%ताव करती है, उ धारा क अपे)ानुसार ऐसे सभी ,िय क जानकारी के िलए िजनके उससे भािवत होने क संभावना है, एत./ारा कािशत कये जाते है ; और एत./ारा यह सूचना दी जाती है क उ ाप िनयम पर भारत के

राजप1 म यथा कािशत इस अिधसूचना क ितयां जनता को उपल3ध कराए जाने वाली ितिथ से तीस दन क अविध क समाि5 के प6ात् िवचार कया जाएगा ; द

1.(1) इन िनयम का संि)5 नाम कटनाशी ( संशोधन) िनयम, 2019 है । (2) ये राजप1 म इनके अंितम काशन क तारीख से वृ होग ।

2. कटनाशी िनयम, 1971 (िजसे इसम इसके प6ात् उ िनयम कहा गया है) के, िनयम 18, के उपिनयम (1) म,

(क) खंड (ञ) म, श3द “पचA पर भी मुत है” के %थान पर “पचA पर एक %थान पर मुत” को ित%था्िपत कया जाएगा।

(ख) खंड (ट) म, “के 3यौरे” श3द का लोप कया जाएगा । (ग) खंड (ड) म,

(i) उपखंड (i) के %थान पर िनिलिखत उपखंड रखा जाएगा, अथाDत् :- “मौसम क सामायन ि%थथित”

(ii)उपखंड (ii) के %थान पर िनिलिखत उपखंड रखा जाएगा, अथाDत् :-

“ मृदा, जहां लागू हो”

(iii) उपखंड (vii) के %थान पर िनिलिखत उपखंड रखा जाएगा, अथाDत् :-

“ित हे:टेयर मा1ा (िजसके अंतगDत Eाम संFय संघटक िविनGमित और लीटर म तनुकरण भी है)”

(घ) खंड (प) म, श3द “के अनुसार” के प6ात् “ाथिमक पैक के िलए सुरि)त” श3द जोड़े कए जाएंगे ; 3. उ िनयम के, िनयम 19 म, उप-िनयम (1) के %थान पर िनिलिखत उप-िनयम रखा जाएगा, अथाDत् :- (1) (i) लेबल एक, दो या तीन पैनल का होगा और अयथा किथत के िसवाय केवल अंEेजी और Hहदी भाषाJ म मुत होगा । आKान के सLमुख क ओर लगा #आ एक और दो पैनल का यूनतम आकार एक सौ दस वगD सेNीमीटर से

अयून नहO होगा । तीन पैनल लेबल का यूनतम आकार एक सौ साठ वगD सटीमीटर से अयून नहO होगा । शुP अ,व/आयतन आधार पर तीन कार के लेबल होगे :-

(i) अित लघु पैकस - 1 Eाम/िम.िल से 50 Eाम/िम.िल (ii) लघु पैकस - 51 Eाम/िम.िल से 250 Eाम/िम.िल (iii) वृहद पैकस - > 250 Eाम/िम.िल

लेबल पर िनिलिखत जानकारी मुत होगी :-

(क) कटनाशी का नाम (Qांड नाम या ,ापार िचह का नाम िजसके अधीन कटनाशी िवFय कया जा रहा है) Qांड नाम साधारण नाम से बड़े साईज का नहO होना चािहए और अEभाग या पैनल )े1 के 20 ितशत से Sयादा नहO होना

चािहए । Qांड नाम बड़े अ)र म हो सकेगा । (ख) साधारण नाम ;

(ग) “उपयोग से पहले पढ़े” अनुदेश बड़े अ)र म तथा जहां िवFय कया जाना %तािवत है वहां क सभी

भाषाJ और मुख %थान म लेबल के शीषD पर िलखा जाएगा

(घ) फसल क सूची और नाशकजीव का ,ापक वगD िजस पर उपयोग के िलए वह रिज%Nीकृत है

(ङ) रसायन का योजन लेबल पर उिलिखत कया जाना चािहए, उदाहरण के िलए (i) कृिष उपयोग के िलए

(ii) नाशक जीव िनयं1ण संFयाJ के िलए (iii) घरेलू उपयोग के िलए

(iv) लोक %वा%Tय के िलए

(च) कटनाशी के Uयेक अनुयोग के प6ात् संभािवत पुनःयोग क अविध;

(i) लाल एवं पीला ि1कोणीय कटनाशी (अUयं◌ात जहरीला एवं बेहद जहरीला) : 48 घंटे

(ii) नीला एवं हरा ि1कोणीय कटनाशी (मXय म एवं कम जहरीला) : 24 घंटे

(iii) जैव-कटनाशी एवं हबDल: 12 घंटे

(iv) बीज-उपचार के िलए उपयोग कए गए कटनाशी के संबंध म पुन: योग क अवधी अपेि)त नहO है।

(छ) सुर)ा पूवD सावधािनयां

(i) लेबल और प1क पर जो वGणत है, उससे िभ^ फसल और नाशकजीव पर उपयोग के िलए नहO।

(ii) फसल-कटाई के उपरांत अनुयोग हेतु उपयोगी नहO।

(iii) प1क के िनद_शानुसार उपयोग के प6ात् आKान को न` कर ।

(iv) पोली हाउस और प<र] )े1 के िलए िनद_श और मा1ा –प1क पर देख।

(v) पंजीकरण सिमित ारा यथा अनुमोदत कोई अय चेतावनी या सचेतक कथन।

(ब) कंपनी का नाम, बारकोड, होलोEाम, :यू आर कोड, ई-मेल आई डी और Eाहक देखरेख सं[या

पंजीकरण सिमित ारा अनुमोदन के प6ात् लेबल पर अित<रि सूचना जोड़ी जा सकेगी।

यूनतम आकार के लेबल के संबंध म लेबल के नीचे क ओर एक वगD सटीमीटर से अयून आकार के सभी संबंिधत सुर)ा िच1 िलिप (तीसरी अनुसूची म िच1 1 म िनaद`) होगी । बड़े आकार के लेबल के संबंध म आनुपाितक बड़ी िच1 िलिप पैनल के दािहनी ओर नीचे क ओर होगी । वह लेबल म केवल एक बार मुत होगी। अित लघु और लघु लेबल के िलए

ाथिमक पैक पर िच1िलिप केवल ितीयक पैक पर मुत कया जाएगा।

1(ii) लेबल पर अंEेजी म सात पाbट (7) म अयून फ ट आकार ओर Hहदी तथा ादेिशक भाषाJ म सात पाbट (7) के फ ट आकार का उपयोग करते #ए %प` प से मुत होगी ।

(iii) (क) यद आKान या पैकेट या थैली छोटे, लघु अथवा अितलघु है, उUपाद कसी ितीयक पैक म पैक होगा िजस पर िनयम 19 के उपिनयम 1 म यथा अंतGव` िविहत आकार म लेबल मुत होगा ।

(iii)(ख) िवKमान रिज%Nीकरण के बड़े पैकस को ितीय पैक म उUपाद क प9कग के िलए भी चुना जा सकेगा िजस पर िनयम 19 के उपिनयम 1 म यथा अंतGव` िविहत आकार म लेबल मुत होगा ।

1(iv)(क) लघु थैली, पैकेट या आKानो (51 और 250 Eाम/ िम.िल. के बीच के आकार के िलए ) का उपयोग कए जाने क दशा म उह आगे ितीय पैक म पैक कया जाएगा। िनिलिखत 3यौरे ाथिमक पैक पर अंEेजी और Hहदी म अिमट

%याही ारा मुत कए जाएंगे और फ ट आकार पाइंट (5) से कम नहO होगा । साथ ही साथ ितीयक पैक पर Hहदी और अंEेजी म फ ट आकार सात पाbट से कम नहO (-) होगा ।

ारा मुत कए जाएंगे और फ ट आकार पांच पाइंट (5) से कम नहO होगा । साथ ही साथ दeतीय पैक पर Hहदी और अंEेजी

म फ ट आकार सात पाइंट (7) से कम नहO होगा ।

NOTIFICATION New Delhi, the 1st January, 2019

G.S.R. 10(E).—The following draft rules further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), is hereby published, as required by the said section, for information of all persons likely to be affected thereby;

and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Gazette of India are made available to the public;

The Objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period of thirty days will be considered by the Central Government;

Objections and suggestions in respect to the said draft rules may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Co-operation and Farmers Welfare, Krishi Bhawan, New Delhi-110 001.

DRAFT RULES

1. Short Title and Commencement. - (1) These rule may be called the Insecticides (Amendment) Rules, 2019.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Insecticides Rules, 1971 (hereinafter referred as the said rules) in rule 18, in sub rule (l),

(a) in clause (j) for the words “printed on the leaflet”, the words “ printed on one place on the leaflet”

shall be substituted.

(b) in clause (k), the word “detailed” shall be omitted.

(c) in clause (m),

(i) for sub-clause (i), the following sub-clause shall be substituted, namely:- “whether conditions in general”

(ii) for sub-clause (ii), the following sub-clause shall be substituted, namely:- “soil ,wherever applicable”

(iii) for sub-clause (vii), the following sub-clause shall be substituted, namely:- “ dosage per hectare (include gram active ingredient formulation and dilution in litres )”

(d) in clause (u), the words “secured to primary pack or” shall be inserted after the word “shall be”;

3. In the said rules, in rule 19, for sub-rule (1), the following sub-rule shall be substituted, namely:-

“ (1) (i) The label shall have either one, two or three panels and shall be printed only in English and Hindi languages unless stated otherwise. The minimum size of the one and the two panels label to be affixed on the face of the container shall be not less than 110 square centimetres. The minimum size of the three panel label shall not be less than 160 square centimetres.

There shall be three types of labels depending on the net content/volume:

(i) Ultra small packs-1g/ml to 50 g/ml (ii) Small packs-51 g/ml to 250 g/ml (iii) Big packs->250 g/ml

The following information shall be printed on the label:-

(a) name of insecticide (brand name or trade name under which the insecticide is sold). The brand name should not be of bigger size than the common name and it should occupy not more than 20% of area of the face or panel.

The brand name could be in BOLD (b) common name;

(c) instructions to “Read Leaflet Before Use”; in bold and in all languages where it is proposed for sale and to be placed on the top of the label in a prominent place

(d) list of crops and broad category of pests on which it is registered to apply;

(e) purpose of the chemical should be mentioned on the label, For example:- (i) For Agricultural Use

(ii) For Pest Control Operators (iii) For House Hold Use (iv) For Public Health”

(f) optimal re-entry period after each application of insecticide;

(i) Red and Yellow triangle insecticides (extremely toxic and highly toxic): 48 hrs.

(ii) Blue and green triangle insecticides (Moderately toxic and slightly toxic): 24 hrs.

(iii) Bio-insecticides and Herbal products: 12 hrs.

(iv) Re-entry period is not required with respect to insecticides used for seed treatment.

(i) Not to be used on crops and pests other than those mentioned on label and leaflets (ii) Not to be used for Post-Harvest Applications.

(iii) Destroy the container after use as directed on leaflet.

(iv) Directions and dosage for poly houses and confined area - Refer to the leaflet.

(v) Any other warning or cautionary statement as approved by Registration Committee (w). Company’s name, barcode, hologram, QR Code, e-mail id and customer care numbers.

Additional information can be added to the Label after approval by the Registration Committee.

All relevant safety pictograms (refer picture I in the THIRD SCHEDULE) of size not less than one square centimetre at the bottom of the label in respect of labels of minimum size. Pictograms shall be proportionately bigger in respect of labels of bigger size at the bottom of the right side panel. They shall be printed only once on the label. For ultra small and small labels the pictograms on the primary pack shall be printed only on the secondary pack

1(ii) The label shall be printed legibly using font size of not less than seven points (7) in English and seven points (7) and in Hindi unless stated otherwise.

1(iii) (a) If the container or packet or sachet is ultra small or small, the product should be packed in a secondary pack on which label of prescribed size as per contents of clause (i) of sub-rule (1) of rule 19 shall be printed.

(iii)(b) Bigger packs of existing registrations may also opt for packing the product in a secondary pack on which label of prescribed size as per contents of clause (i) of sub-rule (1) of rule 19 shall be printed.”

1(iv) (a) In case where small sachets, packets or containers (for sizes between 51 and 250 g/ml) are used shall be further packed in a secondary pack. The following details shall be printed with indelible ink on primary pack in English and Hindi and in the font size of not less than five points (5) as well as on the secondary pack in English and Hindi and in font size of not less than seven points (7) :-

(a) brand name (b) common name

(c) manufacturers name and address (d) imported and re-packed by (if applicable) (e) antidote

(f) registration number

(g) manufacturer’s license number (h) batch number

(i) manufacturing date (j) expiry date

(k) maximum retail price (MRP incl. of taxes, in rupees)

(l) net content

(m) customer care details and

(n) cautionary symbol as per the toxicity classification and cautionary words

(iv) (b) In case where ultra small sachets, packets or containers (for sizes between 1 and 50 g/ml) are used shall be further packed in a secondary pack. The following details shall be printed with indelible ink on the inner most pack in English only and in the font size of not less than five points (5) as well as on the secondary pack in English and Hindi and in font size of not less than seven points (7) :-

(a) brand name;

(b) common name;

(c) manufacturers name

(d) imported and re-packed by (if applicable);

(e) antidote

(f) registration number;

(g) manufacturer’s license number;

(h) batch number;

(i) manufacturing date;

(j) expiry date;

(k) net content ;

The secondary pack will have additional information printed like (l) maximum retail price (MRP incl. of taxes, in rupees) (m) customer care details; and

(n) Cautionary symbol as per the toxicity classification and cautionary words

1(v) The model labels (two panel and three panel) shall be as per the pictures II, III, IV & V given in the “ THIRD SCHEDULE ’’ .

(4) In the said rules, for the “Third Schedule” following shall be substituted namely:-
