THE AMENDMENT OF DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 458/MPP/Kep/7/2003 ON PROVISIONS AND PROCEDURES FOR
THE IMPOR OF CITY AND URBAN BUSES IN NON-NEW CONDITION
THE MINISTER OF INDUSTRY AND TRADE,
Considering;
a. that in connection with difficulties in the implementation of provisions on fulfillment of administrative requirements for importing city and urban buses in non-new condition, due to gas emission as meant Decree of the Minister of Industry and Trade No. 458/MPP/Kep/7/2003, on provisions and procedures for the import of city and urban buses in non new condition, it is deemed necessary to amend the said decree;
b. that in relation there to, it is necessary to issue a decree of the Minister of Industry and Trade;
In view of:
1. Decree of the Minister of Industry and Trade No. 756/MPP/Kep/11/2002 on the import of non-new machines and machinery equipments as already amended by Decree of the Minister of Industry and Trade No. 411/MPP/Kep/6/2003;
2. Decree of the Minister of Industry and Trade No. 458/MPP/Kep/7/2003 on provision and procedures for the import of city and urban buses in non-new condition;
3. Decree of the Minister Industry and Trade No. 480/MPP/Kep/7/2003 on the appointment of surveyors as the executors of verification and technical surveillance of the import of city and urban buses in non-new condition;
DECIDES: To stipulate:
THE AMANDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 458/MPP/Kep/7/2003 ON PROVISIONS AND PROCEDURES FOR THE IMPORT OF CITY AND URBAN BUSES IN NON-NEW CONDITION.
Article I
Several provisions in Decree of the Minister of industry and Trade No. 458/MPP/Kep/7/2003 shall be amended as follows:
1. to amend the provision in article 4 so as to entirely read as follows:
“Article 4
a. total seats of 20 (twenty) passengers or more, including the driver; b. axle configuration 1.2;
c. chassis age of 5 (five) years at the minimum and 15 (fifteen) years at the maximum;
d. right steering system;
e. fulfilling roadworthiness in accordance with the provision in force; f. fulfilling Indonesian gas emission standards;
g. marks must have existed in Indonesia.”
2. To amend the provision in Article 5 paragraph (1) so as to entirely read as follows:
“Article 5
(1) The import of non-new city buses shall be accompanied by Certificate of Inspection from surveyors, certifying the fulfillment of requirements, total seats of 20 (twenty) passengers or more including the driver, axle configuration 1.2., chassis age of 5 (five) years at the minimum, and 15 (fifteen years at the maximum, right steering system, gas emission content and mark already existing in Indonesia as well as mention type and variants, country of origin of brand holders, frame no.., dimension, weight, type/model of engine, no. of engine, cylinder capacity and maximum capacity.
(2) The implementation of survey in the framework of issuance of certificate of inspection shall be done in countries where the goods are loaded.
(3) Cost of inspection survey of the import of non-new city buses shall be borne by importers of non-new city buses.”
3. To change the completing form contained in the Attachment to Decree of the Minister of Industry and Trade No. 458/MPP/Kep/7/2003 as regulated in the provision in Article 9 so as to become what is contained in the attachment to this decree.
Article II
This decree shall come into force as form the date of stipulation.
For public cognizance, the decree shall be published by placing it in State Gazette of the Republic of Indonesia.
