masulc ke, bertempat t1nggal di, beperg1an dan berkediaman

PASAL II
1. Warganegara-war1anegara dan peruaahaan-perusahaan salah satu Pihak Jang berada d1w1laJah P1hak jang 1a1nnJa,
akan d1ber1.ka.n perlakuan Jang tidak kurang daripada jang
diberi.kan kepada warganegara-varganegara dan
peruaahaan-perusahaan negara ketiga manapun djuga, mengena1 segala soal
berhubungan dengan pembebanan padJak, hak untuk mengadjukan
persoalan kemuka pengadilan, hak-hak rtas m111k, 1.kut aertanja
didalam badan-badan hukum, dan umumnja penjelenggaraan segala
djen1s kegiatan perusahaan serta usaha perseorangan.
2. Ketentuan-ketentuan aJat l dar1 Pasal 1n1 t1dak
mengu-rang1 hak mas1ng-mas1ng Pihak untuk member1kan
k:er1nganan-kPr1nr,anan padjak Jang chusus atas dasar t1mbal-bal1k atau

l. Warganegara-warganegara salah satu Pihak 、QセQャ。ェ。ィ@
Pihak jang lainnja, akan diberikan perlakuan jang tidak
kurang daripada jang diberikan kepada
warganegara-warganegara Pihak jang lainnja itu dan negara ketiga
aanapun djuga mengenai perlindungan dan keamanan pr1bad1
mereka.
2. (l} Warganegara-warganegara salah satu Pihak
d1w1lajah Pihak jang lainnja akaJ\ dibebaskan dari tugas
vadjib m111ter dan dar1 pembajaran apapun djuga jang
dikenakan sebagai ganti tugas tersebut.
(2) Warganegara-warganegara dan perusahaan-perusahaan
aalab satu Pihak divilajah Pihak jang lainnja altan diberikan
perlaltuan jang tidak kurang daripada jang diberikan kepada
varganegara-warganegara dan perusahaan-perusahaan Pihak
jang lainnja itu dan kepada negara ketiga manapun djuga,
mengenai aegala pindjaman-pindjaman vadjib,
pembebanan-pembebanan, penjitaan-penjitaan atau pengasramaan vadjib
militer.
PASAL IV
Barang milik warganegara-warganegara dan
perusahaan-perusahaan salah satu Pihak diwilajah Pihak jang lainnja
t1dak &kan diambil, terketjual1 untuk auatu kepentingan
umum, dem11<1an djuga m111k 1tu tidak akan diambil tanpa
penggantian kerugian jang adil sesua1 dengan

PASAL V
1. Warganegara-warganegara dan perusahaan-perusahaan
salah satu Pihak akan d1ber1.kan perlakuan Jang t1dak
kurang daripada Jang d1ber1kan kepada
warganegara-warganegara dan perusahaan-perusahaan negara ketiga
manapun djuga, mengenai pembajaran, pengiriman uang dan transfer dana-dana atau surat-surat berharga, ba1.k antara wilajah kedua belah Pihak maupun antara wilajah
Pihak Jang la1.nnja dan negara ketiga manapun dJuga.
2. Mas1ng-mas1ng Pihak tidak akan mengadakan
pembatasan-pemba taaan atau larangan-larangan terhadap pemasukan sesuatu
basil Pihak jang la1.nnja atau terhadap pengeluaran aesuatu
haail kewilajah Pihak Jang lainnja, terketjual1 dj1.ka
pemasukan dar1 atau pengeluaran hasil jang sama
kesegaJ.-negara ketiga d1kenakan pembatasan atau larangan serupa.

mengenai pendjualan dalam neger1, penawaran pendjualan,
pembel1an, d1str1bus1 atau pemakaian barang-barang impor,
maka setiap keringanarj, keuntUrtgan, hak istimewa atau
kekebalan Jang telah atau mungkin diberikan kemudia.n oleh

Kedua Pihak menjanggupi untuk bekerdja sama dP.ngan
belah P1hak serta memperkuat hubungan ・ォッョッセゥ@ antara kPdua bel&h Pihak, dan untuk memadJukan pertukarun serta peng-gunaan pengetahuan 1lm1jah dan teknik, terutama dem1 kepentingan pembangunan ekonom1 serta perbaikan taraf h1dup d1w1lajah mas1ng-mas1ng, dengan memperhat1.kan

PASAL VIII
Ketentuan-ketentuan Perdjandj1an ini tidak akan mempengaruhi hak-hak dan kewadjiban-kewadjiban jang telah
ada pada atau mungkin akan diperoleh salah satu Pihak S8b&ga1 anggauta General Agreement on Tariffs and Trade, atau pasal-pasal Agreement of the International Monetary Fund, atau suatu persetudjuan multilateral jang mengandung perobahan atau tamb&han, selama kedua belah Pihak masih tetap anggauta persetudjuan atau persetudjuan-persetudjuan jang bersangkutan.
PASAL IX
Ketentuan-ketentuan Perdjandjian in! tidak dapat d1art1kan sebagai penghalang bag! masing-masing Pihak mengtJ11b1l atau melaksanakan tindakan- tlndakan berkene.an dengana
b. bahan-oahan inti atau bahan-bahan baku untuk membuatnja;
c. perdagangan ウ・イエセ@ pengangi<utan sendjata, amunisi serta alat-alat perang, du.n perdagangan serta pengangkutan barang-barang serta bahan-bahan la1nnja jang dilakukan sedem1k1an rupa sehinega setjara langsung atau tidak langsung dapat diper-gunakan untuk memperlengkapi suatu bangunan m111ter;
d. perlindungan kesusilaan umum;
e. perlindungan kesehatan u.mum dan perlindungan chewan serta tumbuh-tu.mbuhan terhadap penjakit-penjakit, serangga-serangga jang merusak dan benalu-benalu;
f. perdagangan emas dan perak;
g. perlindungan barang-barang pusaka nadonal J::uig bernilai kesenian, sedjarah atau il.mu pengetahuan purbak.ala; dan
h. dipenuhinja kewadjiban-kewadjiban jang diletakkan

PASAL XI
1. Perdjandjian ini akan disahkan, dan piagam pengesahannja
akan ditukarkan selekas mungkin di Djakarta.
2. Perdjiandjian ini akan mulai berlaku satu bulan sesudah hari pertukaran piagam-piagam pengesahannja. Perdjandjian
ini akan berlaku untuk tiga tahun dan akan tetap berlaku setelahnja hingga dibatalkan aenurut ketentuan jang tertera
dalaa ajat 3 dari Pasal ini.
3. Salah satu Pihak dapat membatalkan Perdjandjian ini pada achir masa tiga tahun semula atau setiap vaktu
sesudahnja, dengan memberitahukan setjara tertulis enam
bulan sebelumnja kepada Pihak Jang lainnja.
PASAL XII
Perdjandjian ini dibuat dalam bahasa-bahasa Dj•pang,
Indonesia dan Inggris. Bila terdapat perbedaan tatairan,
Untult menguatkannja, \1iak11 Wakil Berkuasa Penuh jang bersangkutan telah menandatangani Perdjandjian lni dan telah membubuhkan metera1-metera1 mereka padanja.

Keramahan dan Pern1agaan antara DJepang dan Republ1k
Indonesia (selandJutnJa disebutkan "PerdJandJian"), Wakil
Wakil Berkuasa Penuh Jang ber.tandatangan dibawah 1nJ., Jang telah d1ber1 wewenang seperlunJa oleh PemerintahnJa
masing-masing, selandjutnja telah menjetudjui ketentuan-ketentuan
berikut, Jang harus dianggap sebagai bagian Jang tidak
dapat dipisah-pisahkan dar1 PerdJandjian1
1. Mengenai Pasal I, Kedua belah Pihak sependapat bahwa
salah satu Pihak manapun tidak akan berhak menuntut
ker1nganan-keringanan Jang bersangkut-paut dengan
soalsoal paspor dan visa Jang tel ah di berikan a tau akan di be ri
-kan kmudian oleh Pihak jang lainnJa kepada warganegara-varganegara negara ketiga manapun dJuga sesua1 dcngan
persetudjuan-persetudjuan chusus atas dasar timbal-balik.
2. Ketentuan-ketentuan Pasal I t1dak dapat diartikan
memberi hak kepada Djepang untuk menuntut manfaa t da r i
keringanan-keringanan Jang sebagai t radis! dHe r1kan ola''l
Republik Indonesia kepada warganegara-w<1.r gan•1;;ara Ht:i;a r1s
Singapura.

4. Mengenai 1:-asal II, ajat 1, salah satu Pih&k dapat menuntut agar perlakuan dalam mendapatkan hak-hak atas benda-benda tid&k bergerak didasarkan atas azas timbal-balik.
$. Ketentuan-ketentuan Perdjandjian ini tid&k dapat d1-art1kan sebaga1 memberi hak atau meletakkan suatu kewadjiban apapun djuga mengena1 h&k pengarang dan hak m111k industrl. 6. Ketentuan-kettintuan dalam Pasal IV akan berlaku
terhadap barang milik, jang d1amb11 d1w1lajah salah satu Pihak, dalam mana varganegara-warganegara serta perusahaan-perusahaan Pihak jang la1nnJa mempunjai kepent1ngan.

8. Ketentuan-ketentuan dar1 Perdjandj1an 1n1 jang ュ・セ「・イャ@

(a) ker1nganan-ker1nganan jang diberikan oleh salah satu Pihak kepada negara-negara tetangganja untuk mempermudah la1u-11ntas perbatasan;
(b) keringanan-keringanan Jang serupa dengan Jang dimaksudkan dalam ajat (a), Jang diber1kan oleh
Republik Indonesia pada Persekutuan Tanah Melayu, Republik Philipina dan Negara Singapura; dan (c) ker1nganan-ker1nganan jang diber1kan oleh salah
satu P1hak sebagai ak1bat suatu customs union atau suatu persetudjuan mengena1 daerah perdagangan bebas dar1 bea dan tjuka1, dalam mana Pihak
teraebut kelak mungkin 1kut-serta.
9.
Ketentuan-ketentuan Perdjandj1an 1n1 tid&k dapat d1art1kan sebaga1 member! hak kepada Republik lndJnesia untuk menuntut keuntungan dari bak-hak serta hak-hak 1st1mewajang telah atau akan diberikan kemudian oleh Djepang kepada: (a) orang- orang jang berasal dari w1lajah-w1laJah, atas mana Djepang telah melepaskan semua hak, titel dan tuntutan-nja sesuai dengan ketentuan-ketentuan dari Pasal 2 Per-djandj1an Perdamaian Djepang Jang ditandatangan1 d1kota San Francisco pada tanggal 8 September, 1951, atau (b) penduduk-penduduk asli serta kapal-kapal dari, dan perniap.aan 、セョァ。ョL@
Perdjandjian Perdamaian セ・イウ・「オエL@ selama keadaan, sebagai jang disebutkan dalam kal1mat kedua dar1 Pasal tersebut mengenai pemer1ntahan, perundang-undangan serta jur1sd1ks1 atas daerah itu, masih tetap berlangsung.
Untuk menguatknnnja, Wakil '.ilakil Berkuasa Penuh jang bersanglrutan telah menandatangani Protokol ini dan telah membubuhkan meterai-meterai mereka padanja.

Who, having commwiicated to each other their full
powers found to be in due form, have agreed upon the f

ARTICLI I
Natiooala of either Party shall be permitted to enter
the territory of the other Party in accordance with the
provisions or the laws and regOlations of such other Party
and shell be accorded treatment no leas favourable than
that aooorded to nationals or any third country with raspeot
to all matters relating to their entry into, their sojourn,
tra.el and residence within, and their departure from, th•
territory of such other Party.
ARTICLB II
l. Nationals and companies or either Party shall be
accorded, within the territory ot the other Party,
treat-ment no lesa favourable than that accorded to nationals and
compallies ot any third country with respect to all msttera
pertaintne to the lttvying of taxes, access to the courts,
rights to property, participation in juridical entitles,
and generally the conduct or all kinds or business and
professional activities.
2. .Notwithstanding the provisions or paragraph l of this
tax adTantages on a basis of reciprocity or by virtue of
agreements tor the avoidance of double taxation or the
autual proteotlon ot reTenue.
ARTICLE III
l. .Nationals ot either Party, within the territory ot
th• other Party, shall be accorded treatment no leas
favourable than that accorded to nationals ot such other
Party and ot any third country with respect to the
protection and eecurity tor their persons.
2. (1) Nationals ot either Party, within the territory
ot the other Party, shall be exempt from any compulsory
111.llltary service and from any disbursement iapoaed in
place ot such serrtoe.
(2) Nationals and companies of either Party shall be
accorded, within the territory

l. 1'8tionals and companies of either Party shall be accorded treatment no less favourable than that accorded to nati onals and companies of any third country with respect to payments, remittances and transfers or funds er f i nenci6l instruments between the territories of the two Parties as well as between the territories of the other Party end of any third country,
2. Neither Party shall impose restrictions or prohibitions on the importation of any product of the other Party, or on the exportation

AH'1'ICL.E VIII
Nothing in the present '.l'reaty shall affect the rights and obligations that either Party has or may have as a contracting party to t he General .Agreement on Tarirrs and Trade or the Articles of セイ・・ュ・ョエ@ ot the International Monetary Fund or any mul tl.l&teral agreement amendatory or supplementary thereto, so long ea both Parties are contracting parties to t ha relevttnt agreet1ent or agreements.
ARTICLE IX
The provisions or the ーイ・セ・ョエ@ '.l'reaty shall not be
interpreted as preclud11.g each Party エイッセ@ aaopti ng or
(a) the internel public security or nati cnal 1e1·ense or the maintenance or international peace and security;
(b) fissionable materials or the materials from which they are derived;
(o) traffic in arms, ammunition anrl implements of war and such traffic 1n other goods and materials as is carried on directly or indirectl7 tor the purpose of supplying a mill tery establishment'; (d) the protection of public morals;
(e) the protection of public health and the proteDtion
ot animals and plants against diseases, harmtul insects and parasites;
(f) trade in gold or silver;
(g) the protection of national treasure s or artistic, historic or archaeological value; and
(h) the fulfillment of obligations under any multi-lateral commodity agreement.
ARTICLE X

At the time of signing the Treety of Amity end

(hereinatt.er referred to as "the Treaty"). the
under-signed Plenipotentiaries, duly authorized by their
respective Governments, have further agreed on the
following proviaions, which shall be ccnsidered ャセエ・ァイ。ャ@
parts of the Treaty:
l. With reterence to Article I, it le understood that
neither Party ehall be entitled to claim the benefit ot
those advantages relating to matters concerll.lng passports
and visas which the other Party bas accorded or may
here-after accord to nationals ot any third country by virtue
ot 8pecial agreements on a basis of reciprocity.
2. Nothing in Article I shall be construed 80 as to
entitle Japan to claim the benefit ot those advantages
tracUtionally accorded by the Republic or Indonesia to the
Citizens ot the State or Siugapore.
