KATA PENGANTAR

Globalisasi telah memasuki era baru yang bernama revolusi industri 4.0. Revolusi industri 4.0 secara fundamental mengakibatkan berubahnya cara manusia berpikir dan berhubungan satu dengan yang lain. Era ini akan mendisrupsi berbagai aktivitas manusia dalam berbagai bidang, tidak hanya teknologi saja, namun juga bidang yang lain seperti ekonomi, sosial, dan politik. Pada bidang politik misalnya, gerakan-gerakan politis untuk mengumpulkan massa melalui konsentrasi massa telah digantikan dengan gerakan berbasis media sosial. Bidang pemerintahan pun kini juga ditantang untuk melaksanakan birokrasi secara efektif dan efisien berbasis e-governance.

Perkembangan media sosial yang masiv juga telah merekonstruksi struktur budaya masyarakat.

Relasi sosial hubungan masyarakat kini lebih erat terbangun dalam dunia maya, sehingga hubungan dalam dunia nyata justru menjadi relatif. Paradigma bisnis pun bergeser dari penekanan owning menjadi sharing (kolaborasi) (Prasetyo & Trisyanti, 2018), sebagaimana merebaknya e-commerce yang menggeser bisnsi retail (toko fisik). Singkatnya, dalam disruptif akan terjadi disruptive regulation, disruptive culture, disruptive mindset, dan disruptive marketing (Khasali, 2018). Tantangan era baru ini tidak dapat diselesaikan dengan cara-cara yang sama seperti dalam konsep masa lampau. Revolusi industri 4.0 tidak mungkin hanya dihadapi dengan pengembangan teknologi tanpa melibatkan dinamika sosial di dalamnya. Perlu dirumuskan strategi kebijakan nasional melalui kesadaran dan kedewasaan berpikir

Hal tersebut menginisiasi Fakultas Ilmu Sosial dan Ilmu Politik Universitas Lampung untuk mengadakan Seminar FISIP Unila (Sefila) 3 yang mengangkat tema mengenai “Agenda Baru Pembangunan Indonesia Berbasis Local Knowledge". Walaupun mengacu pada konteks ruang dan tempat, pengetahuan lokal (local knowledge) memiliki relevansi dalam proses pembangunan, karena memanfaatkan sumber daya yang minimal berbasis karakteristik sosial budaya setempat.

Pengetahuan lokal ini dapat ditransfer menjadi kearifan lokal yang bisa dipertukarkan atau dilakukan lintas budaya (World Bank, 1998). Sehingga pengetahuan lokal memiliki elastisitas dalam berbagai masalah dan perubahan, termasuk mewarnai agenda pembangunan di Indonesia

Seminar ini diharapkan dapat menghasilkan kajian diskusi yang dapat berkontribusi dalam menyediakan altenatif solusi bagi agenda pembangunan di Indonesia menghadapi tantangan perubahan dinamika sosial saat ini. Pada akhirnya, luaran dari Seminar FISIP Unila juga diharapkan dapat terpublikasi melalui prosiding dan jurnal terakreditasi, sehingga hasil kajian dapat bermanfaat secara luas bagi kebutuhan pengembangan akademik dalam bidang sosial politik.

Segala puji bagi Tuhan yang telah menolong hamba-Nya menyelesaikan prosiding ini dengan penuh kemudahan. Prosiding ini disusun agar akademisi, mahasiswa dan peminat ilmu sosial politik dapat memperluas ilmu tentang ruang lingkup konsep maupun kebijakan ilmu sosial dan politik, khususnya di negara Indonesia, yang disajikan dari berbagai sumber. Abstract

The Directorate General o f Intellectual Property Rights o f the Republic o f Indonesia Ministry o f Law and Human Rights in 2018 received an award for IPR protection by conducting service renewals, such as the system o f recording copyright online with cryptographic techniques. The innovation won first place in the public service innovation award by KemenPANRB. The award was received because the Online Copyright Recording System with Cryptography Technology was assessed to facilitate the public when registering copyrights within one day digitally and auto- approve. The impact o f these technological innovations, IPR protection services in Indonesia in 2018 increased requests. The success o f public services in the Director-General o f Intellectual Property Rights is exemplary. Therefore in this study, we want to know the success factors in developing a system o f online copyright recording at the Directorate General o f Intellectual Property (DJKI),and it can apply in public services elsewhere. This research isqualitative research by conducting interviews related to the dimensions o f support, capacity, and value, policy, institutions, and planning. Based on the results o f the study, the success factor that most supports the success o f public service innovation is the online recording system o f copyright is support in infrastructure, budget, and human resources, besides the role o f the Director-General o f IPR that consistently provides E-Government development policies and regulations in the implementation o f the public.

Abstrak

Direktorat Jenderal Kekayaan Intelektual (DJKI) Republik Indonesia Kementerian Hukum dan Hak Asasi Manusia pada tahun 2018 menerima penghargaan untuk perlindungan HKI dengan melakukan pembaruan layanan, seperti system pencatatan hak cipta online dengan teknik kriptografi. Inovasi memenangkan tempat pertama dalam penghargaan inovasi layanan publik oleh Kemen PAN-RB. Penghargaan ini diterima karena Sistem Perekaman Hak Cipta Online dengan Teknologi Kriptografi dinilai untuk memfasilitasi masyarakat ketika mendaftarkan hak cipta dalam satu hari secara digital dan otomatis menyetujui. Dampak dari inovasi teknologi ini, layanan perlindungan HKI di Indonesia pada 2018 permintaan meningkat. Keberhasilan layanan publik di Direktur Jenderal Kekayaan Intelektual patut dicontoh. Oleh karena itu dalam penelitian ini, penulis ingin mengetahui faktor keberhasilan dalam mengembangkan sistem pencatatan hak cipta online di Direktorat Jenderal Kekayaan Intelektual (DJKI), dan dapat diterapkan di layanan publik di tempat lain. Penelitian ini adalah penelitian kualitatif dengan melakukan wawancara terkait dimensi dukungan, kapasitas, dan nilai, kebijakan, lembaga, dan perencanaan. Berdasarkan hasil penelitian, factor keberhasilan yang paling mendukung keberhasilan inovasi layanan publik adalah system pencatatan online hak cipta adalah dukungan dalam infTastruktur, anggaran, dan sumberdaya manusia, selain peran Direktur Jenderal IPR yang secara konsisten menyediakan Kebijakan dan regulasi pengembangan E-Government dalam implementasi publik.

INTRODUCTION

Piracy often we find is occurrence book piracy by copying documents with a copy machine.

Therefore, copying can inflict a financial loss for the publisher. Moreover, cassettes and videos illegal that quickly sold found in Glodok Jakarta.

However, internet development has made piracy even more widespread. As explication by

Oganyan, Vinogradova, & Volkov (2018), the internet is useful to trading center which the

transaction will be faster especially goods in digital formats, such as digital audio, video, games,

software, and digital documents. The popularity of the internet has influenced to promotes their product; it makes the purchase is effortless, and the product can be downloaded and stored in a computer or gadget. Therefore, the user can misuse the product, especially the hijacker, to charitable illegally.

There are several steps to handle piracy, such aslicense key and security. Sometimes users have it when they online register for payment in save ID number. However, the user feels that the publisher’s treatment is unfairto encourage hijackers to steal product and spread it for low cost (sometimes it free). If users as citizen support their actions, then allowing the hijacker to convince themselves that their actions are justified (Brown, 2016).

Therefore, another option is the existence of copyright laws to encourage and protect it, when the creators hurt so much that product works (creation) have a free sale (Herings, Peeters, & Yang, 2018) or another group who recognizes as their creation.

The government has an essential role in copyright protection because it has the power of law by making a rule attached to the Republic of Indonesia law number 28 of 2014. Therefore, it needs supervision and controlled by the Directorate General of Intellectual Property Rights under the auspices of the Ministry of Law and Human Rights.In the research of (Kurnianingrum, 2015) clarified that a due renewal by replacing law number 19 of 2002 into law number 28 of 2014, due to inappropriate in the condition in Indonesia for now.The amendment emphasized on the extension of copyright protection, protection of the economic rights for creators and limiting the transfer of economic rights in the sold-flat form, copyrights as tangible movable non-objects be used as objects of fiduciary collateral, and even more.

Therefore, the improvement in the law of copyright protection made citizens are immediately to register their creation through the Directorate General of Intellectual Property Rights or DJKI.

However, the governmentrealizes that when their officials serve the community, several officials violate the rules which harm the society, such as unauthorized collections. For this reason, a platform was created to solve the problem which had an online system.The community can register with the platform without face to face anofficer. The platform which is mention as e- government.

In 2018, DJKI had an award of copyright online recording system as the top 99th public service innovation. It is according to announcement attachment number 001/TPI.06/2018. The novelty is to embed cryptographic techniques into the system. This technique used for preventing forgery of copyright documents with a digital signature for validity the owner authentic using QR code (Rochman, Raharjana, & Taufik, 2017). Therefore, DJHKI entrusts to Badan Siberdan Sandi Negara (BSSN) for the document security. Even from the ministry of research and technology appeal lecturers to register their copyright for protected their writings and inventions, as Intellectual Property Rights (IPR) represented by the affiliation. Lecturers can input IPR data as a track record for proof of performance results in Sinta-Science and Technology Index. Therefore, we analyze what the factor which makes the copyright online recording system is successful in public service thus got an award. The analyze divide with two methods, namely interview and questionnaires. Interviews were carried out to investigate the viewpoints of officials involved in building the platform, while the poll was conducted based on the views of several platform users.

Both methods are met to find a correlation.The study is the purpose of analyzing the background to build the platform and how to work thus became the best platform.

The DJKI of Public Service Platform. The platform of DJKI for the civil service which attached inh ttp://dgip.go.id/, such as e-filling and e-hakcipta. E-filling is a platform used tobrand, patent, and industrial design registrationwhich it allows only to Registered Intellectual Property Consultant, Regional Office of the Ministry of Law and Human Rights, and Intellectual Property Rights Coordination Center of University. E-hakcipta which had honor in 2018 for cryptography technique allows to submitting creations such as writings, artworks, musical compositions, audio­

visual, photographic, drama, choreography, recorded, and other works, for example, computer programs (Manual Book Aplikasi E - Hak Cipta, 2018). Based on (Tim Penyusun, 2017), eight clusters can access e-hakcipta, namely:

The procedure to access e-hakcipta mustfollow infive steps:

a) Online copyright account registration based on username and password

b) Upload file, namely statement letter, copyright transfer, and creation type (sample) Payment for recording copyright via e-banking or ATM

Checking the file registration requirements for copyright

Reviewing the file registration requirements for copyright, except for types of creation such as artwork, audio-visual, drama and choreography, recordings and other production that need to be verified first

Cryptography Technique. The many happen of an irresponsible group claim the item which is not their property by showing their fake documents. Therefore, DJKI considers the problem with using cryptography technique. Cryptography is one technique for Information and data security to keep it private from unauthorized such as destruction, modification, fabrication, disclosure, and disruption (Alia, Tamimi, & Al-allaf, 2014). Therefore, it can safeguard the original document such as e-certificate which publishes by DJKI. E-certificate itself attached QR code,which the function of storing URLs, addresses, signs, etc. (Pandit, Nipane, Jadhav, & Naik, 2016). In order not to change the contents of the information in the QR code, cryptographic security required by using encryption. Encryption works are to alter the information in a QR code into an unreadable form; thus, the hijacker has difficulty changing the contents of the document. Also, the cryptography support identifies the person who has authenticated e-certificate is well-known as Digital Signature.

The cryptography technique process simulation is similar to DJKI, as illustrated in research (Pizaini, Guritman, & Sukoco, 2016)below:

Measurement of Success Factors for the Public Service Quality. Based on the book of (Indrajit, Rudianto, & Zainuddin, 2007) thatusing information technology in the government with the concept of e-government not necessarily implemented; thus, it not significantly government performance is change. Focusing on technology in the development of e-government is a wrong step.

The technology is only an instrument as a government role transformation from a bureaucratic to an oriented institution to serve its customers. The intended customers are the community, the business community, and other stakeholders (Indrajit et al., 2007). A country decides to implement e-government because it believes that by involving information technology within the framework of government management, it will provide several benefits such as (Indrajit et al., 2007):

a) Improving the quality of government services to citizen and also other countries;

b) Improve the process of transparency and accountability among government organizers;

c) The reducing transaction, communication, and interaction costs that occur in the government process;

d) Creating a higher quality community-based information;

Therefore, advantages gained in involving e-government require a clear vision, such as improve government productivity and operational performance; promote clean and transparent government; etc. For that reason, the success of public service is need measured in achieving e- government vision.

Measurement for the public service quality in this study is using the Customer Satisfaction Index (CSI). CSI usually use for customer satisfaction for service in a company to adjust to changes, thus to improve the quality service. The quality service has five dimensions (Ilieska, 2013):

The calculation illustrated in Table 1. The average on Importance (I) added to obtain Y value and also the result of Sc for the score from multiplication Importance (I) and Satisfaction (S), which is then summed to achieve the T value. Therefore, CSI obtained with formula as bellow(Widodo & Sutopo, 2018):

The result of the CSI as Satisfaction Level Criterionhas shown in Table 2. If CSI obtains approximately 81%, then the satisfaction level is higher, this means that customers are delighted with the services.

According to the results of a study from Harvard JFK School of Government to apply the

concepts of digitalization to the public sector, three elements of success must be owned and taken

seriously, namely support, capacity and value (Indrajit, 2016). The Governmental Model has been

Nationally, assessment e-Government implementationalso carried out using five dimensions of e- ranking Government Indonesia (PeGI) carried out by the Ministry of Communication and Informatics. PeGI aims to provide development and utilization of ICT in the government environment and get a map of utilization conditions ICT in the government environment nationally. In the PeGI Framework, there are five dimensions of measurement: policy, institutional, infrastructure, application, and planning (Sihwi, 2009).

M ETHOD

In completing the study, several ways needed. As written in the previous introduction, the steps taken are conducting interviews, and questionnaires are well-known as mixed methods.

Mixed methods combine qualitative and quantitative in the purpose of understanding the problem (Masrizal, 2011). The qualitative tool using interviews, we interviewed Head of Sub Directorate in Development of Intellectual Property Information Systems.

The quantitative tool that we are using CSI, which we use six responded lecturer of UniversitasIndraprasta PGRI. They have been dealing with e-government platform is e-hakcipta, because they enrolled in the Ministry of Research, Technology and Higher Education Grand Program.

The mixed methods in the purpose of observation the fact by observing the data received, which illustrated as follow:

RESULT AND DISCUSSION

According to interviews, e-hakcipta followed by the rules in the e-government operational based on the Republic of Indonesia law number 28 of 2014, such as:

a) The government regulation of the Republic of Indonesia number 7 of 1989, concerning amendments to government regulation number 14 of 1986 concerning the Copyright Council established on April 5, 1989

b) The Republic of Indonesia government regulation number 1 of 1989 concerning translation and/or reproduction of creations for the interest of education, science, research, and development established on January 14, 1989

c) The government regulation of the Republic of Indonesia, number 14 of 1986 concerning the Copyright Council, established on March 6, 1986

d) Republic of Indonesia government regulation number 45 of 2016 concerning types and rates of non-tax state revenue that apply to the Ministry of Law and Human Rights

e) Republic of Indonesia’s Presidential Decree number 74 of 2004, concerning ratification of the WIPO performances and phonograms treaty, 1996/WIPO treaty concerning performances and voice recorders.

Therefore, legal protection received by the community, which was socialized by the DJKI and the development of e-hakcipta to facilitate registration. The following data collected is:

According to the data in Figure 3, beginning in 2018, approval is higher than the request, because of the reason for 2017, submitted recently in 2018.

The data received a higher demand in December 2018. The reason the data is higher because DJKI holds an event such as socialization and workshop for help Lembaga Manajemen Kolektif Nasional (LMKN) to register Intelectual Property Rights (IPR).

The data which approval in December 2018 is higher than request. It means institutions do request online through e-hakcipta to DJHK while the permission conducted collectively in workshop socialization and request online. The demand for application is more elevated than Approval because data application is an unsuccessful process.

Also, calculation of CSI value obtain is 162.3611/(5x48.83333) = 0.664960182 x 100% =

66.49602%, it means the level based on table 2 is satisfied. The response is satisfied with e-

hackcipta because they assisted by Research and Development Institute. They do not deal directly

with online systems when they take part in the Ministry of Research, Technology and Higher

Education Grand Program; their IPR handled by the institution.

Elements o f Success Copyright Recording Online System

Based on the results of interviews we conducted with the DJKI Information Technology staff, the Copyright recording online system began to be implemented in February 2018, submitting a copyright application via the (manual) window no longer exists. Based on the improvement in the quality of copyright services that transformed from manual to online, then copyright requests increase fourfold compared to 2017 applications.

Support from institutions is the element that best supports the successful implementation of e- government in a government. Support observed from the aid of leaders in implementing the concept of e-government by Presidential Instruction Number 3 of 2003 concerning National E- Government Development Policy and Strategy and Law Number 14 of 2008 concerning Public Information Openness. Support from top-down supervisors is considered to be a factor that can succeed in implementing e-government. Supporting DJKI in implementing the online copyright recording system is considered very good, efficient, and useful. The role of leaders who participate in innovating public services by changing copyright services from manual to online, one form of DJKI leadership support is to provide a budget allocation of 100 million and allocate quality human resources totaling four people with undergraduate computer graduates. The distribution of funds and human resources is considered to be very useful and efficient in increasing copyright requests four times from 2017. Also, the support provided in the form of socializing the system of recording copyright online with local government agencies and cooperating in terms of copyright enhancement. InIndonesia, socialization and cooperation were also carried out by holding seminars for universities, SMEs and industries.

Therefore, the value observed from the magnitude of the benefits obtained from the online copyright recording system for the government, the community, and those who are interested (Demand side). The E-government system is one of the concepts towards the era of 4.0, making it easier for providers and recipients of public services that are easy, fast, and safe. For the government, the implementation of e-government makes the efficiency of time at work, because of the transformation of the system from the counter to online and paperless. For people with an online recording system to facilitate them in copyright applications, in addition to being accessible, public services online copyright recording system is also considered fast, safe, and free from illegal levies.

Based on the results of our interviews with DJKI staff, the success factors in the innovation of public services Online Registration System Copyright in DJKI is the support of DJKI institutions, specifically to the Directorate of Information Technology in the field of Intellectual Property.The institution noticedby leadership that performs the Duties and Functions, the implementation of the E-hakciptaSOP by the vision and mission, and the support of budget allocation and HR. The following is the synchronization analysis table of the four things:

T he procedure o f application used for recording online is the progress to com pletion o f registering for one working day, except for the type o f creation excluded.

Procedures are carried o ut through account registration, file upload, paym ent, checking file registration requirements, verification o f the kinds o f spare such as art, audio­

visual works, dram a, and choreography, recorded, etc. , then the final stage is approved before printing the certificate.

Synchronization of the four things shows the role of institutions and leaders is vast in making a public innovation based on e-government is works well and experience development every year. If sorted, then the critical success factor is the role of leaders in carrying out the vision and mission of implementing e-government, which provides support in the form of offering budget allocations and qualified human resources who are competent in making up to the development of e-hakcipta.

CONCLUSION

Based on the response applicant, The stages of e-hak cipta according to framework Deloitte and Touche is low. Low Stage or level 1 is publication information about the profile, innovation, background, and goals copyright online recording system. The publications information has been carried out in the institutions and regional government. The copyright online recording system cannot be categorized into the second stage because at this stage; there has not been a two-way transaction between the community and the government. This system has no relationship reciprocity between the users, in this case, the society, with the government as a service provider (Handayani & Kardia, 2010). In implementing public service innovations, the online copyright recording system (e-hak cipta) is a successful service innovation because it provides convenience, speed, and transparency in public services, as evidenced by the increase in copyright registration.

The success factor of the E-Hak Cipta service innovation is the support of institutions and leaders by implementing the vision and mission of implementing e-government on tasks and functions, SOP on Copyright publishing, and budget and HR support. Thus, the commitment of institutions and leaders is notable and an essential factor in designing, creating, and developing e-government in institutional organizations.
