PUSAT PENDIDIKAN DAN PELATIHAN KEMENTERIAN LUAR NEGERI

REPUBLIK INDONESIA DAN

INSTITUT DIPLOMAS! YORDANIA

KEMENTERIAN LUAR NEGERI DAN EKSPATRIAT KERAJAAN YORDANIA HASYIMIAH

MENGENAI KERJA SAMA PENDIDIKAN DAN PELATIHAN DIPLOMATIK

Pusat Pendidikan dan Pelatihan Kementerian Luar Negeri Republik Indonesia dan lnstitut Diplomasi Yordania Kementerian Luar Negeri dan Ekspatriat Kerajaan Yordania Hasyimiahl (selanjutnya disebut "Para Pihak");

BERHASRAT untuk memperkokoh hubungan persahabatan yang ada saat ini melalui kerja sama yang lebih erat di bidang pendidikan dan pelatihan diplomatik antara Para Pihak;

MEMPERTIMBANGKAN kebutuhan untuk menghubungkan kedua institusi melalui mekanisme konsultasi langsung dan aksi yang bertujuan untuk mengembangkan pendidikan dan pelatihan pegawai dinas luar negeri dari kedua negara untuk mempererat hubungan diantara mereka;

SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di kedua negara.

TELAH MENYETUJUI sebagai berikut:

PASALI TUJUAN

Memorandum Saling Pengertian ini bertujuan untuk membangun kerangka hubungan yang memperbolehkan Para Pihak untuk mengembangkan pendidikan dan pelatihan diplomat dan pegawai dinas luar negeri Indonesia dan Yordania melalui mekanisme kerjasama langsung, konsultasi dan aksi. Untuk mencapai hal ini Para Pihak akan mengembangkan:

1) Kerangka kerjasama di bidang pendidikan dan pelatihan untuk para diplomat dan pegawai dinas luar negeri kedua negara. Kerja sama tersebut selayaknya tanpa ada pertimbangan komersial;

2) Kondisi untuk memelihara hubungan dan kerja sama yang tetap antara institusi yang ditunjuk oleh Para Pihak;

3) Pengembangan sumber daya manusia untuk diplomat dan pegawai dinas luar negeri kedua negara;

PASAL 2

BIDANG KERJA SAMA

Bidang kerja sama di bawah Memorandum Saling Pengertian ini khusus mengenai hal-hal di bawah ini:

1) Pertukaran informasi mengenai silabus pelatihan-pelatihan diplomatik, program-program pelatihan, seminar-seminar dan kegiatan akademis lainnya yang menjadi ketertarikan bersama;

2) Pertukaran publikasi dan bahan cetakan atau elektronik lainnya yang diterbitkan oleh Para Pihak atau institusi lainnya di negara

masing-masing;

3) Pertukaran narasumber dengan maksud untuk saling bertukar pengetahuan dan pengalaman masing-masing dengan narasumber dan siswa dari Pihak lain;

4) Pertukaran para pejabat atau siswa untuk mempelajari bidang-bidang yang menjadi ketertarikan bersama seperti kebudayaan, politik, sistem ekonomi dan hubungan luar negeri Pihak lain;

5) Menyelenggarakan seminar-seminar, konferensi atau acara lainnya yang serupa, yang akan diselenggarakan di Republik Indonesia atau di Kerajaan Yordania Hasyimiah;

PASAL 3 PEMBIAYAAN

Para Pihak boleh meminta dan mengelola, baik bersama atau terpisah, sumber pembiayaan untuk melaksanakan proyek-proyek yang akan dikelola di bawah Memorandum Saling Pengertian ini. Semua pembiayaan atas pelaksanaan instrumen ini bergantung atas ketersediaan pendanaan Para Pihak;

PASAL 4 PELAKSANAAN

Para Pihak harus berkonsultasi secara rutin untuk melaksanakan Memorandum saling Pengertian ini guna memoersiapkan prosedur-prosedur, rencana-rencana dan program-program kerjasama yang direkomendasikan yang bertujuan untuk mencapai tujuan program-program.

Untuk pelaksanaan Memorandum Saling Pengertian ini, Para Pihak akan

membuat pengaturan khusus, program-progran dan proyek-proyek dalam

lingkup Memorandum Saling Pengertian berdasarkan ketersediaan biaya dan pegawai dari Para Pihak.

PASAL 5

HAK KEKA YAAN INTELEKTUAL

Jika dalam program tersebut di atas atau proyek-proyek yang dikembangkan berhubungan dengan isu yang berkenaan dengan kekayaan intelektual, Para Pihak harus membuat perjanjian khusus yang sesuai dengan hukum dan aturan yang berkenaan dengan hak kekayaan intelektual di negara masing-masing.

PASAL 6

PEMBATASAN KEGIATAN PERSONIL

Masing-masing Pihak wajib memastikan bahwa semua personil yang terlibat kegiatan dalam Memorandum Saling Pengertian ini wajib menghormati dan mematuhi hukum dan peraturan perundang-undangan dari negara tuan rumah dan tidak akan berpartisipasi dalam segala bentuk

kegiatan politik dan/atau usaha komersial serta program atau kegiatan yang tidak sesuai dengan tujuan dari Memorandum Saling Pengertian ini.

PASAL 7

PENYELESAIAN PERBEDAAN

Setiap perbedaan antara Para Pihak yang berkaitan dengan penafsiran dan/atau pelaksanaan Memorandum Saling Pengertian ini wajib diselesaikan secara damai melalui konsultasi dan perundingan langsung diantara Para Pihak.

PASAL 8

PERUBAHAN

Memorandum Saling Pengertian ini dapat ditinjau atau diubah setiap saat dengan kesepakatan bersama secara tertulis oleh Para Pihak. Perbaikan-perbaikan atau perubahan-perubahan tersebut wajib mulai berlaku pada tanggal yang ditentukan oleh Para Pihak dan akan menjadi bagian yang tidak terpisahkan dari Memorandum Saling Pengertian ini.

PASAL 9

MULAI BERLAKU, MASA BERLAKU, DAN MASA BERAKHIR

1) Memorandum Saling Pengertian ini wajib mulai berlaku sejak tanggal penandatanganan;

2) Memorandum Saling Pengertian ini akan berlaku selama tiga (3) tahun dan secara otomatis diperpanjang untuk satu (1) tahun selanjutnya kecuali diakhiri secara tertulis oleh Para Pihak enam puluh (60) hari sebelum berakhirnya Memorandum Saling Pengertian ini;

3) Salah satu Pihak dapat mengakhiri Memorandum Saling Pengertian ini setiap saat dengan menyampaikan pemberitahuan tertulis sekurang-kurangnya enam puluh (60) hari sebelum tanggal berakhirnya periode tersebut;

4) Pengakhiran Memorandum Saling Pengertian ini wajib tidak mempengaruhi pelaksanaan program-program, proyek-proyek dan kegiatan-kegiatan yang sedang berjalan yang dibuat berdasarkan Memorandum Saling Pengertian ini.

SEBAGAI BUKTI, yang bertanda tangan di bawah ini telah menandatangani Memorandum Saling Pengertian ini.

Ditandatangani dalam rangkap dua di Amman, pada tanggal t1ga belas bulan Maret tahun dua ribu enam belas, dalam Bahasa Indonesia, Bahasa Arab dan Bahasa lnggris, semua naskah memiliki keabsahan yang sama.

Bila terdapat perbedaan penafsiran Memorandum Saling Pengertian ini,

maka naskah Bahasa lnggris yang akan berlaku.

MEMORANDUM OF UNDERSTANDING

BETWEEN

THE CENTRE FOR EDUCATION AND TRAINING OF

THE MINISTRY OF FOREIGN AFFAIRS OF

THE REPUBLIC OF INDONESIA

AND

THE JORDAN INSTITUTE OF DIPLOMACY OF

THE MINISTRY OF FOREIGN AFFAIRS AND EXPATRIATES OF

THE HASHEMITE KINGDOM OF JORDAN

FOR THE COOPERATION ON DIPLOMATIC TRAINING AND

EDUCATION

The Centre for Education and Training of the Ministry of Foreign Affairs of the Republic of Indonesia and the Jordan Institute of Diplomacy of the Ministry of Foreign Affairs and Expatriates of the Hashemite Kingdom of Jordan (hereinafter referred to as "the Parties");

DESIRING to strengthen the existing friendly relations through closer cooperation in the field of diplomatic education and training of the Parties;

CONSIDERING the need to joint the two institutions through mechanism of

direct consultation and action with a view to promote the education and training of foreign service officials from both countries in order to

strengthen relationship between

PURSUANT to the prevailing laws and regulations of the two countries;

HAVE AGREED as follows:

ARTICLE 1 OBJECTIVE

This Memorandum of Understanding aims at establishing the framework of

relations that allow the Parties to promote the education and training of the

Indonesian and Jordanian diplomatic personnel and foreign service officers

through direct mechanism of cooperation, consultation and action. To this

effect the Parties shall promote:

1) A framework for the cooperation on the field of education and training

for diplomats and foreign service officers from both countries. Such

cooperation shall not be marked by any commercial consideration;

2) Condition to keep regular contacts and cooperation between the

designated institutions of the Parties;

3) The development of human resources for the diplomats and foreign

service officers of both countries.

ARTICLE 2

AREAS OF COOPERATION

The areas of cooperation under this Memorandum of Understanding shall

be especially on the following:

1) Information exchange on the syllabus of the diplomatic courses, training

2) Exchange of publications and other printed or electronic materials

published either by the parties or by other institutions in their respective

countries;

3) Exchange of resource persons with the view of sharing their respective

knowledge and experience with resource persons and students from

the other Party;

4) Exchange of officials or students to study fields of common interest

such as: culture, politics, economic systems and foreign affairs of the

other Party;

5) Organization of seminars, conferences, and other similar events, which

shall be held alternatively either in the Republic of Indonesia or in the

Hashemite Kingdom of Jordan;

ARTICLE 3

EXPENSES

The Parties may request and manage, either jointly or separately, the

resources in order to carry out with the projects that may be arranged

under this Memorandum of Understanding.

All the expenses arising out of the implementation of this instrument shall

be subject to the budgetary availability of the Parties.

ARTICLE 4 IMPLEMENTATION

The Parties shall keep regular consultation in the implementation of this

Memorandum of Understanding in order to prepare the procedures, plans,

and recommended programs of cooperation aiming at attaining the

For the implementation of this Memorandum of Understanding, the Parties

may develop specific arrangements, programs and projects within the

scope of this Memorandum of Understanding subject to the availability of fund and personnel of the Parties.

ARTICLE 5

INTELLECTUAL PROPERTY RIGHTS

In case that the aforementioned programs or projects developed issues related to intellectual property, the Parties shall conclude a special agreement in accordance with the laws and regulations concerning the intellectual property rights in the territories of the respective countries.

ARTICLE 6

LIMITATION OF PERSONNEL

Each Party shall ensure that its personnel engaged in the activities under this Memorandum of Understanding shall respect and comply with the laws and regulations of the host country and shall not participate in any political

affairs and/or any commercial activities as well as any activity or program

inconsistent with this Memorandum of Understanding.

ARTICLE 7

SETTLEMENT OF DIFFERENCES

Any differences between the Parties concerning the interpretation and/or implementation of this Memorandum of Understanding shall be settled amicably through direct consultation and negotiation between the Parties.

ARTICLE 8.

AMENDMENTS

This Memorandum of Understanding may be reviewed or amended at any time by mutual written consent by the Parties. Such revisions or amendments shall enter into force on such date as may be determined by the Parties and shall form an integral part of this Memorandum of Understanding.

ARTICLE 9

ENTRY INTO FORCE, DURATION AND TERMINATION

1) This Memorandum of Understanding shall enter into force on the date of its signing;

2) This Memorandum of Understanding shall remain in force for a period of three (3) years and automatically extends for one (1) year consecutively unless either Party communicates to the other in writing its intention not to extend it at least sixty (60) days before the expiration date of the respective period.

3) Either Party may terminate this Memorandum of Understanding at any time by giving written notification at least sixty (60) days before the intended date of termination.

4) The termination of this Memorandum of Understanding shall not affect the implementation of the ongoing programs, projects and activities made under this Memorandum of Understanding.

IN WITNESS WHEREOF, the undersigned have signed this Memorandum of Understanding.

Signed in duplicate at Amman, on the 13th March 2016, in Indonesian,

Arabic and English languages, all texts being equally authentic. In case of any divergence of interpretation of this Memorandum of Understanding, the

English text shall prevail.
