AGREEMENT CONCERNING A CONTRIBUTIVE WORK Date: June 12, 2019
To: Smithsonian Institution of 2011 Crystal Drive, Suite 350, Crystal City, VA 22202, a trust instrumentality established by the Congress of the United States, on behalf of its employee Helene Muller-Landau (the “Author,” “you”)
Princeton University Press (the “Press”) is pleased to have the privilege of publishing your contribution to the volume of work tentatively entitled Unsolved Problems in Ecology and edited by Andy Dobson, Robert Holt, and David Tilman (the “Volume”), your contribution defined hereafter as the “Work.”
So that you as Author of the Work and the Press as Publisher of the Work may be protected from the consequences of unauthorized use of its contents, the Press considers it essential to register the copyright. To this end, we ask you to license us rights to the Work. As copyright licensee, the Press will exercise its rights according to the following agreement:
1. The Press may make the manuscript of the Work conform to a style of presentation, spelling, capitalization, and usage which it deems appropriate. You shall have the opportunity to read and correct the edited manuscript and agree to return the corrected manuscript to the Press or to the volume editor, as arranged. Whether you will be shown proofs will be determined by the volume editor in consultation with the Press.
2. You represent and warrant that you are the sole proprietor of the Work, except as otherwise noted in this Agreement, and that you have full power to make this Agreement and grant; that the Work does not infringe the copyright or other proprietary rights of any other person; that the Work contains no libelous or other unlawful matter and makes no improper invasion of the privacy of any other person; that any recipe, formula or instruction contained in the Work is not injurious to the user; and that you have not previously assigned, pledged or otherwise encumbered the same or agreed to do so. If the Work includes any material requiring permission from copyright owners, you will secure and pay for such permission at your expense and furnish us with written evidence that you have done so. To the extent authorized by law, you shall indemnify, hold harmless and defend the Press from all manner of claims based upon an alleged violation of any of these representations and warranties. The provisions of this Section Two shall survive any termination of this Agreement.
3. You license to the Press exclusive world-wide rights in the Work to publish it in all forms, languages, and media now or hereafter known or developed, subject to the U.S. Government’s nonexclusive license as stated hereunder. Permissions for photocopying will be controlled by the Press either directly or through the Copyright Clearance Center, of which the Press is a member. Copyright of the Work will be credited in the name of the Smithsonian Institution, on behalf of Helene Landau-Muller, Smithsonian Tropical Research Institute.
4. Upon your request, the Press will grant you gratis a nonexclusive license to republish the Work in revised form in any language in a book written or edited by you after the Volume has been published. The Press will then inform you of the required wording of the copyright wording. The Press will not refuse your request for such republication unless it judges the proposed use of the Work to be direct competition with the Volume. The U.S. Government shall retain a nonexclusive license to publish all or parts of the Work solely for governmental purposes and distribution by or on behalf of the U.S. Government.
5. Upon publication of the Volume, the Press will send you one free copy of the paperback edition. You may purchase additional copies for your own use (but not for resale) by direct order to the Press at a 40% discount from the list price.
6. The Press hereby acknowledges receipt of the Work.
