NAME OF WORK: CONSTRUCTION OF CANTEEN WORK
1. The Security Deposit will be deducted @ 10% of each payment/ running payment made to contractor.
2. The security deposit amount shall be refunded only after the expiries of “Defects Liability Period” i.e. after 12 months of completion of work with satisfy report.
3. All building material/ fixtures required for the construction work, must be got tested and contractor has to submit the certificate for the same if required & got approved from the Govt. Engineering College authority prior to use. Any material not conforming to the specifications collected at site and defective work shall have to be removed by the contractor within a period of 24 hours of the instructions issued by the Govt. Engineering College authority. Failing which such material shall be removed by the college authority at risk and cost of the contractor after expiry of 24 hours period.
4. If prorata progress is not achieved then a part of work may be withdrawn from the contractor with a single notice of 7 days to get it executed from the other party & action shall be taken as per clause of agreement.
5. After completion of work, contractor has to clear the site as per direction of Govt.
Engineering College authority within 15 days. Otherwise same shall be done by department at contractor‟s cost without issuing any notice.
6. Construction program shall be submitted by the contractor within 5 days of issue of work order and get approved from the Govt. Engineering College authority.
7. Quantities of any item may be increased or decreased or deleted as per site condition and as per instruction of principal of Govt. Engineering College. Nothing can be claimed extra for such charges in the item and also in the variation of quantities. All the instruction/ specification issued by the Govt. Engineering College authority from the time to time regarding construction addition or alteration shall be binding for the contractor.
8. Proper Curing shall be done as per specification & as specified by the Govt. Engineering
College authority by the contractor at his own costs. All arrangement regarding this shall
be done by the contractor at his own cost, for which no extra payment shall be made. If not the same will be got done departmentally & recovery will be made from contractor.
9. All scaffolding shall be arranged by the contractor.
10. Any defective work shall have to be removed within 24 hours.
11. If any extra item executed in the tendered work, rate shall be applicable as per BSR P.W.D. Circle Ajmer-2012 above/below whatever is sanctioned in tender by Govt.
Engineering College, authority. For non-BSR item rate shall be given as per rate analysis sanctioned by Govt. Engineering College, Ajmer.
12. The Security Deposit of the work shall be paid to contractor after 12 months from the date of handing over the charge of work on completion to college and on the satisfactory report of work by the committee.
13. Watch & ward shall be carried out by the contractor at his own cost till the handing over of the said work to the client department.
14. Any price Escalation is not applicable under this contract agreement.
15. The contractor during the entire execution of work shall fully abide by the labour law PF law, as are applicable for any construction and shall also be responsible to enforce it during the entire period of construction.
16. The Authority will have the right to replace an order of any of the items in the „G‟
Schedule enclosed with the tender in full or in part & also reserves the right to reject all or any of the items in the tender without assigning any reasons.
17. In case of contradiction between special condition and general condition, the special condition will prevail.
18. Material/fittings, fixture will be used as per specifications mentioned in G-Schedule and shall be got approved before execution from Govt. Engineering College Authority.
19. If progress of work is not found satisfactory a penalty up to 10% shall be imposed on contractor/firm as decided by college authority.
20. The decision of college authority shall be final & binding to contractor in all cases.
