GCC Clause
1.17 The Intended Completion Date is 4 months or 120 calendar days.
NOTE: The contract duration shall be reckoned from the start date and not from contract effectivity date.
1.22 The Procuring Entity is Kalinga State University, National Highway, Purok 6, Bulanao, Tabuk City, Kalinga.
1.23 The Procuring Entity’s Representative is:
Dr. Eduardo T. Bagtang University President Kalinga State University National Highway, Purok 6 Bulanao, Tabuk City, Kalinga.
1.24 The Site is located at Kalinga State University Main Campus, National Highway, Purok 6, Bulanao, Tabuk City, Kalinga and is defined in drawings No. [Insert Number].
1.28 The Start Date shall be the date of receipt of the Notice to Proceed.
1.31 The Works consist of Design and Construction of Two Units Potable Water System at KSU Bulanao Campus, consisting of the following:
(i) To come up with a Water Resource Plan for the Design and Construction of Two Units Potable Water System at KSU Bulanao Campus;
(ii) To conduct sub-surface water exploration for the most feasible location of the underground source for the two units potable water system;
(iii) To provide signed and sealed report and calculations relative to the subsurface water exploration;
(iv) To provide signed and sealed structural analysis, structural details, drawings, plans and specifications relative to the construction of two units potable water system;
(v) To provide a detailed cost estimates of the construction of two units potable water system;
(vi) To integrate Solar panel system or windmill as a form of an alternative electrification for the operation of this proposed two units potable water system; and
(vii) To construct two units of Potable Water System in Bulanao Campus providing an uninterrupted quantity flow of water, adequate water pressure, a quality of water, free from objectionable taste, turbidity, odor or chemical detriments and water that is bacteriological safe for drinking which is readily accessible to end users of the Kalinga State University.
2.2 Not Applicable/ No sectional completion of Works.
5.1 The Procuring Entity shall give possession of all parts of the Site to the Contractor upon receipt of the Notice to Proceed.
6.5 The Contractor shall employ the following Key Personnel:

NOTE: The names of the Key Personnel and their designation shall be filled out by winning contractor prior to contract signing.
7.4(c) The Performance security shall cover the period from the time of the signing of the contract until the final acceptance of the project by the government wherein the warranty period as prescribed in Sec. 62.2.2 of the IRR of RA 9184 shall have commenced. For this reason, the coverage of the performance security shall include the defects liability period of one (1) year and shall be due for release only after the Certificate of Final Acceptance is issued by the procuring entity.

10 The site investigation reports are:
There is no available Site Investigation Report. The Bidder shall conduct a site visit prior to the preparation of his bid.

12.5 In case of permanent structures, such as buildings of types 4 and 5 as classified under the National Building Code of the Philippines and other structures made of steel, iron, or concrete which comply with relevant structural codes (e.g., DPWH Standard Specifications), such as, but not limited to, steel/concrete bridges, flyovers, aircraft movement areas, ports, dams, tunnels, filtration and treatment plants, sewerage systems, power plants, transmission and communication towers, railway system, and other similar permanent structures: Fifteen (15) years.
13 If the Contractor is a joint venture, “All partners to the joint venture shall be jointly and severally liable to the Procuring Entity.”

21.2 The Arbiter is: THE PROPER COURT IN THE PROVINCE OF KALINGA, or the Construction Industry Arbitration Commission.
29.1 Day works are applicable at the rate shown in the Contractor’s original Bid.
31.1 The Contractor shall submit the Program of Work to the Procuring Entity’s Representative within Fourteen (14) calendar days of delivery of the Notice of Award.
31.3 The period between Program of Work updates is Seven (7) calendar days days.
The amount to be withheld for late submission of an updated Program of Work is at least equal to one-tenth of one percent (0.001) of the actual cost of contract for every day of delay.
34.3 The Funding Source is the Government of the Philippines, through the GAA Capital Outlay CY 2017.
39.1 The amount of the advance payment is equivalent to fifteen percent (15%) of the Total Contract Price to be paid in lump by the KSU.

51.1 The date by which operating and maintenance manuals are required is Seven calendar days.
The date by which “as built” drawings are required is upon approval of the Variation Orders.
51.2 The amount to be withheld for failing to produce “as built” drawings and/or operating and maintenance manuals by the date required is at least equal to one-tenth of one percent (0.001) of the actual cost of contract for every day of delay.
