YANG DIIMPORT KE DALAM MALAYSIA

PADA menjalankan kuasa yang diberikan oleh subseksyen 20(2) Akta Pelindung 2006 [Akta 657] dan peraturan 10 Peraturan-Peraturan Pelindung 2007 [P.U. (A) 386/2007], Kerajaan telah membuat penentuan awal negatif berhubung dengan penyiasatan perlindungan berkenaan dengan peningkatan import keluaran jubin lantai dan dinding seramik ke dalam Malaysia sebagaimana yang diperihalkan dalam perenggan 1 yang dikatakan telah menyebabkan kemudaratan yang serius kepada industri dalam negeri di Malaysia yang mengeluarkan keluaran serupa.
Keluaran yang disiasat
1. Keluaran yang disiasat adalah jubin lantai dan dinding seramik yang dikelaskan di bawah Kod Sistem yang Diharmonikan (“Kod H.S.”) dan Tatanama Tarif Berharmonis ASEAN (“AHTN”) 6907.21.21 00, 6907.21.23 00, 6907.21.91 00, 6907.21.93 00, 6907.22.11 00, 6907.22.13 00, 6907.22.91 00, 6907.22.93 00, 6907.23.11 00, 6907.23.13 00, 6907.23.91 00 dan 6907.23.93 00 (dalam notis ini disebut “keluaran”). Kod H.S. dan AHTN ini diberikan hanya untuk makluman dan tidak mempunyai kesan mengikat terhadap pengelasan keluaran itu.
Keluaran serupa
2. Keluaran serupa adalah keluaran yang dikeluarkan oleh industri dalam negeri di Malaysia yang sama atau serupa dengan keluaran sebagaimana yang diperihalkan dalam
perenggan 1.
Sebab bagi penentuan awal negatif
3. Sebab bagi penentuan awal negatif adalah seperti yang berikut:

(a) tiada peningkatan import keluaran dalam terma mutlak semasa tempoh penyiasatan;
(b) jumlah import keluaran dalam terma relatif kepada pengeluaran keluaran serupa dalam negeri di Malaysia tidak dapat dipastikan semasa tempoh penyiasatan; dan
(c) disebabkan kekurangan maklumat, penyiasatan tidak dapat memastikan kewujudan hubungan bersebab antara peningkatan import keluaran dengan kemudaratan yang serius kepada industri dalam negeri di Malaysia yang mengeluarkan keluaran serupa.
Penamatan penyiasatan
4. Berdasarkan sebab yang dinyatakan dalam perenggan 3, Kerajaan memutuskan untuk menamatkan penyiasatan perlindungan pada tarikh penyiaran notis ini.

SAFEGUARDS ACT 2006
NOTICE OF NEGATIVE PRELIMINARY DETERMINATION OF SAFEGUARD INVESTIGATION WITH REGARD TO CERAMIC FLOOR AND WALL TILES PRODUCTS
IMPORTED INTO MALAYSIA (SM 01/20)
IN exercise of the powers conferred by subsection 20(2) of the Safeguards Act 2006 [Act 657]
and regulation 10 of the Safeguards Regulations 2007 [P.U. (A) 386/2007], the Government has made a negative preliminary determination in relation to the safeguard investigation with regard to the increase in imports of ceramic floor and wall tiles products into Malaysia as described in paragraph 1 which was alleged to have caused serious injury to the domestic industry in Malaysia producing the like products.
Products under investigation
1. The products under investigation are ceramic floor and wall tiles classified under the Harmonised System Code (“H.S. Code”) and ASEAN Harmonised Tariff Nomenclature (“AHTN”) 6907.21.21 00, 6907.21.23 00, 6907.21.91 00, 6907.21.93 00, 6907.22.11 00, 6907.22.13 00, 6907.22.91 00, 6907.22.93 00, 6907.23.11 00, 6907.23.13 00, 6907.23.91 00 and 6907.23.93 00 (in this notice referred to as “products”). These H.S. Code and AHTN are given for information only and have no binding effect on the classification of the products.
Like products
2. The like products are products which are produced by the domestic industry in Malaysia which are identical or alike to the products as described in paragraph 1.
Reasons for negative preliminary determination
3. The reasons for the negative preliminary determination are as follows:
(a) there was no increase in imports of the products in absolute term during the period of investigation;

(b) import volume of the products in relative term to the domestic production of the like products in Malaysia could not be ascertained during the period of investigation; and
(c) due to lack of information, the investigation was unable to ascertain the existence of causal link between increase in imports of the products and the serious injury to the domestic industry in Malaysia producing the like products.
Termination of investigation
4. Based on the reasons specified in paragraph 3, the Government decides to terminate the safeguard investigation on the date of publication of this notice.
