Congress on his designation of one or more of these amounts as emergency requirements under the Balanced Budget and Emergency Deficit Control Act of 1985, as amended, and (2) if the amounts are annually appropriated under this title but not designated as emergency requirements under Sec. 251(b)(2)(D)(i) of Bal-. The Leaders of the House and Senate in Conference on the Discordant Votes of the Two Houses on the Senate Appropriations of the Bill (H.R. 4602), making appropriations to the Department of the Interior and related agencies for the fiscal year ending September 30, 1995, and for other purposes, submit the following joint statement to the House and Senate in explanation of the effect of the action agreed upon by the leaders and recorn.rn .concluded in the accompanying conference report. 4602 incorporates most of the provisions in both the House and Senate versions of the bill.

The condition of the Illanagers, while repeating the language of the report for emphasis, does not negate the above language unless expressly stated herein. Administrators agreed to delete this requirement for fiscal year 1995 pending an opportunity to review the land exchange procedures of the Department of the Interior and the Forest Service.

DEPARTMENT OF THE INTERIOR

After the passage of the domestic appropriations bill in both the House and the Senate, the property associated with Hatty Diatnond Laboratories was transferred to the United States. The leaders encourage the service to work closely with the reconstituted recycler in preparing a plan for the future use of the transferred property. Of the funds provided to the National Fish and Wildlife Foundation, $500,000 is for the acquisition of lands within the San Diego County, CA Habitat Conservation Plan.

The managers expect the partners involved in developing the plan for this project to help with future funding. Obligation of funds for the rehabilitation of the Kennesaw NBP Visitor Center should not proceed until the $300,000 private. The $500,000 for the Lackawanna Heritage Valley Authority is for technical assistance and development of the LAVA plan.

The managers have provided funding for ongoing planning in the Cumberland area of ​​the Chesapeake and Ohio Canal National Historical Park. Fish and Wildlife Service to conduct comprehensive assessments of each unit of the National Park. The Illanagers note that this process must continue with the direct participation of the tribes.

With respect to the funds provided as compensation to the Marshall Islands under Section 111(d) of the agreement, the Illanagers agree with the House language requiring a plan for spending those funds to be subpoenaed to the Appropriations Committee. The leaders also request that a report on the use of the economic development funds previously provided to the Marshall Islands be submitted to the CoDlDlitt~es. Allocates a $104,000 increase to the Office of Self-Government within the Office of the Secretary, instead of $208,000 as proposed by the House.

The managers agree that those applications which have received first half-f111al certificates on or before the date of commencement of this Act are not subject to the prohibition in Section 112. the managers agree that those applications for first-semifinal certificates currently pending in the Office of the Attorney General in Washington, D.C. or elsewhere in the Department of the Interior in Washington, D.C. shall not be subject to the m.oratory in section 112 not. The managers from the House side reluctantly backed down on this an1endn1ent.

TITLE II RELATED AGENCIES DEPARTMENT OF AGRICULTURE

This language is incorporated by the Statelllent Illanagers with the understanding that the State of Texas, the City of San Antonio, other affected COIIlillunities, and other water users will be. Within the economic action programs, $2.6 million is earmarked specifically to continue the Rur Developn1ent through Forestry program in the Northeast and Midwest at the level available in fiscal year 1994. The Managers expect the Fdrest Service to consider all of these factors in determining the allocation of timber sales preparation dollars for fiscal year 1995. In addition, the Managers recommend that the Forest Service meet with the interested public. , such as crop buyers and others, to explain the costs, benefits and details of using watershed analysis in Tongass. Regarding the possibility of a 10-year contract, the Forest Service should explore that option as part of the Tongass Land Use Plan revision process.

The Illanagers are partnering with the Department of Agriculture to create a task force to examine the causes, effects and severity of wildfires in the western United States. The Department's goals in undertaking such efforts shall be to reduce the risk of loss of life and property. Members agree with the Senate's language requiring the Department to seek expressions of interest in collective projects using clean coal technologies, included in international (non-volatile) projects of the type described in the Senate report.

The IIlanagers further agree that a report, as proposed by the Senate, is needed by April 1, 1995, reviewing the role of the program in the overall context of the advanced combustion system development program. The fetal alcoholsyndrom.e project at the University of Washington should receive its fair share of the funds provided. Of the funds made available for program increases for the treatment and prevention of alcohol and drug abuse, at least $100,000 should be used to help offset operational deficiencies in the Gal region.

The IHS must work carefully with the tribes in the Portland area before making a decision on the transfer of the Native Anlerican Rehabilitation Association's alcoholisll project. The changes in the House position include an increase of $375,000 for the design of the outpatient clinic in Parker, Arizona and a decrease of $500,000 for injury prevention activities at the facilities and an environmental health support program.

DEPARTMENT OF EDUCATION

The Indian Health Service has indicated that it will consider the needs of Alaska Natives in the non-Native communities of Alaska, where circumstances hamper the ability of the town of Maize to outsource water supply and waste disposal.

The managers understand that the IHS will provide sanitation facilities to some Indian homes in non-Indian communities if the non-Indian community is in an IHS service area and the homes (new or existing) are not currently served by the short-term sanitation system. IHS may n1ain the construction of a service line between an Indian hoiile and an existing water, and IHS may pay the connection fee. If a subdivision of Indian kennels is constructed, IHS may fund the sanitation facilities for the kennels within the subdivision plus fund upgrades to the central treatment/storage systems necessary to accommodate the added Indian kennels (a prorated 81U01JDt).

IHS can fund a connection between an Indian and non-Indian community to provide improved service to the Indian community. IHS can fund a proportional amount for a new local solid waste facility in locations where there was no existing solid waste. 500,000, may be accomplished by reprogramming to the extent necessary to comply with the final reauthorization act.

OTHER RELATED AGENCIES

The decrease below the amount proposed by the House is for the grasslands. 110: Restores language proposed by the House, reducing funding for the National Endow1ent for the Arts by 2.0 percent The Senate had deleted this provision. Appropriates for conservation programs and $698,000 for services to the profession as proposed by the House. 113: Applies to the salaries and expenses of the Pennsylvania Avenue Developn1ent Corporation as proposed by the Senate. The managers expect the Board to notify the Governors as soon as possible of any necessary reallocation of funds to accommodate unexpected increases in operation and maintenance and security requirements placed on the Holocaust Memorial Museum as a result of the continuing higher -as-expected visit to the ntuseunt.

115: Restores language proposed by the House and struck by the Senate, providing that funds available to the Council in fiscal year 1995 will remain available until used for repair and rehabilitation projects at the Holocaust Memorial Museum.
