xv RINGKASAN
Undang-undang Nomor 12 Tahun 2012 tentang Pengadaan Tanah Bagi
Pembangunan Untuk Kepentingan Umum dalam Pasal 2 meyebutkan salah satu
asas yang melandasai pengadaan tanah adalah Asas Kesepakatan. Menurut
penjelasan Pasal 2 ini yang dimaksud dengan Asas Kesepakatan adalah bahwa
proses pengadaan tanah dilakukan dengan musyawarah para pihak tanpa unsur
paksaan untuk mendapatkan kesepakatan bersama. Undang-undang Nomor 12
Tahun 2012 ini tidak memberikan pengertian musyawarah. Pengertian
musyawarah terdapat pada Peraturan Presiden Nomor 36 Tahun 2005 tentang
Pengadaan Tanah Bagi Pelaksanaan Pembangunan Untuk Kepentingan Umum,
sebagaimana telah dirubah dengan Peraturan Presiden Nomor 65 Tahun 2006
yang sekarang tidak berlaku lagi. Pasal 1 angka 10 Peraturan Presiden ini
menyebutkan bahwa musyawarah adalah kegiatan yang mengandung proses
saling mendengar, saling memberi, dan saling menerima pendapat, serta keinginan
untuk mencapai kesepakatan mengenai bentuk dan besarnya ganti rugi dan
masalah lain yang berkaitan dengan kegiatan pengadaan tanah atas dasar
kesukarelaan dan kesetaraan antara pihak yangn mempunyai tanah, bangunan,
tanaman, dan benda-benda lain yang berkaitan dengan tanah, dengan pihak yang
memerlukan tanah. Jika diperhatikan pengertian asas kesepakatan dan pengertian
musyawarah tersebut, maka terdapat unsur yang merupakan inti dari pengertian

itu, yaitu pertama, bahwa untuk mendapatkan kesepakatan bersama tidak boleh
ada unsur paksaan, dan kedua, atas dasar kesukarelaan antara para pihak.
Dalam hukum perjanjian terdapat salah satu asas hukum yang penting
yaitu asas Konsensualisme, yang mempunyai arti bahwa untuk melahirkan
perjanjian cukup dengan dicapainya sepakat. Jika hal ini dihubungkan dengan
syarat sah perjanjian senbagaimana dirumuskan dalam Pasal 1320 BW, yakni
syarat sepakat mereka yang mengikatkan diri. Kata sepakat yang dimaksud dalam
Undang-Undang Nomor 2 Tahun 2012 itu sama atau tidak sama dengan sepakat
yang dimaksud dalam ketentuan Pasal 1320 BW. Dengan demikian dalam
pengadaan tanah terjadi atau tidak perjanjian dan perikatan sebagaimana
dimaksud oleh Pasal 1313 BW. Pasal 1313 BW menyebutkan bahwa perjanjian
adalah suatu perbuatan dengan mana satu orang atau lebih mengikatkan dirinya
terhadap satu orang atau lebih. Jika diperhatikan, memang dalam pengadaan tanah
terdapat para pihak, yaitu pertama adalah pihak atau instansi yang memerlukan
tanah, dan kedua adalah pihak yang mempunyai atau menguasai tanah. Namun
demikian dalam pengadaan tanah harus diteliti secara hati-hati agar tidak cepat
menyimpulkan bahwa kesepakatan dalam pengadan tanah sama dengan
kesepakatan dalam hukum perjanjian, hanya semata-mata melihat ada para pihak
atau subjek hukum dan ada objek yang disepakati yaitu tanah, kemudian pihak
yang satu menerima sejumlah uang sebagai ganti kerugian dan pihak yang lain
menerima tanah yang dikehendaki. Apalagi dalam praktik sering terjadi
ketidaksepakatan mengenai besarnya ganti kerugian, dan tidak dilaksanakannya
proses musyawarah untuk mencapai kesepakatan sebagaimana mestinya.

Dengan demikian dalam pengadaan tanah bisa terjadi ketidaksepakatan,
sama halnya dengan kesepakatan dalam perjanjian. Namun pada perjanjian, jika
terjadi ketidaksepakatan, maka para pihak tidak terikat lagi. Tapi pada pengadaan
tanah untuk kepentingtan umum, jika kesepakatan melalui musyawarah tidak
berhasil dan mekanisme melalui pengadilan telah ditempuh, maka
ketidaksepakatan itu berujung pada penitipan ganti kerugian kepada pengadilan.
Jadi kesepakatan dalam pengadaan tanah memiliki ciri tersendiri yang berbeda
dengan kesepakatan dalam hukum perjanjian. Untuk menganalisis kesepakatan
dan hubungan para pihak dalam pengadaan tanah diperlukan pemahaman yang
lebih mendalam mengenai hakikat kesepakatan itu sendiri, makna dan fungsinya
dalam pengadan tanah untuk kepentingan umum.
Tujuan dari penelitian ini adalah pertama, untuk menganalisis dan
menemukan landasan filosofi asas kesepakatan dalam pengadaan tanah bagi
pembangunan untuk kepentingan umum; kedua, untuk menemukan dan
merumuskan karakteristik asas kesepakatan dalam pengadaan tanah bagi
pembangunan untuk kepentingan umum, dan ketiga, untuk menganalisis
penerapan asas kesepakatan dalam pengadaan tanah bagi pembangunan untuk
kepentingan umum. Sedangkan manfaat yang diharapkan dari penelitian ini
adalah: bagi para teoritisi dan akademisi, penelitian ini diharapkan bermanfaat
sebagai bahan pengembangan untuk menambah wawasan yang lebih mendalam
mengenai asas-asas hukum dalam pengadaan tanah untuk kepentingan umum,
khususnya asas kesepakatan; bagi para pembuat peraturan perundang-undangan,
dalam rangka untuk lebih menyempurnakan ketentuan-ketentuan penerapan asas

kesepakatan, sehingga tujuan pengadaan tanah untuk kepentingan umum dapat
tercapai dan pada akhirnya akan memberikan jaminam keadilan bagi masyarakat;
bagi kalangan praktisi khususnya yang berkecimpung dalam pengadaan tanah
untuk kepentingan umum dapat memberikan gambaran dan sebagai bahan acuan
mengenai substansi hukum dalam pengadaan tanah untuk kepentingan umum
khususnya dalam rangka penerapan asas kesepakatan, yang pada akhirnya
memberikan dan meningkatan pengetahuan hukum baginya.
Hasi dari penelitian ini dapat disimpulkan sebagai berikut; pertama,
kesepakatan dalam pengadaan tanah didasarkan pada asas musyawarah yang
ditegaskan dalam Undang-Undang Nomor 2 Tahun 2012. Sedangkan kesepakatan
dalam hukum perjanjian (kontrak) didasarkan pada asas kebebasan berkontrak
sebagaimana diatur dalam BW. Makna asas kesepakatan dalam pengadaan tanah
adalah asas yang mengatur hubungan para pihak dalam menentukan bentuk dan
besarnya ganti kerugian atas dasar kebersamaan, kesukarelaan, dan kesetaraan
yang dilakukan melalui musyawarah. Sedangkan fungsi asas kesepakatan dalam
pengadaan tanah adalah untuk menjamin terwujudnya keseimbangan kembali
antara dilepaskannya hak atas tanah dengan ganti kerugian yang diterima,
sehingga para pihak dapat hidup bersama kembali dalam kehidupan dan ikatan
kebersamaan dengan tenang dan damai; kedua, karakteristik kesepakatan dalam
pengadaan tanah untuk kepentingan umum bersifat terbatas, yaitu dibatasi oleh
waktu sebagaimana terdapat dalam peraturan tentang pengadaan tanah yang
berasaskan musyawarah untuk mencapai kesepakatan. Sedangkan kesepakatan
dalam hukum perjanjian tidak ada pembatasan waktu, bahkan jika salah satu pihak

tidak sepakat bisa bebas dan tidak terikat lagi dengan materi yang ingin
disepakati. Dalam pengadaan tanah pihak pemegang hak atas tanah juga terbatas
kebebasannya dalam menentukan kesepakatan mengenai besarnya ganti kerugian.
Terbatasnya sifat kesepakatan dalam pengadaan tanah ini juga terkait dengan
ketentuan konsinyasi ganti kerugian pengadaan tanah; ketiga, meski
Undang-Undang Nomor 2 Tahun 2012 menganut asas kesepakatan dan musyawarah,
namun dalam penerapannya terdapat penyimpangan terhadap asas kesepakatan itu
sendiri. Ketentuan Pasal 66 ayat (4) Peraturan Presiden Nomor 71 Tahun 2012
yang menentukan musyawarah untuk mencapai kesepakatan hanya untuk bentuk
ganti kerugian, bertentangan dengan ketentuan Pasal 37 ayat (1) dan (2)
Undang-Undang Nomor 2 Tahun 2012 yang menentukan musyawarah dilakukan untuk
menetapkan bentuk dan/atau besarnya ganti kerugian. Ketentuan Pasal 42
Undang-Undang Nomor 2 Tahun 2012 yang menentukan alasan konsinyasi atau
penitipan ganti kerugian di pengadilan negeri dilakukan jika yang berhak menolak
bentuk dan/atau besarnya ganti kerugian, bertentangan dengan asas kesepakatan
karena dilakukan tanpa mendasarkan adanya kesepakatan dari para pihak, dan
bertentangan dengan esensi musyawarah yang menghendaki adanya kesepakatan.
Di Amerika Serikat, penetapan ganti kerugian didasarkan pada agreement antara
negara dengan pemilik properti, seperti dalam proses jual beli properti pada
umumnya, yaitu setelah tercapai kata sepakat dalam negosiasi. Di Vietnam
kewenangan memutuskan pengadaan tanah dan penentuan harga tanah untuk
menetapkan ganti kerugian dilakukan oleh Komite Rakyat. Di Indonesia, ganti

kerugian dalam pengadaan tanah didasarkan pada asas musyawarah untuk
mencapai kesepakatan.
Dari kesimpulan yang telah dikemukakan di atas, maka disarankan,
pertama, dalam rangka evaluasi Undang-Undang Nomor 2 Tahun 2012, ke depan
asas kesepakatan dan musyawarah untuk mencapai kesepakatan harus tetap
dipertahankan karena sesuai dengan kepribadian bangsa Indonesia. Sebaliknya
lembaga konsinyasi atau penitipan ganti kerugian kepada pengadilan harus
dihapus, karena bertentangan dengan asas kesepakatan dan esensi dari
musyawarah itu sendiri; kedua, karena asas kesepakatan dalam pengadaan tanah
untuk kepentingan umum bersifat terbatas, maka dalam pelaksanaan asas
kesepakatan ini harus memperhatikan asas-asas lain yang terdapat dalam
Undang-Undang Nomor 2 Tahun 2012, khususnya asas keadilan, asas kemanusiaan, dan
asas kesejahteraan; ketiga, karena dalam menetapkan bentuk dan/atau besarnya
ganti kerugian Undang-Undang Nomor 2 Tahun 2012 menganut asas kesepakatan,
maka seharusnya dalam pengadaan tanah ditempuh melalui cara pelepasan hak
atau penyerahan hak atas tanah dengan asas musyawarah untuk mencapai
kesepakatan. Jika musyawarah tidak menghasilkan kesepakatan, maka bukan
konsinyasi atau penitipan kepada pengadilan yang dilakukan, tetapi seharusnya
dengan menggunakan lembaga pencabutan hak atas tanah sebagaimana diatur
dalam Undang-Undang Nomor 20 Tahun 1961.
xxi SUMMARY
Article 2 of Act Number 12 of 2012 concerning Land Procurement for
Development for the sake of Public Interest stipulates that one of the principles as
the basis of land procurement is Consensualism Principle. The Elucidation of
Article 2 the meaning of the Consensualism Principle is a process of land
procurement conducted through deliberation between the parties without any
element of coercion in order to reach mutual agreement. Act Number 12 of 2012
does give definition on the meaning of consensus. The meaning of deliberation
(mutual consensus) can be found in Presidential Regulation 36 of 2005
concerning Land Procurement for Development Realization for the sake of Public
Interest which is no longer in force. Article 1 figure 10 of this Presidential
Regulation mentioned that deliberation is an activity involving a process of
mutual listening, take and give, mutual acceptance of other opinions, and the
intention to reach consensus on the form and amount of compensation and other
problems related with the activities of land procurement based on
whole-heartedness and equality between the parties who own the land, building,
vegetation, and other objects related with land, and the party who need the land.
From such meaning of the consensualism principle and the meaning of
deliberation, there is an element which constitutes the essence of this meaning,
i.e., firstly, in order to reach an mutual consensus there is no element of coercion
is allowed, and secondly, it should be on the basis of sincerity of the parties.

In contract law there is one important principle, namely, consensualism
principle which means that in order to establish an agreement it is sufficient that
the consensus has been reached. If this matter is correlated with the requirement
of lawful agreement as formulated in Article 1320 BW (Civil Code), namely, the
requirement of consensus between the parties who bind themselves. The word
“consensus” stipulated in Act Number 2 of 2012 is the same or not the same as
the word “consensus” stated in the provision of Article 1320 BW (Civil Code).
Thus, in land procurement whether agreement has taken place or not, it should
refer to Article 1313 BW (Civil Code). Article 1313 BW (Civil Code) stipulates
that an agreement is an act of two or more persons binding themselves to one or
more other persons. In land procurement there are parties, namely, firstly, the
party or institution which requires the land , secondly, the party who possesses or
occupies the land. Nevertheless, in land procurement it must be carefully studied
in order not to draw quick conclusion that consensus in land procurement is equal
to the consensus in contract law, by merely look that there are parties or legal
subjects and there is an agreed object, namely land, then one party receives a sum
of money as compensation, and other party who receives the intended land.
Moreover, in practice disagreements frequently occurs on the amount of the
compensation, and the process of deliberation is not implemented towards proper
consensus.
In land procurement disagreements may take place, just the same as
consensus in an agreement. But in an agreement, if a disagreement happens, the
parties are no longer bound thereto. In land procurement for the sake of public

interest, if an agreement through consensus does not succeed, then the mechanism
through court of justice is taken, and this disagrement ends with the deposit of
compensation at the court. So consensus in land procurement has its own
characteristic which is distinct from the consensus in contract law. To analyze the
agreement and the relation of the parties in land procurement needs deeper
understanding on the essence of the consensus, notion and function of land
procurement for the sake of public interest.
The aims of this research are, firstly, to analyze and find the
philosophical ground of the consensualism principle in land procurement for
development for the sake of public interest; secondly, to find and formulate the
characteristics of the consensualism principle in land procurement for
development fo the sake of public interest; thirdly, to analyze the application of
the consensualism principle in land procurement for development for the sake of
public interest. While the benefits expected from this research are: for the theorists
and academicians, this research is expected to give benefit as development
resources to widen horizon on legal principles in land procurement for
development fo the sake of public interest, particularly the consensualism
principle; for the lawmakers, in order to improve the provisions on the application
of the consensualism principle so the goal of land procurement for the sake of
public interest can be achived and at the end it will provide guarantee of justice to
the society; for the practitioners, especially those who involve in land
procurement for the sake of public interest that they can give description and as a
reference on legal substance in land procurement especially in the enforcement of

the consensualism principle which finally provides and enriches their legal
knowledge.
From the results of this research it can be inferred as follows: firstly, the
consensus in land procurement is based on the principle of deliberation as
stipulated in Act Number 2 of 2012, while consensus in contract law is based on
the principle of the freedom of contract as regulated in BW (Civil Code). The
meaning of the consensualism principle in land procurement is the principle
which regulates the relation among the parties in determining the form and the
amount of the compensation on the basis of togetherness, sincerity, and equality
conducted amicably, while the function of the consensualism principle in land
procurement is to guarantee the manifestation of re-balancing between the release
of land right and the land compensation which has been received, so the parties
can live together in harmony and the co-existence can be achieved pleasantly and
peacefully; secondly, the characteristics of the principle in land procurement for
development for the sake of public interest is limited that is limited by the time. In
land procurement the party who need the land the party who owns or occupies the
land are limited by the time in conducting deliberation towards consensus. In land
procurement the holder of land right also has limited freedom in determining the
consensus on the amount of the compensation. Such the limited nature of this
consensus in land procurement is related with the provision concerning
consignment/deposit of the compensation at the court; thirdly, there is deviation
in the enforcement of the consensualism principle in Article 66 paragraph (4) of
Act Number 2 of 2012 which determines that deliberation towards consensus isn

only in a form of compensation, is contrary to Article 37 paragraph (1) and (2) of
Act Number 2 of 2012 which stipulates that deliberation is conducted in
determining the form and/or the amount of compensation. The provision on
consignment or deposit of the compensation at the court is contrary to the
consensualism principle because it is conducted without the basis of mutual
agreement, and it is aganist the essence of deliberation which requires consensus.
In the United States of America, the injunction on the compensation is based on
the agreement between the state and the property owner, such as in the process of
sale and purchase of property in general, namely after mutual agreement in a
negotiation. In Vietnam the authority to decide the land procurement and the
determination of land price is carried out by People’s Committee. In Indonesia,
compenation in land procurement is based on the consensualism principle.
From the aforementioned conclusion, the recommendations are as
follows: firstly, in the effort towards evaluation of Act Number 2 of 2012, in the
future the consensualism principle and deliberation towards consensus must be
defended because it is in accordance with the personality of Indonesian nation.
On the contrary, the institution of consignment or deposit of the compensation at
the court must be abolished; secondly, since the consensualism principle in land
procurement for public interest is limited, so in its implementation this
consensualism principle pay attentio to other principles contained in Act Number
2 of 2012, especially principle of justice, principle of humanity, and principle of
welfare; thirdly, since in determining the form and/or amount of compensation the
Act Number 2 of 2012 contains the consensualism principle, so land procurement

must be performed through release of right or delivery of land right on the basis of
the principle of deliberation towards consensus. If deliberation does not produce
consensus, not consignment or deposit of the compensation at the court shall be
imposed, but it should refer to an land right revocation institution as used to be
regulated in Act Number 20 of 1961.

Consensualism Principle in Land Procurement for Development for the sake of Public Interest

The legal issues of this research consist of philosophical ground of the consensualism principle in land procurement for development for the sae of public interest; the characteristics of the principle in land procurement for development for the sake of public interest; and the application of the consensualism principle in land procurement for development for the sake of public interest. The method of this research is normative legal research by applying statute approach, conceptual approach, and comparative approach.
The results of this research are, firstly, the consensus in land procurement is based on the principle of deliberation, while consensus in contract law is based on the principle of the freedom of contract, the meaning of the consensualism principle in land procurement is the principle which regulates the relation among the parties in determining the form and the amount of the compensation on the basis of togetherness, sincerity, and equality conducted amicably, the function of the consensualism principle in land procurement is to guarantee the manifestation of re-balancing between the release of land right and the land compensation so the harmonization in the co-existence can be achieved pleasantly and peacefully; secondly, the characteristics of the principle in land procurement for development for the sake of public interest is limited that is limited by the time, limited freedom in determining the consensus on the amount of the compensation, and limited nature of this consensus is related with the provision concerning consignment/deposit of the compensation at the court, thirdly, there is deviation in the enforcement of the consensualism principle in Act Number 2 of 2012 as well as in its implementing regulation, namely, Presidential Regulation Number 71 of 2012.
