The PMA is responsible for the maintenance and monitoring of structures and equipment and other infrastructure, the security of all fixtures and fittings during the occurrence of the event. Conditional bids will not be considered and will be rejected outright. iv) EMD in respect of the successful PMA will be retained until the Performance Bond is deposited. Upon submission of performance bond and after signing the contract, EMD will be returned. The Performance Guarantee (PG) will be released upon completion of the work based on Completion Certificate issued by the Competent Authority stating that the PMA has completed the work satisfactorily in all respects.
The balancing work must be done independently without the risk and cost of the failed PMA. The technical bids will be opened on the date and time specified in the tender notice, in the presence of representatives of the bidders who wish to participate. Financial bids from the shortlisted applicants will then be opened at the date, time and place as indicated.
Financial bids from only those bidders declared technically qualified shall be publicly opened on the date and time fixed by the Ministry in the presence of the bidders' representatives who choose to participate.
FINANCIAL NEGOTIATIONS
The bidders who score at least 30 out of 70 points in the technical evaluation will be shortlisted and only their financial bids will be opened. The decision of DAC&FW will be final while shortlisting the bidding entities. The Bidder must not be directly or indirectly related to any employee of DAC&FW. At no stage has the Bidder been declared by DAC&FW as blacklisted/excluded/defaulter in making payments by DAC&FW.
PMA shall be fully responsible for following all labor welfare legislations in India and DAC&FW shall not be responsible for any default/violation of labor welfare legislation by the party. PMA shall be directly responsible for any/all disputes arising between it and its personnel/employees and shall indemnify DAC&FW for all losses, damages and claims arising therefrom. The PMA shall be solely responsible for the payment of wages/salaries/all applicable taxes and allow their predecessors to the personnel that are applicable under the laws in force including any new act or order of the Government which may be brought into force .
PMA will be fully responsible for theft, burglary, fire or any wrongdoing by its staff. All items and consumables used by PMA shall be of standard manufacture and approval of Designated Officer of DAC&FW shall be obtained for the same. DAC&FW reserves the right to award the work in whole or in part through one or more PMAs and to reject any or all bids without assigning any reason.
DAC&FW shall not permit any change in the composition of the PMA after submission of bid or later during execution. This would lead to disqualification of the application and further legal remedies for the future. i) All hangers/stands/equipment must be ready in proper working condition three (03) days before the event. ii) The quantity specified in the tender documents is in accordance with the scope of work as on date. iii). You can increase or decrease the amount before or during the event or as the case may be up to 25% without any change in rates. iv).
The Ministry is not obliged to accept the lowest bid or assign any reason for non-acceptance or rejection of a tender. The Ministry reserves the right to accept any tender in respect of all or any part of the work specified in the tender documents or to subdivide the work between different tenders or to reduce the work or to accept any tender for less than the bid without specifying the quality no reason.
DISPUTE RESOLUTION
The charges apply for the entire duration of the event from the date of participation until the end of the event (which includes the final settlement of accounts and submission of the final report). We undertake that, in case of acceptance of our offer, we will perform the services specified in the contract within the stipulated period, which begins to run from the date of receipt of the order submission notification. I agree to enter into a contract in the form notified by the Department, which shall include all agreements with such changes or additions as may be necessary to adapt such agreement to the circumstances of the standard and notice of submission within the time prescribed after notice of your intention, to accept this offer.
