DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 153/MPP/Kep/5/2001 DATED MAY 2, 2000
THE COMPULSORY APPLICATION OF INDONESIAN NATIONAL STANDARD/ SNI TO WHEAT FLOUR AS FOODSTUFFS
(SNI.01.3751-2000/Rev.1995 AND ITS REVISION)
THE MINISTER OF INDUSTRY AND TRADE,
Considering :
a. that in order to increase the nutritious value of the society, it is necessary to fortify foodstuffs by supplementing micronutrients : iron (Fe), zinc (Zn), B1 vitamin (thiamine), B2 (riboflavin) and pholate acid as well as to boost the creation of fair competition in the industrial and trading sectors, it is deemed necessary to promptly stipulate the compulsory application of SNI to wheat flour as foodstuffs (SNI 01.3751-2000/Rev.1955 and its revision);
b. that wheat flour constitutes a carrier material which is potential for fortification because the product is widely used for producing food products consumed by the society;
c. that in relation thereto, it is necessary to stipulate a decree of the Minister of Industry and Trade;
In view of :
1. Law No. 5/1984 on industrial affairs (Statute Book of 1984 No. 22, Supplement to Statute Book No. 3193); 2. Law No. 8/1999 on consumer protection (Statute Book of 1999 No. 42, Supplement to Statute Book No.
3821);
4. Government Regulation No. 17/1986 on the authority to regulate, foster and develop industries (Statute Book of 1986 No. 23, Supplement to Statute Book No. 3330);
5. Government Regulation No. 13/1991 on the Indonesian National Standard (Statute Book of 1991 No. 10, Supplement to Statute Book No. 3434);
6. Government Regulation No. 69/1999 on food label and advertisement (Statute Book of 1999 No. 131, Supplement to Statute Book No. 3687);
7. Government Regulation No. 102/2000 on the national standardization;
8. Presidential Decree No. 12/1997 on the formulation, application and supervision over Indonesian national standards;
9. Presidential Decree No. 136/1999 on the status, tasks, functions, organizational structures and working arrangements of ministries as already amended by Presidential Decree No. 147/1999;
10. Presidential Decree No. 234/M/2000 on the establishment of the cabinet for 1999-2004 period;
11. Decree of the Minister of Industry and Trade No. 108/MPP/KEP/5/1996 on the standardization, certification, accreditation, and supervision over the quality of products within the Ministry of Industry and Trade, as already amended several times the latest by the Decree of the Minister of Industry and Trade No. 384/MPP/Kep/8/1999;
12. Decree of the Minister of Health No. 632/MENKES/SK/VI/1998 on the fortification of wheat flour;
13. Decree of the Minister of Industry and Trade No. 444/MPP/Kep/9/1998 jo. No. 24/MPP/Kep/I/1999 on the on the organization and working arrangement of the Ministry of Industry and Trade.
DECIDES :
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE OF THE COMPULSORY APPLICATION OF INDONESIAN NATIONAL STANDARD/SNI TO WHEAT FLOUR AS FOODSTUFFS (SNI.01.3751-2000/Rev.1995 AND ITS REVISION).
Article 1
To stipulate and apply compulsory the Indonesian National Standard of wheat flour as foodstuffs (SNI 01.3751-2000/Rev.1955 and its revision).
Article 2
Manufacturers producing wheat flour as foodstuffs shall apply the Indonesian National Standard of wheat flour as foodstuffs and must have certificates of products using SNI identity in accordance with the provisions in force.
Article 3
The wheat flour as foodstuffs as meant in Article 1 traded in the country which comes from the country and the import shall fulfill the requirements (SNI 01.3751-2000/Rev.1955 and its revision).
Article 4
(1) The Directorate General of Chemical, Agro and Forest-based Industries and the Center of Standardization shall be appointed to prepare and implement the application of SNI of wheat flour as foodstuffs.
(2) The Directorate General of Chemical, Agro and Forest-based Industries shall have the task of fostering manufacturers of wheat flour as foodstuffs with regard to their capability of producing products in accordance with the SNI requirement.
(3) The Center of Standardization for the Minister shall issue certificates of products using SNI identity to manufacturers of wheat flour as foodstuffs which apply the quality system and the quality of their products meets the SNI requirement.
(4) The Center of Standardization shall be responsible for the supervision over the use of SNI identity.
(5) The supervision as meant in paragraph (4) shall be done by executing periodical supervision and can be executed at any time by the Center of Standardization along with the Fostering Directorate.
(6) The supervision as meant in paragraph (5) shall include : a. supervision over the quality system;
b. supervision over the quality of products consisting of sample taking and the test of products by testing laboratories which are accredited or appointed by the Minister of Industry and Trade.
Article 5
(1) In implementing this decree, the Directorate General of Chemical, Agro and Forest-based Industries and the Center of Standardization shall be assisted by Second-level regions industrial and trading service offices and testing centers/institutions accredited or appointed by the Minister of Industry and Trade.
(2) The second-level region's industrial and trading services shall have the tasks of assisting in the technical administrative field.
(3) Testing Centers/Institutions shall have the task of taking sample and testing the products.
