B. (l)The Government of the United Kin dom shall adopt the arran ements and procedures described in the following paragraphs of this ote insofar as the relate to

things to be done by or on behalf of that Government . The Government of the epublic o Indonesia shall adopt

the arrange1ents and procedures so described insofar as they relate to thin s to be done by or on behalf1

of that Government .

( 2 ) The projects to be assisted from the loan shall be

agreed between the Government of the United Kingdom and the Government of the Republic of Indonesia and drawings from the loan shall be applied subject to aragraph

(4)

of this Note to ayments an reimbursements for costs incurred in furtherance of the projects agreed . Unles s the Government of the United dn_;dom othervlise agree , no project shall b e eli gible for assistance from the l oan unles s i t i s a·reed between the two Governments before

the 31st of larch, 1971 , and no payment or reimbursements in the a!llle r hereinafte r described shall be maae in respec t of any contract or costs ｵｮｬ･ｾｳ＠ the co tract or other r elevant t r ansaction is entered into ｢･ｦｯＱｾ＠ t e 31s t of !arch 1971 .

ｾｯｲ＠ the purpose

of

these arrangements the Government of' the epublic of I ndonesia shall , by a request in the form set out in Annex A to this iTote, open a special account (hereinafte r referred to as "the Account") with the Crown gents for Oversea Governments and

drninistrations of

the Republ i c of Indonesia shall :f\lrnish the Government of the nited Kinr.·dom with a copy of the Government' a ins tractions to

the Crown Agents given i n accordance ith the

foregoing provisions of this paragraph. The Government of the Republic of I ndonesia or the Crown Agents on their behalf shall at the same time and s o often as any change is made therein, notify the Government of the Uni ted Kingdom of the names of the officers who are duly

｡ｵｾｨｯｲｩｳ･､＠ to sign on i ts behalf the ayment Authorities ,

Payment Orders and Requests for Drawing hereinafter provided and shall furnish a specimen signature i n duplicate of ea such officer.

-(c) The Government of the epublic of Indonesia shall ensure that the Crown Agents for ard to the Government of the United ingdom monthly a statement of receipts to and

payments from the Account .

(d) nless the Government of the United Ki ｾ､ｯｭ＠ ot erwise agree , payments into the Account shall not be made after the 31st of rarch

Save to t he extent , i f any , to which the Government of the United Kingdom may otherwise agree, ､ｲ｡ｾｩｮｧｳ＠ fro the loan shall be used only:

(a) to reimburse the Bank in the United I ingdom designated by the Government of the epublic of Indonesia for payments made under i rrevocable letters of credit

advised after the date of tni s Note ro r t he purpose of

any contract for the purchase in the United Kingdom (which expression in this ote shall be deemed to include the Channel I slands an the Isle of I.Ian ) of

goods ｾｨｯｬｬ ｹ＠ prod ced or manufactured i n the Unite d Ci:ngdom or , in the c ase o chemical and allied products , goods which are duly declared to be of United Ki ngdom origin on t he f'orm set out i n Annex C (Chemicals) to this ote, or for "V ark to be done or for services t o

be ren ered by persons ordinarily resident or carrying on business in the United Kingdoi. or for t ｾｯ＠ or more of such purposes , being a contract wbi ch:

(i) provides for payment in sterlin to ersons carrying on business in the United .L ing om;

and

(ii) is approved on behalf of the Government of the Republic of Indonesia and accepted by the Government of the United Kin6dom fo r financin from the loan; and

(iii) is a contract entered into after the date of t his Not e and before the 31st of

Decembe r 1970 .

(b) or payment of sterlin bank charges , commissions , ｨｩ｟Ｉｾｊｩ＠ F .

costs and other acceptable charges payable i n the Uni· Kingdom to :

(i ) the Crown gents in respect of their s ervi ces in conn ction ·th this loan; o r

(iii) in other cases , ｴｨｲｯｵｾｨ＠ the British m assy i n jakaPta, details of the transaction and such inf'ormation additional to that provided under paragraph ( 5) (a) and •,1here a::_Jplicable paragraph (6) as the Go-ernment of the Unite d i aom may request .

(b) The Gove rnment of the epublic of Indonesia or the Crown Agents on their behalf shall ensure that the Government of the United Kingdom are info med ir at any time an aNreed project or a contract or transaction (being a contract or transaction in respect of which documents have been

f'orward..ed in accordance with the foregoing provisions) is amended , or ir liability is incQrre or is to be inc rred thereunde r to a r·reater or lesser amount than the amount s eciried in the levan t docume ts so fo arded , and in any of these cases the Government of the ｾ･ｰ ｵ｢ｬｩ｣＠ of

Indonesia or the roy n gents acting on t 1eir· behalf shall ensure that there are forwarded as soon as possible t o the Gov rrunent of the United Ki dom the relevant supplementary or revised documents .

( 8)(a) \.f'ter the Government of the nited Kingdom have considered the documents for\1arded, in u1s ance of the procedure

des cribed i n para"·raph (7) or this Note , and any additional informacion ｾ｢ｩ ｣ｨ＠ it may request from the ｾｯｶ･ｲｮｭ･ｮｴ＠ of the

ｾ･ｰｵ｢ｬｩ｣＠ of' Indonesia or the Oro m ents for t .1.is purpose ( and which t ha · Government or the Cro·m ·ents shal l then supply), the overnment of' the United Kingdom shall notify tha t Government or the Crown - 0 ents ｾｨ･ｴｨ･ｲ＠ and to what

extent they accept a contract or t r nsaction as eligible

authority and shall ｳｨｯｾ＠ the loan drawings made for the purposes of sub-paragra hs (4)(d)(e) and (f ) of t h is

ote and the actual expenditure incurred durin he Inda esian financial ye ar and shall certify that t he expenditure was made in accordance with the terms and conditions se t out in this l ote and any co1 di tions on

made available and shall furnish such o· ficers , servants and agents with such information relating to the projects and the progress and financing thereof as the latter may reasonably require .
