviewed or amended at any time by mutual written consent of the Parties through diplomatic channels. Such revisions or amendments shall enter into force on such date as may be determined by the Parties and shall form an integral part of this Memorandum of Understanding.

Article 9

Entry into Force, Duration, and Termination

1. This Memorandum of Understanding shall enter into force on the date of its signing.

2. This Memorandum of Understanding shall remain in force for a period of 5 (five) years and shall be automatically renewed for 5 (five) years, unless either party notifies in writing of its intention to terminate this Memorandum of Understanding through diplomatic channels, at least 6 (six) months prior to its expiration.

3. The termination of this Memorandum of Understanding shall not affect the validity and duration of any on-going programs or activities made under this Memorandum of Understanding until the completion of such programs or activities.

IN WITNESS WHEREOF, the undersigned, have signed this Memorandum of Understanding.

Done in duplicate at Kuta , Bali on the twenty sixth day of February in the year two thousand and nine, in Indonesian, Khmer and English languages, all texts being equally authentic. In case of any divergence on the interpretation of this Memorandum of Understanding, the English text shall prevail.
