DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 304/MPP/Kep/4/2002 DATED APRIL 11, 2002
ON
THE BENCHMARK PRICES OF FISH
FOR THE CALCULATION OF FISHERY PRODUCT CONTRIBUTIONS THE MINISTER OF INDUSTRY AND TRADE,
Considering :
a. that to implement provisions in Article 5 paragraph (4) of Government Regulation No. 142/2000 concerning duty on non tax state revenue prevailing in the Ministry of Marine and Fishery Resources, Decree of the Minister of Industry and Trade No. 365/MPP/Kep/12/2001 on the benchmark prices of fish for the calculation of fishery product contributions has been stipulated;
b. that the benchmark prices of fish as contained in Attachment to the Decree referred to in letter a have been expired since April 6, 2002;
c. that to give certainty in the calculation of fishery product contributions, it is necessary to set the benchmark prices of fish by a decree of the Minister of Industry and Trade.
In view of :
1. Law No. 9/1985 on fishery (Statute Book of 1985 No. 16, Supplement to Statute Book No. 3299);
2. Government Regulation No. 141/2000 on the second amendment to Government Regulation No. 15/1990 on fishery business (Statute Book of 2000 No. 256, Supplement to Statute Book No. 4058);
3. Government Regulation No. 142/2000 on duty on non tax state revenue prevailing in the Ministry of Marine and Fishery Resources (Statute Book of 2000 No. 257, Supplement to Statute Book No. 4059);
4. Presidential Decree No. 102/2001 on the position, task, function, authority, organizational structure and working system of a ministry;
5. Presidential Decree No. 109/2001 on the organizational unit and task of echelon I officials of a ministry;
6. Presidential Decree No. 228/M/2001 on the formation of the Mutual-Help Cabinet;
7. Decree of the Minister of Industry and Trade No. 558/MPP/Kep/SK/12/1998 on general provisions in the export sector adjunct Decree of the Minister of Industry and Trade No. 57/MPP/Kep/1/2002;
Observing :
The result of a meeting between ministries and businessmen grouped in the Indonesian Association of Fishery Businessmen (GAPPINDO), the Federation of Indonesian Fishery Businessmen (HPPI), the Indonesian Tuna Association(ASTUIN), the Indonesian Association of Non Tuna and Non Shrimp Businessmen (ASPINTU), and state owned fishery company Samudra Besar, held on March 8, 2002.
DECIDES :
To stipulate :
DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE BENCHMARK PRICES OF FISH FOR THE CALCULATION OF FISHERY PRODUCT CONTRIBUTIONS.
Article 1
The benchmark prices of fish (HPI) shall be the value or prices of fish in the rupiah set by the Minister of Industry and Trade to calculate fishery product contributions based on the fish prices in the domestic and international markets set by the Minister of Marine and Fishery Resources as well as on other inputs from the relevant business associations/players in the field of fishery.
Article 2
(1) The fish prices on the domestic market as referred to in Article 1 shall be set by the Minister of Marine the average price of each type of fish in main fishing ports in Jakarta, West Java, Central Java, East Java, Lampung, North Sumatra, North Sulawesi, South Sulawesi, Bali and Nusa Tenggara.
(2) The fish prices on the international market as referred to in Article 1 shall be set by the Minister of Marine and Fishery Resources based on the average free on board (FOB) price each type of fish exported.
(3) The percentage of the sale volume of fish sold on the domestic market and that of sold on the export market shall be set by the Minister of Marine and Fishery Resources based on the sale volume of fish sold on the domestic market and that of fish sold on the export market.
(4) HPI shall be set using the following formula :
HPI = ax + by in which :
a is the percentage of the sale volume of fish sold on the domestic market; b is the percentage of the sale volume of fish sold on the export market;
x is the average-weighed price of each type of fish sold on the domestic market; y is the average-weighed FOB price of each type of fish sold on the export market.
Article 3
(1) The HPI attached thereto shall be valid for 3 (three) months starting from the enforcement date of this Decree,
product contributions pending the issuance of new HPI.
Article 4
With the enforcement of this Decree, Decree of the Minister of Industry and Trade No. 365/MPP/Kep/12/2001 on the benchmark prices of fish for the calculation of fishery product contributions shall be declared null and void.
Article 5
This decree shall begin to take effect on April 6, 2002.
