DECREE OF THE MINISTER OF COMMUNICATION AND INFORMATION TECHNOLOGY

NUMBER : 06 /P / M. Kominfo / 5/ 2005 ON

SECOND AMENDMENT TO THE DECISION OF THE MINISTER OF

COMMUNICATION NUMBER KM. 4 YEAR 2001 ON THE DEFINING OF NATIONAL FUNDAMENTAL TECHNICAL PLAN 2000 OF NATIONAL TELECOMMUNICATION

DEVELOPMENT

BY THE GRACE OF GOD THE ALMIGHTY

MINISTER OF COMMUNICATION AND INFORMATION TECHNOLOGY

Considering: a. that the application of access code of long distance direct dialing regulated in the Decision of the Minister of Communication Number KM. 4 Year 2001 on the Defining of National Fundamental Technical Plan 2000 of National Telecommunication Development as amended by the Decision of the Minister of Communication Number KM. 28 Year 2004 is no more in line with the situation and condition that develop within the society;

b. that in view of what is stated in point a above, it is considered necessary to make Second Amendment to the Decision of the Minister of Communication Number : KM. 4 Year 2001 on the Defining of National Fundamental Technical Plan 2000 of National Telecommunication Development by issuing a Decree of the Minister of Communication and Information Technology.

Bearing in mind: 1. Law of the Republic of Indonesia Number 36 Year 1999 on Telecommunication (State Gazette of the Republic of Indonesia Number 154 Year 1999, Supplement to the

State Gazette of the Republic of Indonesia Number 3881);

2. Government Regulation of the Republic of Indonesia Number 52 Year 2000 on Provision of Telecommunication (State Gazette of the Republic of Indonesia Number 107 Year 2000, Supplement to

3. Government Regulation of the Republic of Indonesia Number 53 Year 2000 on Use of Radio Frequency Spectrum and Satellite Orbit (State Gazette of the Republic of Indonesia Number 108 Year 2000, Supplement to the State Gazette of the Republic of Indonesia Number 3981);

4. Decree of the President of the Republic of Indonesia Number 9 Year 2005 on Positions, Duties, Functions, Organizational Structure and Work Method of State Ministries of the Republic of Indonesia;

5. Decree of the President of the Republic of Indonesia Number 10 Year 2005 on Organizational Units and Duties of Echelon I of State Ministries of the Republic of Indonesia as amended by the Decree of the President of the Republic of Indonesia Number 15 Year 2005;

6. Decision of the Minister of Communication Number KM. 20 Year 2001 on Provision of Telecommunication Network as amended by the Decision of the Minister of Communication Number KM. 29 Year 2004;

7. Decision of the Minister of Communication Number KM 21 Year 2001 on Provision of Telecommunication Service as amended by the Decision of the Minister of Communication Number KM. 30 Year 2004;

8. Decree of the Minister of Communication and Information Technology Number 01/P/M.Kominfo/1/2005 of 1 April 2005 on Organizational Structure and Work Method of the Department of Communication and Information Technology;

9. Decree of the Minister of Communication and Information Technology Number 03/P/M.Kominfo/5/2005 on Adjustment of Nomenclatures of a Number of Decisions/Decrees of the Minister of Communication which Regulate Special Material Content in the Field of Post and Telecommunication.

DECIDES :

To issue : DECREE OF THE MINISTER OF COMMUNICATION AND INFORMATION TECHNOLOGY ON SECOND AMENDMENT TO THE DECISION OF THE MINISTER OF COMMUNICATION NUMBER KM 4 YEAR 2001 ON THE DEFINING OF NATIONAL FUNDAMENTAL TECHNICAL PLAN 2000 OF NATIONAL TELECOMMUNICATION DEVELOMENT

Article I

A number of provisions in the Attachment of the Decision of the Minister of Communication Number KM. 4 Year 2001 on the Defining of National Fundamental Technical Plan 2000 of National Telecommunication Development as amended by the Decision of the Minister of Communication Number KM. 28 Year 2004 are amended as follows :

1. Amend the provision of Chapter II Point 1.3.c) in order to read:

The presence of more than one provider in the provision of service of long distance direct dialing (SLJJ) will provide the possibility for customers to choose SLJJ service they will use. For that purpose, each provision of SLJJ service must be allocated with different SLJJ prefix.

The number of SLJJ prefixes that must be provided is estimated to be big enough , bearing in mind the vastness and variety of regions of the State of the Republic of Indonesia.

On the other hand, customers that do not wish to use their right to choose SLJJ service, must remain to obtain good service. For that purpose, there is a need to provide one special prefix as a sign that customers do not use their right to make a choice.For these customers, the selection of SLJJ service providers is done by providers of local fixed network that provide service to such customers.

2. Amend the provision of Chapter II Point 4.2.2.1 in order to read as follows :

choose or not to choose providers of SLJJ service to be used to channel their calls. For that reason, in principle there are two (2) alternatives that may be used to make SLJJ calls, namely :

1) Customers chose the available SLJJ access code.

Providers of local fixed network shall channel such SLJJ calls to providers of SLJJ service whose access code is chosen by customers and are prohibited to change the traffic to other SLJJ service providers or to other service providers.

2) Customers do not choose certain SLJJ access code.

Customer dial national prefix ‘0’ in replacement of SLJJ access code. Providers of local fixed network choose SLJJ service providers to be used by their customers.

3. Amend the provision of Chapter II Point 5.2.4.1 in order to read as follows :

Format for SLJJ access code is ‘01X’, where X = 1…9 giving the characteristics of SLJJ service providers.

The first SLJJ provider operating in Indonesia and during this period using national prefix of ‘0’ as SLJJ access code by stages shall use SLJJ access code of ‘01X’ in the numbering regions which are technically possible, and must have been completed in all numbering regions at the latest on 1 April 2010.

During the transition period up to 1 April 2010, the SLJJ call procedure is as follows:

- For SLJJ call between regions whose SLJJ access code of

‘01X’ has not been opened, customers of each local fixed network provider and customers of each cellular mobile network provider use SLJJ access code of ‘0’.

- For SLJJ call between regions whose new SLJJ service providers have opened SLJJ access code of ‘01X’, customers of each local fixed network provider in those regions and customers of each cellular mobile network provider may use SLJJ access code of ‘0’ or ‘01X’.

- For SLJJ call between regions whose SLJJ access code of

‘01X’ has been opened by all SLJJ service providers, customers of each local fixed network provider and customers of each cellular mobile network provider may use SLJJ access code of ‘01X’ chosen by them, or use SLJJ access code of ‘0’

if they do not make a choice.

4. Amend the provision of Chapter II Point 5.2.5.1 in order to read as follows :

Format for ITKP prefix is ‘010XY’, where the combination of XY (X = 0, 1,….9 and Y = 1, 2,….9) giving the characteristics of single stage ITKP service providers.

Double stage ITKP does not need prefix. For double-stage ITKP access code used is in the form of shortened number of customer with format of ‘170XY’.

ITKP providers who during this time use prefix of ‘01X’,shall make replacement with ITKP prefix of ‘010XY’ at the latest on 31 December 2005.

5. Amend the provision of Chapter V Point 4.3.6 in order to read as follows :

The implementation of routing for SLJJ call must be in line with the desire of calling customers, in relation with the use of National Prefix and SLJJ Prefix (vide Chapter II – Plan of Numbering) . 1) A user using SLJJ access code shows that he wishes his call

be channelled through SLJJ service provider chosen by him.

2) A user using National prefix as replacement of SLJJ access code shows that he leaves the choice of SLJJ service provider to local fixed network provider to channel his SLJJ call.

3) SLJJ service provider chosen directly by a user or chosen by local fixed network provider, is responsible for channeling the traffic starting from “outward point” in the beginning of local

fixed network.

Article II

This Ministerial Decree shall come into force on the date of its issuance.
