TEXTILE AND CLOTHING GROWTH QUOTAS OF THE QUOTA YEAR OF 1999 FOR EXPORT DESTINATIONS : UNITED STATES, EUROPEAN UNION, NORWAY,
CANADA, TURKEY, AND PARTNERSHIP IN THE EXPORT OF TEXTILE AND CLOTHING

THE MINISTER OF INDUSTRY OF AND TRADE,
Considering :
that with the start of the quota year of 1999 for textile and clothing (TPT) exports to the United States, the European Union, Norway, Canada and Turkey, it is necessary to stipulate fixed quotas (KT) for smale-scale companies and cooperatives as approved exporters of TPT (ETTPT-PKK) originating in growth quotas (KPt) for relevant eligible ETTPT.
In view of :
1. Law No. 9/1995;
2. The Decree of the Minister of Industry and Trade No. 374/MPP/Kep/8/1998 on the export of textile and clothing;
3. The Decree of the Minister of Industry and Trade No. 374/MPP/Kep/8/1998 on the team for studying the feasibility of small scale companies and cooperatives to obtain growth quotas of 1999. D E C I D E S :

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING TEXTILE AND CLOTHING GROWTH QUOTAS OF THE QUOTA YEAR OF 1999
FOR EXPORT DESTINATIONS : UNITED STATES, EUROPEAN UNION, NORWAY, CANADA, TURKEY, AND PARTNERSHIP IN THE EXPORT OF
TEXTILE AND CLOTHING
Article 1
Article 2
Within the framework of fostering and development of ETTPT-PKK, it is necessary to determine fixed quotas (KT) for ETTPT-PKK originating in growth quotas (KPt), at the rate of 6% of base quotas.
Article 3
1. The totals of KPt for the respective ETTPT-PKK of the quota year of 1999 shall be based on prorata calculation for eligible ETTPT-PKK, according to the following provision :

2. The totals of KPt for the respective ETTPT-PKK of the quota year 1999 shall be as contained in the attachment to this decree.
3. For ETTPT-PKK whose names bear "star-marks", the realisation of totals of KPt as meant in Article 3 paragraph (2) of this decree shall be postponed.
4. The totals of KPt as meant in Article 3 paragraph (2) of this decree can be realised after the relevant companies have adjusted administration data and met other requirements as stipulated for ETTPT-PKK.
5. The deadline for the administrative adjustment and fulfillment of other requirements as meant in Article 3 paragraph (4) of this decree shall be the end of April 1999.
6. The KPt as meant in Article 3 paragraph (2) of this decree shall be effective from 1 January, 1999 through December 31, 1999.
7. Especially with regard to KPt for ETTPT-PKK in Bali, the allocation is fixed at 20% of 6% of KPt, which is globally determined by the Director General of Intrnational Trade through the Bali Regional Office of the Ministry of Industry and Trade.
Article 4
1. ETTPT receiving KPt shall realise exports themselves from the quotas they obtain/own and shall not have them realised by others for more than two categories per quota country.
2. For maximising the utilisation of TPT quotas, ETTPT failing to realise exports themselves from the quotas they obtain/own which originate in KT, KPt, KSM, KSM-S, KSS, KF and KP shall be obliged to establish partnership with other ETTPT realising exports themselves on the basis of mutual profit and report it to the relevant institution.

The implementation of this decree shall be further stipulated in a decision of the Director general of International Trade.
Article 7
This decree shall come into force as from the date of stipulation.
