Water is one of the most important elements in human life. the Participation of the private sector's role in managing water resources cause problem in society, especially in Jakarta. Pros and cons of the private sector's role in managing water resources, among others due to the discharge of the Constitutional Court Decision No. 85/PUU-XI/2013, which cancels Act No. 7 of 2004 on Water Resources. The purpose of this study was to determine the position of the parties in the cooperation agreement for water supply management, and to know the management of water supply system following the Ruling of the Constitutional Court No. 85/PUU-XI/2013.

The method used in this research is to use a normative juridical approach, method normative juridical conducted by examining the secondary data in the form of primary material, supported by interviews with Development Support Agency of Water Supply System (BPPSPAM) and the Provincial Government of DKI Jakarta related, with the specification of research descriptive analysis conducted with data collection in the form of literature studies and field studies.
