DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 527/MPP/Kep/7/2002 DATED JULY 5, 2002

ON

THE WORKING ARRANGEMENT OF THE

NATIONAL WTO TEAM AND ESTABLISHMENT OF LOBBY GROUPS FOR MULTILATERAL TRADE NEGOTIATIONS IN THE FRAMEWORK OF WTO

THE MINISTER OF INDUSTRY AND TRADE,

Considering :

a. that in the framework of implementing the provisions in THIRD and FOURTH Dictums of Presidential Decree No. 104/1999 on the establishment of the national team for multilateral trade negotiations in the framework of the World Trade Organization (WTO), according to the membership composition as stipulated by Presidential Decree No. 16/2002, it is necessary to restipulate the working arrangement of the national team and set up lobby groups for multilateral trade negotiations in the framework of WTO;

b. that in relation thereto, it is necessary to issue a decree of the Minister of Industry and Trade;

In view of :

1. Law No. 7/1994 on ratification of the Agreement Establishing The World Trade Organization (Statute Book of 19994 No. 57, Supplement to Statute Book No. 3564); 2. Presidential Decree No. 104/1999 on the establishment of the national team for

multilateral trade negotiations in the framework of the World Trade Organization (WTO), as already amended several times and the latest by Presidential Decree No. 16/2002; 3. Presidential decree No. 17/2000 on realization of the State Budget of Revenue and

Expenditure;

4. Presidential Decree No. 228/M/2001 on the establishment of the Mutual Cooperation Cabinet;

5. Presidential Decree No. 102/2001 on status, tasks, functions, authority, organizational structures and working arrangements of ministries;

6. Presidential Decree No. 109/2001 on first-echelon organizational units and tasks of ministries;

7. Decree of the Minister of Industry and Trade No. 86/MPP/Kep/3/2001 on the organization and working arrangement of the Ministry of Industry and Trade;

To stipulate :

DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE WORKING ARRANGEMENT OF THE NATIONAL WTO TEAM AND ESTABLISHMENT OF LOBBY GROUPS FOR MULTILATERAL TRADE NEGOTIATIONS IN THE FRAMEWORK OF WTO.

Article 1

To stipulate the working arrangement of the National team for Multilateral Trade Negotiations in the Framework of WTO, which is set up by Presidential Decree No. 104/1999 as already amended several times and the latest by Presidential Decree No. 16/2002.

Article 2

The working arrangement as meant in Article 1 is in the form of distribution of tasks and authority of first vice chairman, second vice chairman, advisors, secretary and members of the National WTO Team.

Article 3

(1) The First Vice Chairman has the tasks of assisting the Chairman of the National WTO Team to prepare and coordinate everything related to multilateral trade negotiations in the framework of WTO.

(2) The Second Vice Chairman has the tasks of assisting the Chairman of the National WTO Team to prepare input related to developments of activities and negotiations in WTO as well as to coordinate negotiators of issue in WTO.

(3) Advisors have the tasks of providing directives and input for the Chairman and members of the National Team in connection with the determination of the Indonesian position in multilateral trade negotiation forums.

(4) The Secretary of the National team has the tasks of assisting and preparing everything related to the implementation of activities in the framework of WTO multilateral trade negotiations and is responsible and conveys written reports to the First Vice Chairman.

(5) Members of the National Team act as chairpersons of lobby groups and/or alternate chairpersons of lobby groups.

(6) The Chairman of the Indonesian Chamber of Commerce and Industry as a member of the National Team has the tasks of providing input for the National Team with regard to matters being interests of Indonesian business communities for every issue discussed in WTO negotiations.

Article 4

To establish lobby groups composed of lobby fields respectively consisting of chairpersons, alternate chairperson, technical executives and facilitating officials with the composition as contained in the attachment to this decree.

(1) Every lobby groups as meant in Article 4 has the tasks of coordinating and preparing the Indonesian position for every issue discussed in multilateral trade negotiations in the framework of WTO.

(2) The technical executives as meant in Article 4 can represent chairpersons/alternate chairpersons to execute operational tasks of lobby groups.

(3) The facilitating officials as meant in Article 4 have the tasks of assisting and preparing everything related to the implementation of activities in the framework of WTO multilateral trade negotiations.

Article 6

To establish the Secretariat of the National Team for Multilateral Trade Negotiations in the Framework of WTO, hereinafter called the Secretariat of the National Team, with the membership composition being stipulated by a decision of the Director General of Industrial and International Trade Cooperation, Ministry of Industry and Trade.

Article 7

(1) In executing their tasks, the first and second vice chairmen are responsible and convey written reports to the Minister of Industry and Trade.

(2) Chairpersons of lobby groups and/or alternate chairpersons of lobby groups in executing their tasks are responsible and obliged to convey written reports to the First Vice Chairman. (3) The technical executives and facilitating officials as meant in Article 5 in executing their tasks are responsible and obliged to convey written reports to chairpersons of lobby groups.

Article 8

All costs needed for implementing this decree are borne by budgets of the respective ministries/institutions in accordance with their activities in the relevant lobby groups.

Article 9

This decree comes into force as from the date of stipulation.
