PELANGGARAN TERHADAP NORMA JUS COGENS DALAM HUKUM INTERNASIONAL

Doktrin imunitas negara (State immunity) lahir dari suatu norma hukum internasional terkait kedudukan sama atau sejajar negara-negara berdaulat yang merupakan subyek utama yang memiliki konsekuensi bahwa suatu negara tidak dapat di adili di negara lain karena memiliki imunitas yang melekat terhadapnya. Doktrin ini umumnya dibenarkan oleh kebutuhan suatu negara untuk menghindari adanya interfensi penerapa imunitas negara oleh negara lain dan untuk memungkinkan wakil atau representatif negara tersebut dalam melaksanakan tugas dan kewajibannya tanpa adanya gangguan.Prinsip ini telah berkembang melalui beberapa instrumen internasional. Dalam penerapannya, doktrin imunitas negara yang memiliki status hukum kebiasaan internasional sering kali dibenturkan dengan adanya pelanggarannya terhadap norma jus cogens, yang merupakan norma tertinggi dalam hukum internasional.
Karya tulis ini disusun dengan metode penelitian yuridis normatif dengan spesifikasi penelitian deskriptif analitik. Metode ini menggunakan data sekunder yang berupa konvensi-konvensi hukum internasional dan bahan-bahan kepustakaan seperti buku-buku, karya ilmiah, makalah seminar serta bahan-bahan terkait yang didapat penulis dengan membaca majalah-majalah, jurnal, surat kabar, kamus, bahan bacaan lainnya yang relevan dengan penulisan ini.
Dari hasil penelitian, penulis dapat menarik kesimpulan bahwa berdasarkan putusan Mahkamah Internasional imunitas negara merupakan masalah prosedural dan jus cogens meruapakan permasalahan yang substantif sehingga kedua norma tersebut tidak memiliki relevensi satu sama lain. Penulis juga beranggapan bahwa diperlukannya kepastian hukum dalam penanganan perkara yang berkaitan oleh pelanggaran terhadap norma jus
cogens yang telah dikenal oleh masyarakat internasional sebagai norma

THE DOCTRINE OF STATE IMMUNITY CORRELATED WITH THE VIOLATION OFJUS COGENS NORMS IN INTERNATIONAL LAW
Abstract
The Original Concept of the Doctrine of State Immunity was tranformed from one of the norm international law called equality of states and as result state are immune from any kind of prosecution and can not be adjudicated in another state. This Doctrine is generally justified by the needs of state to avoid any interference from another state and to allow the representative of state to carry out their duties and obligations without any interventions. The doctrione of State immunity has also been recognised as customary international law. When the doctrine of state immunity which has been recognised as customary international has been applied by states, it is often led to some obstacles where as state violated the jus cogens norm which also have been recognised and known to have the highest status in International law.
This research based on judicial normative approach with analytical descriptive research specification. This method utilizes secondary data, such as international law conventions and literatures, inter alia, books, treatises, articles and journals that are related to this thesis.
Based upon this research, the author lead into conclusion that according to the judgement which was adjudicated by the ICJ, the doctrine of state immunity was merely a procedural matter, while the jus cogens norms adjust the substantial matter. The author also contend that basically there is in need of a legal enforcement when the violations of the jus cogens normsmwhich has been recognised by the international community as the highest norm of international law, has been face with the doctrine of state immunity in defense. In addition, it can also be concluded that the jus cogens norms has not been applied effectively by states as the highest norm of International law seen by the cases that the ICJ has adjudicated.
