AMENDMENT TO THE DECREE OF THE MINISTER OF FINANCE NO.291/KMK.0511997 ON BONDED WAREHOUSES AS ALREADY AMENDED THE LATEST BY THE DECREE
OF THE MINISTER OF FINANCE NO. 292/KMK.01/1998
(Decree of the Minister of Finance No. 349/KMK.01/1999 ,dated June 24,1999) THE MINISTER OF FINANCE
Considering
a. that the use of goods resulting from the processing activities in bonded zones as the support of industries in other Indonesian customs areas needs to be further increased:
b. that exports by companies located outside bonded zones which produce export commodities need to be increased;
c. that in relation thereto, it is deemed necessary to restipuiate the total of release of products processed by PDKB which produce finished goods or other goods/materials for ]further processing in other Indonesian customs areas, by issuing a decree of the Minister of Finance;
In view of :
1. Law No. 1 011 995 an customs affairs (Statute Book of 1 995 No. 75, Supplement to Statute Book No. 361 2);
2. Government Regulation No. 3311 996 on bonded stockpiling sites (Statute Book of 1 996 No. 50, Supplement to Statute Book No. 3638) as already amended by Government Regulation No. 43/1997 (Statute Book of 1997 No. 40), Supplement to Statute Book No. 371 7);
3. Presidential Decree No. 1 22/Mll 998;
4. Decree of the Minister of Finance No, 291.KMK.0511 997 on bonded warehouses as already amended the latest by the Decree of the Minister of Finance No. 292/KMK.01 /1 998;
D E C 1 D E S To stipulate :
THE DECREE OF THE MINISTER OF FINANCE CONCERNING AMENDMENT TO THE DECREE OF THE MINISTER OF FINANCE NO. 291/KMK.0511997 ON BONDED WAREHOUSES AS ALREADY AMENDED THE LATEST BY THE DECREE OF THE MINISTER OF FINANCE NO. 292/KMK.0 1 /1 998
Article 1
To amend Article 10 paragraph (7) of the Decree of the Minister of Finance No. 291/KMK.0511997, so as to read as follows :
Article 10
(7) The release of goods already processed by PDKB which are destined for OPTL, can be done by using Import Declarations (PIS/BC.2.0) in accordance with the customs procedure in the import sector, with the provision as follows :
a. The release to DPIL by companies using Sapeksta Keuangan facilities is treated the same as the release for export purposes.
b. The total of release to PE)IL, after the realisation of export andlor release to other PC)KB is as follows b1. goods which need not further processing, can function independently without the support of other goods
and are used by end consumers is at the maximum 50%; b2. goods other than those as meant in letter b. 1 is 1 00 %;
of the value of exports realized and/or release to other PDKB."
Article 11 This decree shall come into force as from July 1 , 1 999.
For public cognizance, this decree shall be published by placing it in State Gazette of the Republic of Indonesia.
