REGARDING
APPOINTMENT OF SURVEYOR TO PERFORM SURVEY ON NON-NEW CAPITAL GOODS IMPORT
MINISTER OF INDUSTRY AND TRADE OF ROI
Considering:
a. in the framework of enforcing provision of Article 1 paragraph 6 and Article 4 Decree of Minister of Industry and Trade No. 756/MPP/Kep/12/2003 regarding import of Non -New Capital Goods, it is deemed necessary to appoint surveyor to perform survey on non-new capital goods import;
b. therefore, it is deemed necessary to issue Decree of Minister of Industry and Trade;
In view of:
1. Decree of Minister of Industry and Trade Number 86/MPP/Kep/3/2001 regarding Organization and Working Procedure of Ministry of Industry and Trade;
2. Decree of Minister of Industry and Trade Number 756/MPP/Kep/12/2003 regarding Non-New Capital Goods Import;
D E C I D E: Stipulate:
FIRST: Appoint:
1. PT. Surveyor Indonesia; and
2. PT. Superintending Company of Indonesia (PT. Persero SUCOFINDO); To perform verification on non-new capital goods to be imported.
SECOND
Surveyor referred to in THE FIRST Dictum shall have the following tasks:
1. perform survey on non-new capital goods import at the goods loading state of origin; and
2. issue Certificate of Inspection as survey result as contemplated in item 1 (one) stating that the imported non-new capital goods are utilizable and reconditioned to be re-functioned, not constituting scrap and surveyor shall provide information on technical specification the said non-new capital goods import.
THIRD:
Survey referred to in THE SECOND Dictum shall be performed on non-new capital goods classified in Tariff Post of HS. 82, 84, 85, 86, 87, 88, 89 and 9009, except those included in Appendix I of Decree of Minister of Industry and Trade Number 756/MPP/Kep/12/2003 regarding Non-New Capital Goods Import.
FOURTH:
In performing a survey on non-new capital goods import, Surveyor may receive payment from importer of the relevant non-new capital goods whose amount shall be in line with the fair principle.
FIFTH:
Any cost arising from the enactment of this Decree shall be borne by the Surveyor as contemplated in THE FIRST Dictum.

The appointment of Surveyor referred to in THE FIRST Dictum shall be effective at the date of the stipulation of this decree and shall expire on December 31, 2005 on condition that it does not nullify the authority of Minister of Industry and Trade to revoke, amend and or add Surveyor to perform survey on import of non-new capital goods.
EIGHTH:
This Decree shall be effective on the date of stipulation.
