MEMORANDUM SALING PENGERTIAN TENTANG
KERJASAMA MARITJM ANTARA
PEMERINTAH REPUBLIK INDONESIA DAN
PEMERINT AH REPUBLIK RAKYAT TIONGKOK
Pemerintah Republik Indonesia clan Pemerintah Republik Rakyat Tiongkok (selanjutnya discbut sebagai "Para Pibak");
BERHASRA T untuk meningkatkan lebih lanjut hubungan bilateral yang telab terjalin antara kedua negara;
MEMPERHA TIKAN ke1jasama yang bermanfaat dan efektif antara kedua negara dalam bidang-bidang, antara lain, keselamatan pelayaran, keamanan maritim, dialog dan ke1:jasama antara kedua Angkatan Laut, penelitian ilmiah kelaulan, dan perlindungan lingkungan;
MENGAKUI pentingnya memperluas dan memperdalam kcrjasama maritim antara Para Pihak guna memperkaya kemitraan strategis bilateral untuk keuntungan bagi rakyat kedua negara;
MENY ADARI babwa kerjasama maritim yang lebih crat antara kedua negara meningkatkan saling kepercayaan dan kesepahaman mereka serta mendorong perkcmbangan dari hubungan bertetangga kedua negara yang baik dan hubungan yang bersahabat;
MENGINGAT ketentuan-ketentuan terkait dari Konvensi Perserikatan Bangsa-Bangsa tentang Hukum Laut pada tanggal 10 Desember I 982;
Implementasi dari Deklarasi Bersama dalam Kemitraan Strategis antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Tiongkok yang ditandatangani pada tanggal 21 Januari 2010 dan Komunike Bersama antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Tiongkok tentang Penguatan Lebih Lanjut Kemitraan Strategis Indonesia-Tiongkok yang diterbitkan pada tanggal 29 April 2011;
SESUAI DENG AN hukum dan peraturan nasional masing-masing dari Para Pihak;
Telah menyetujui sebagai berikut:
Pasal 1 Tujuan
Para Pihak wajib membentuk suatu kerangka kerja untuk memperkuat Iebih lanjut mekanisme kerjasama maritim bilateral dalam bidang-bidang maritim, seperti keselamatan pelayaran, lingkungan laut, dan keamanan maritim.
Pasal 2 Bidang Kerjasama
Para Pihak wajib mendorong perkembangan kerjasama maritim melalui bidang-bidang berikut:
1. Keselamatan Pelayaran:
(1) Pertukaran informasi mengenai keselamatan pelayaran;
(2) Penyediaan alat bantu pelayaran untuk keselamatan pelayaran dan fasilitas terkaitnya;
(3) Kerjasama dalam dialog antara Negara Pantai dan Negara Pengguna Selat Malaka dan Singapura.
2. Lingkungan Laut dan Perikanan:
(1) Pertukaran informasi mengenai Hngkungan laut;
(2) Perlindungan lingkungan dan ekologi maritim; Pertukaran teknis dan kerjasama mengenai tumpahan minyak di laut dan pencegahan polusi;
(3) Pertukaran teknis dan kerjasama untuk memerangi, mencegah, menangkal, dan menghapuskan penangkapan ikan yang ilegal, tidak diatur dan tidak dilaporkan.
(4) Penelitian ilmiah kelautan, program observasi dan pelatihan; 3. Keamanan Maritim:
(3) Kerjasama di bidang-bidang seperti memerangi penyelundupan, perdagangan obat terlarang, perdagangan manusia, kejahatan transnasional terorganisir, kejahatan terhadap kapal di laut, perompakan, dan tindakan-tindakan melanggar hukum lainnya di laut;
( 4) Pertukaran antar angkatan bersenjata di bidang-bidang seperti saling kunjung angkatan laut, guna meningkatkan hubungan antara militer dan kerjasama terkait lainnya.
4. Bidang lainnya:
( 1) Kerjasama pencarian dan pertolongan maritim;
(2) Pembangunan dan penyediaan kapal, termasuk perawatan dan perbaikan; (3) Program peningkatan kapasitas mengenai isu-isu maritim;
(4) Kerjasama di berbagai forum internasional seperti Organisasi Maritim
Internasional (OMI), Organisasi Hidrografis Internasional (OHI), Komisi Oseanografi Antai· Pemerintah (KOAP) dan Asosiasi Internasional Otoritas Mercusuar (AIOM);
(5) Bidang kerjasama lainnya yang dianggap perlu oleh Para Pihak.
Pasal 3
Komite Kerjasama Maritim
1. Para Pihak sepakat untuk membentuk Komite Kerjasama Maritim (selanjutnya
disebut sebagai "KKM") yang di Ketuai Bersama oleh Wakil Menteri Luar Negeri
dari masing-masing negara, dengan anggotanya yang terdiri dari wakil-wakil
instansi pemerintah terkait dari masing-masing Pihak.
2. KKM adalah suatu badan pengai·ah untuk kerjasama mru:itim antara Para Pihak dengan mandat berikut:
(1) Memberikan pedoman kebijakan mengenai mekanisme kerjasama maritim antai11 Para Pihak;
(2) Merencanakan bidang-bidang dan proyek-proyek penting kerjasama maritim antara Para Pihak dari perspektif strategis tingkat tinggi dan jangka panjang; (3) Membuat keputusan mengenai isu-isu penting;
(4) Mengarahkan dan mengawasi penggunaan Dana Kerjasama Maritim Indonesia-Tiongkok;
3. KKM akan bertemu setiap tahun cli Indonesia atau Tiongkok secara bergantian. dan
4. KKM akan melapor kepada dialog bilateral antara Menteri Luar Negeri kedua negara dan antara Menteri Koordinator bidang Politik Hukum, dan Keamanan dari Republik Indonesia dan Dewan Negara dari Republik Rakyat Tiongkok.
Pasal 4
Komite Teknis Kerjasama Maritim
I. Para Pihak sepakat untuk membentuk Komite Teknis Kerjasama Maritim
(selanjutnya disebut sebagai "KTM"') yang diKetuai Bersama oleh pejabat tingkat tinggi dari masing-masing Kementerian Luar Negeri dengan anggotanya terdiri dari wakil-wakil dari instansi pemerintah terkait.
2. KTM adalah badan eksekutif untuk kerjasama maritim antara Para Pihak dan bertanggung jawab untuk tugas-tugas berikut :
(1) Merencanakan, menyetujui, mendorong dan mengawasi proyek-proyek kerjasama;
(2) Melapor kepada KKM mengenai pelaksanaan proyek-proyek dan kerjasama di masa depan, dan membuat rekomendasi kepada KKM.
3. KTM akan mengadakan pertemuan tahunan dan/atau pertemuan-pertemuan khusus di Indonesia atau Tiongkok secara bergantian, berdasarkan kesepakatan bersama Para Pihak.
Pasal 5
Dana Kerjasama Maritim
1. Fungsi utama Dana Kerjasama Maritim adalah untuk menyediakan dukungan keuangan bagi kerjasama maritim antara Para Pihak melalui pendanaan proyek-proyek yang disetujui.
Pasal 6
Hak Kekayaan Intelektual
Setiap basil dari aktivitas yang dilakukan dibawah Memorandum Saling Pengertian ini wajib tunduk kepada hukum dan peraturan perundang-undangan mengenai perlindungan hak kekayaan intelektual dan hak terkait dalam wilayah masing-masing Para Pihak sepanjang tidak diatur dalam suatu persetujuan umum yang bersifat intemasional.
Pasal 7
Amandemen
Setiap amandemen terhadap Memorandum Saling Pengertian ini wajib dibuat hanya berdasarkan kesepakatan yang dicapai melalui konsultasi dan dengan konfinnasi tertulis oleh kedua Pihak.
Pasal 8
Penyelesaian Sengketa
Setiap sengketa yang mungkin timbul diantara Para Pihak dalam melaksanakan Memorandum Saling Pengertian ini akan diselesaikan secara damai melalui konsultasi.
Pasal 9
Masa Berlaku, Masa Berlaku dan Pengakhiran
1. Memorandum Saling Penge1tian ini akan mulai berlaku pada tanggal penandatanganan oleh kedua Pihak.. Memorandum Saling Penge1tian akan tetap berlaku untuk jangka waktu lima tahun dan akan diperpanjang secara langsung untuk jangka waktu lima tahun berikutnya dan seterusnya, kecuali diak.hiri pada setiap waktu oleh salah satu Pihak dengan memberikan pemberitahuan tertulis kepada Pihak lainnya, sekurang-kurangnya 6 (enam) bulan sebelumnya
2. Pada saat berlakunya Memorandung Saling Pengertian ini, Memorandum Saling Pengertian antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Tiongkok mengenai Kerjasama Maritirn yang ditandatangani oleh kedua belah Pihak pada tanggal 25 April 2005 akan berakhir.
SEBAGAI BUKTI, yang diberi kewenangan oleh Pemerintah masing-masing Negara,
yang dibawah ini menandatangani Memorandum Saling Pengertian ini.
Dibuat cli Beijing pada tanggal 23 Maret 2012, dalam rangkap dua dalam bahasa
Indonesia, Mandarin, dan lnggris, semua naskah mempunyai kekuatan huk.um yang
sama. Dalam hal terdapat perbedaan interpretasi, naskah dalam bahasa Inggris yang akao berlaku.

MEMORANDUM OF UNDERSTANDING ON
MARITIME COOPERATION BETWEEN
THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND
THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CIDNA
The Government of the Republic of Indonesia and the Government of the People's Republic of China (hereinafter referred to as "the Parties,,);
DESIRING to further promote the existing bilateral relations between the two

NOTING the fruitful and effective cooperation between the two countries in the fields
of, among others, safety of navigation, maritime security, dialogue and cooperation between the two navies, marine scientific research and environmental protection;
RECOGNIZING the importance of expanding and deepening maritime cooperation
between the Parties for enriching the bilateral strategic partnership to the benefit of the two peoples;
REALIZING that closer maritime cooperation between the two countries enhances
their mutual trust and understanding and promotes the development of their good-neighborly and friendly relationship;
RECALLING the relevant provisions of the United Nations Convention on the Law of
the Sea of I 0 December 1982;
April 2005, the Plan of Action for the Implementation of the Joint Declaration on Strategic Partnership between the Government of the Republic of Indonesia and the Government of the People's Republic of China signed on 21 January 2010 and the Joint Communique between the Government of the Republic of Indonesia and the Government of the People's Republic of China on Further Strengthening the Indonesia-China Strategic Partnership issued on 29 April 2011;
PURSUANT TO the respective national laws and regulations of the Parties;
Have agreed as follows:
Article 1 Objectives
The Parties shall establish a framework for further strengthening the bilateral maritime cooperation mechanism in the maritime fields, such as safety of navigation, marine environment, and maritime security.
Article 2
Areas of Cooperation
The Parties shall promote the development of the maritime cooperation through the following areas:
1. Safety of Navigation:
(1) Exchange of info1mation on safety of navigation;
(2) Provision of aids-to-navigation for safety of navigation and its related facilities; (3) Cooperation in dialogues between the Littoral States and User States of the
Straits of Malacca and Singapore;
2. Marine Environment and Fisheries:
(1) Exchange of information on marine environment;
(2) Maritime environmental and ecological protection; Technical exchanges and cooperation on oil spill at sea and pollution prevention;
3. Maritime Security:
( 1) Exchange of info1mation on maritime security;
(2) Provision of aids for maritime surveillance, monitoring and management; (3) Cooperation in such areas as combating smuggling, drug-trafficking, trafficking
in person, transnational organized crimes, crimes against ships at sea, piracy, and any other unlawful acts at sea;
( 4) Exchanges among the armed forces in such areas as navy mutual visits, to
enhance military-to military relations and other relevant cooperation;
4. Other Areas:
(1) Maritime search and rescue (SAR) cooperation;
(2) Construction and provision of ship, including maintenance and repair;
(3) Capacity building programs on maritime issues;
( 4) Cooperation in various international forum such as International Maritime
Organization (IMO), International Hydrngraphic Organization (IHO), Intergovernmental Oceanographic Commission (IOC) and International Association of Lighthouse Authorities (IALA);
(5) Other areas of cooperation deemed necessary by the Parties.
Article 3
Maritime Cooperation Committee
1. The Parties agree to establish Maritime Cooperation Committee (hereinafter referred to as the "MCC") which shall be Co-Chaired by the Vice Minister for Foreign Ministry from the respective countries, with its members consisting of representatives from relevant government agencies from each Patty.
2. The MCC is a steering organ for the maritime cooperation between the Parties with
the following mandates:
(1) Providing policy guidance on maritime cooperation mechanism between the Patties;
(2) Planning the key areas and projects of maritime cooperation between the Patties from a strategic height and a long-term perspective;
(3) Making decision on important issues;
3. The MCC shall meet annually in Indonesia or China alternately, and may convene
special meetings whenever deemed necessary upon mutual consent of the Parties.
4. The MCC shall report to the bilateral dialogues between the Ministers for Foreign Affairs of the two countries and between the Coordinating Minister for Political, Legal and Security Affairs of the Republic of Indonesia and the State Councilor of the People's Republic of China.
Article 4
Technical Committee on Maritime Cooperation
1. The Parties agree to establish Technical Committee on Maritime Cooperation (hereinafter referred to as the "TCM") which shall be Co-Chaired by the respective high ranking officials from the Ministry of Foreign Affairs with its members consisting of representatives from the relevant government agencies.
2. The TCM is the executive organ for the maritime cooperation between the Parties and is responsible for the following tasks:
(1) Planning, approving, promoting and supervising the cooperation projects;
(2) Reporting to the MCC on the implementation of the projects and for future cooperation and making recommendations to the MCC.
3. The TCM shall convene annual meeting and/or special meetings in Indonesia or China alternately, based upon mutual consent of the Parties.
Article 5
Maritime Cooperation Fund
1. The main task of the Maritime Cooperation Fund is to provide financial support for the maritime cooperation between the Parties by funding the approved projects.
Article 6
Intellectual Property Rights
Any result of activities performed under this Memorandum of Understanding shall be subject to the laws and regulations concerning the protection of intellectual property rights and related iights in the respective territories of the Parties insofar as these are not covered by a general agreement of an intemational character.
Article 7
Amendment
Any amendment to this Memorandum of Understanding shall only be made after mutual consent achieved by consultation and with written confirmation by both Parties.
Article 8
Settlement of Disputes
Any dispute that may occur between the Parties in implementing this Memorandum of Understanding will be settled amicably through consultations.
Article 9
Entry into Force, Duration and Termination
1 . The Memorandum of Understanding will come into force upon signature by both Parties. It wiJI remain in force for five years and will be automatically renewed for another period of five years and thereafter accordingly, unless terminated at any time by either Pa11y by giving prior notification to the other Party, at least 6 (six) months in advance.
3. Upon the termination of this Memorandum of Understanding, the Parties will determine the further course of all ongoing activities concluded in the framework of this Memorandum of Understanding in clearly defined terms and conditions.
IN WITNESS THEREOF, being duly authorized by their respective Governments
concerned, the undersigned signed this Memorandum of Understanding.
Done at Beij ing on March 23, 2012, in duplicate in the Chinese, Indonesian, and English languages, all texts being equally authentic. In case of divergence in interpretations, the English text will prevail.
