PASAL1 TUJUAN

Tujuan Memorandum Saling Pengertian (sel anjutn ya disebut 'MSP') ini adalah untuk mem ben tuk sebuah ke rangka ke rjas ama bilatera l da lam bid ang pena nggu lan gan bencana be rdasarkan pri nsip ｫ･ｾ･ｴ｡ ｲ｡｡ｮ Ｌ＠ azas tim bal ba lik, sali ng meng untu ngkan, salin g menghorm ati dala m rangka men doron g hu bu ngan dan pemahaman bersama antar Para Pi hak .

PASAL 2

RUANG LINGKUP KE RJAS AMA

Kerjasama meliputi ke giata n sebagai berikut :

1. Pertukara n informasi ilmiah tekn is ben cana, peng ala man , tek no log i, dan pe ng embang an prog ram bersama ;

2. Pertukaran keahl ia n pers eorangan :

3. Pe ngembangan strategi da n metodolog i dal arn bidan g pengurangan risi ko bencana;

4. Pen yeleng garaan kursus pelatih an, sem inar, lokaka ry a sesuai topi k ya ng disepaka ti bersama yang di laksanakan di Indo nesia dan Ital ia;

5. Pel aks anaan latihan bersama di bidang kesia psiag aa n atau sim ulas i situa si da rurat bencana ;

6. Area Kerjasam a lain seb ag aima na disep ak ati ol eh Para Pih ak

PASAL 3

PENGATURAN KEUANG AN

1. Kegi atan ke rjas ama di bawa h MSP ini dila ku kan berd asa rkan ketersedia an dana

2. Mas ing-masing Pihak w aji b menanggung bi aya yang ditimbulkan terkait de ngan pelaksanaan kegiatan kerJasama di bawah MSP in i tanpa ada nya pe rtu karan dana antara Para Pihak .

PASAL 4

PERATURAN PERSO NIL

Masi ng-masing pihak wajib me lakukan upaya untuk memastikan bahwa masin g-masing person il yang terlibat dalam ke giatan ke rja sam a te rkait MSP ini akan wajib menghormati ke merdekaan po liti s, kedau lata n, integritas w il ayah dari nega ra tuan rumah , memiliki kewaJ iban untuk tidak turut campur dala m perka ra internal negara tuan rumah dan tid ak akan terlibat da lam keg iatan komersil atau kegiatan-kegi ata n lain yang be rten tanga n dengan maksu d dan tuju an MSP ini.

PASAL

5

HAK KEKAYAAN INTE LEKTUAL

1. Hak Kek aya an lntelektu al yang dipergu naka n atau dihasilkan oleh sala h satu Pihak dal am pe lak sanaan MSP in1 akan dil in dun gi sesua i deng an

hu ku m dan peraturan yang berlaku di neg ara rn asing-masing , sesuai de ngan kewajiban perja nj ian internasion al te ntang kekayaan intelektual dim ana salah satu Pihak ada lah pihak da ri per1 anj ian tersebut.

PASAL 6 KERAHASIAAN

Sal ah sa tu Pihak wajib ti dak mempublikasi kan atau me nyampaikan kepa da pihak keti ga informas i yang bersifat rahas ia ya ng diterima at au diciptakan da lam kerangka ke rj a MSP in i, di mana kerahas ia an di persyaratkan oleh Pih ak la innya , tanpa ada persetujuan tertu lis dari P1hak lai n tersebut.

PASAL 7

PENYELESAIAN SEN GKETA

Masing-masing Pihak wajib sal ing berkonsu ltasi dengan segera periha l setia p pe rmas al ahan yang dapat mempengaruh i pela ksa na an MSP ini . Setiap se ngketa yang timbu l dari penafsiran ata u pela ksanaan MS P in i wajib disel esa ikan secara damai melalu i negosiasi dan konsu ltasi bersama .

PASAL 8 AMANDEMEN

MSP ini dapat diamandemen berdasarkan kese pa katan tertulis bersam a antara Para Pihak mela lui saluran dip lomatik. Am andemen tersebut waj ib berlaku pad a tan ggal yang ditentukan oleh Para Piha k dan wajib menjadi bagian tid ak te rpis ahkan dari MSP ini.

PASAL 9

MAS A BERLAKU, JANGKA WAKTU DAN PENGA KH IRA N

1. MSP ini waji b berlaku pad a tanggal pen andatangan annya .

DESIDERANDO raggiungere l'ob iettivo comune di promuovere una cooperazi one nel ca mpo della protezione civile , per ii rafforza mento dei sistemi nazionali e del le loro capacita gesti onali ;

FACENDO SEGUI TO alle legg i e ai regolamenti in vig ore nei rispettivi paesi ;

Hanno concorda to quanto segue:

Articolo 1 Ob iettivo

II prese nte Memorandum of Understanding , in se gu ito ind icate come MoU , intende

facil itare la cooperazione bilaterale nel campo dell a gestione de i disastri sul la base dei

principi di parita, reci proci ta, del comune beneficio e rispetto e promuovere ra pporti e

intesa re ciproca tra le Parti .

La coo perazione include le segue nti attivita:

1. Scam bio di info rmazioni tecnico-scientifiche, es perienze , tecnologie e svil uppo di

prog ramm i comun i:

2. Scambio di competenze del personale;

3. Svil uppo di strategie e metodologie sulla riduzione del rischio da disastri;

4. Org anizza zione di corsi di form azione , seminari e works ho p sugli argomenti con venuti da tenersi in Italia e in Indonesia;

5. Conduzione di esercitazioni congiu nte nel campo del la pre parazione ai dis astri o simulazione dei maggiori incidenti ed emergenze;

Articolo 3

Dis posizioni fi nanziarie

1. Le attivita di coope razione co ndotte nell1ambito del pres ente Mo U saranno so ggette all a disponibilita dei fondi.

2. Ciascuna Parte si fara carico delle spese sosten ute rel ativamente alla real izzazione

delle atti vita di cooperazione nell'ambito del presente MoU senza alcuno scambio

4

Disposizioni per ii pe rson ale

Ci ascuna Pa rte adottera misure rag ionevoli per assicurare che ii suo personale

im peg nato nelle attivita di coo perazione relative al prese nte MoU ris pette ra

l'ind ipendenza politica , la sovranita e l'integrita territoriale del paese ospitante, avra ii

dovere di non interferire nelle questioni interne del paese ospi tante, e non pa rtecipera

ad attivita commerciali o altre attivita incom patibi li con le fi nalita e gli obiettivi del

prese nte MoU .

Articolo 5

Diritti di prop rieta intellettua le

1. La proprieta intellettual e utilizzata o concessa da un partecipante nell'attuazion e del

presente MoU sara protetta in co nformita con le rispettive leggi e di sp osizioni del

paese di ciascuna Pa rte , coere ntemente con gli obbli gh i derivanti dagli accordi interna zion al i sulla Proprieta lntel lettuale vincol an ti per le Parti .

2 . La pro tezi one di qualsiasi nuovo diritto di proprieta intellettuale derivante

Articolo 6 Ris ervatezza

Nessuna de ll e due Parti divulghera ne cedera ad una terza parte informazioni riservate ricevute o prodotte nell 'ambito del presente MoU , per le quali la riservatezza

e

richiesta

dall 'altra Parte, senza previo consenso scritto dell'a ltra Parte .

A rticolo 7

Risol uzi one dell e controversie

Ciascu na Pa rte si consultera con l'altra quanta prima su qua lsiasi questione che possa

avere effetti sulla corretta attuazione del presen te MoU. Qualsiasi controve rsi a

deriva nte da ll'interpretazione o attuazione del presente MoU sara defi nita in via

amichevole tramite negoziazioni e consultazioni reci proche .

A rticolo 8 Modifiche

II presente MoU potra essere modificato per mutuo consenso scritto tra le Parti tra mite

cana li diplo matici. Tali modifiche produrranno

loro effetti dalla data stabi lita dal le Parti

e form eranno parte integrale del presente MoU.

Articolo 9

Entrata in v ig ore, durata e revoca

1. II pre sente MoU entrera in vig ore dalla data de lla firma;

2. II presente MoU rimarra in vi gore per un periodo di tre (3) anni e potra esse re

prorogato per un ulte riore peri odo di tre anni per mutuo consenso scritto delle Parti;

3. Ciascuna Parte potra revocare ii presente Mo U in qu alsi asi momenta med iante

notifica scri tta tramite canal i diplomatici almeno tre (3) mesi prima dell a prevista

4. La revoca del presente MoU non influira sul la vali dita e sull a durata di qualsias i accordo , programma, attivita o progetto rea lizzato ne ll 'ambito del presente MoU fino al comple tamento di tali accordi, program mi, attivita o progetti a meno che le pa rti decidano diversamente .

REP UBLIC -D EPARTME NT OF CIVIL PROTECTI ON

ON COOPE RATION IN THE FIELD OF DI SASTER MANAGEMENT

Th e National Agency for Disaste r Management of the Republic of Indones ia and the

Presidency of the Council of Ministers of the Italia n Republic-Departm ent of Civil

Protection (hereinafter referred to as "the Parties,,);

RE COGNIZING that the cooperatio n in the field of civil protection con trib utes to the

the importance of providing an effective disaster man ageme nt

in order to limit and mitigate disasters conseque nces on population, property and

environment;

to achieve the common goal to prom ote cooperation in the field of civil

protection, for strengthening nationa l system and their own management ca pacity;

PURSUANT

to the prevailing laws and regulations in their respective countries;

HAVE AG RE ED

to the following :

Article 1

Objective

This Memora ndum of Understand ing, hereinafte r referred to as MoU, aim s to

fa cilitate the bilateral cooperation in the field of disaster management on the bas is of

equal ity, reciprocity and mutual benefit and res pect and to promote relatio ns and

mutual unde rstand in g between th e Parties .

Article 2

Activities of Cooperatio n

The coope rat ion incl udes the foll owing activities:

1. Exchange of techn ical scie ntific information , ex pe ri ences, tech nol ogies and

development of joint programs;

2. Exch ange of pers onal experti se;

3. Devel opment of strategies an d methodologies on disaster ri sk reduction ;

4. Organization of training cours e, seminars and works hops on agreed topics to be

held in Ind onesia and Italy;

5. Con ducti ng joi nt exercises in the field of dis aster preparedness or si mulati ons of

major accidents and emergency situations;

6. Other areas of cooperation as mutually agreed upcm by the Parties.

Article 3

Fi nancial Arrangements

1. The cooperative activities cond ucted under this MoU shall be subj ect to the

avail ability of funds .

2. Each Party shall bear th e expenses incu rre d in connection with the

implementation of th e cooperative activities under this MoU without any excha nge

of fu nds between the Parties .

Article 4

Personn el Regulation s

Each Party shal l take reason abl e measures to make sure that its perso nnel en gaged

in the cooperative activities rela ted to this MoU shall respect political independen ce,

sovereig nty, terri tori al integrity of the host country, shall have a duty not to interfere

in the internal affairs of the host country , and wil l not involve in any co mmerci al

activities or any other activities inconsistent with the purposes and objectives of this

Mou .

Article 5

Intellectual Property Righ ts

1. The intellectual property used or furnished by a pa rti cipa nt in the im plementation

of this MoU will be protected in accorda nce with the respective laws and

regul ations of each Party's country, con sistent with the ob lig ations under

international agreements on Intellectual Property to which either Pa rty is a party.

2. Th e protection of any new IP ri ghts resulting from the im plementation of thi s MoU

will be provided in specific arran gements to be con clu ded between the Parties .

Article 6

Confidentia lity

Neither Party shall publish nor transfer to a third pa rty confidenti al information

received or created within the framework of thi s MoU, of wh ich the co nfi dentiality is

requ ired by the other Party, without prior written conse nt of the other Party.

Article 7

Settlement of Dispute

Eac h Party sh all consult with the other as soon as possib le on any matter th at may

affect the proper implementation of the MoU . A ny disp ute arising out of th e

interpretation or implementation of the MoU shall be settle d amicably throu gh

negotiati ons and mutual consultations .

Article 8

Amendment

This MoU may be amended by mutual written consent in writing between the Parti es

th rough diplomatic cha nnels . Such amendment shall com e into effect on a date as

may be determined by the Parties and shall form an integral part of this MoU.

Article 9

Entry into Force, Duration and Te rm in ati on

1. This MoU shall enter into force on the date of its signing ;

2. Th is MoU shall remain in force for a period of three (3) years and may be

extended for another th ree ye ars period by mutual written consent of th e Pa rties ;

3. Eith er Party may terminate thi s MoU at any tim e by wri tten notification throug h

diplomati c channels at least three (3) mo nths prior to the intend ed date of

te rmination;

The termination of this MoU shall not affect th e validity and durati on of an y

arra ngements , prog ra ms, activities or proj ects made under this MoU until the

of such arrangeme nts, programs, activities or projects un less th e

Parties decided otherwise.
