T ERMS OF R EFERENCE

Act 11396, for the upgrading and road mapping of its physical and academic facilities that will elevate its status as a leading university in the region and in the country.

Likewise, this project provides the ideal opportunity to incorporate physical and academic strategies and measures to transform the campuses to be more resilient and resistant to address the pandemic crises of the future, due to the onset of the COVID- 19.

2. PROJECT OBJECTIVES

As part of the its effort to come up with Master Development Plans or Land Use Development and Infrastructure Plans, PROCURING ENTITY intends to procure and engage the services of a Consultant that will conduct a review of all past and current development plans and documents of the PROCURING ENTITY and come up with the following plans and documents integrated into the LUDIP as required by Republic Act 11396 to wit:

2.1 Campus planning framework, principles and processes, including master development plans;

2.2 Inventory of all existing buildings, facilities, and other infrastructure within the compound or areas occupied by the SUCs and other real estate assets;

2.3 Facilitate the Transfer Certificate of Title and subsequent renaming for the Four (4) Campuses.

2.4 Detailed description of the research core, academic core, residential areas covering both housing for faculty and staff, dormitories for students, and detailed geographical description and survey of the site intended for dormitories for students and housing sites for employees of the SUCs, including the architectural design and estimated cost of construction;

2.5 Detailed geographical description of land used for commercial, agriculture, fishery, forestry, and other activities, including open and recreational spaces, landscape features, and campus transportation system, among others;

2.6 Design and estimated cost of construction, operation, maintenance of other infrastructure needs of the SUCs; and

2.7 Financial plan for master plan implementation which shall include an investment program containing list of programs and projects and funding sources whether from internally generated income and revenues, loans, public-private partnerships, and other financial schemes or arrangements.

3. PROJECT AREAS

The project areas will be the four (4) campuses of BPSU which are the Main Campus (66,964 SQ.M.) and Balanga Campus (11,820.00 SQ.M.) in Balanga City, Orani Campus (19,956 SQ.M. and 60,016 SQ.M.) and Dinalupihan Campus (19,162 SQ.M.), all located in the province of Bataan. In addition, the 27-hectare fishpond of

BPSU located in Orani, Bataan will also have a LUDIP or Master Development Plan of its own.

4. GENERAL INFORMATION

4.1 Applicable Laws. All laws governing the operation and implementation of this TOR shall be deemed to be those of the Government of the Republic of the Philippines, Republic Act 9184 and its Implementing Rules and Regulations and its amendments, to the extent applicable.

4.2 The Approved Budget of the Contract for this particular project is Six Million Pesos (Php 6,000,000.00).

4.3 The BAC shall draw up the shortlist of the consultants from those who have submitted eligibility documents/expression of interest and have determined as eligible in accordance with the provisions of Republic Act 9184 (RA 9184), otherwise known as the “Government Procurement Reform Act” and its implementing rules and regulations (IRR). The short list shall consist of five prospective bidders who will be entitled to submit bids or should only one (1) or less than the required number apply for eligibility and short listing, p ass the eligibility check, and/or pass the minimum score required in the short listing, the BAC shall consider the same.

The criteria and rating system for short listing are:

a) The overall experiences of the firm will be considered for both joint ventures and existing firms (45%);

b) Qualification of personnel who may be assigned to the job vi-a-vis extent and complexity of understanding (45%); and

c) Current workload relative to capacity, (10%).

4.4 The Procuring Entity shall evaluate bids using the Quality Based Evaluation (QBE) procedure using the following criteria:

b) Project Team composition – 35%

1 – Team Leader/Regional Planner, 1 – Physical Planner and Architect, 1 – Infrastructure Specialist/Engineer 1 – GIS and CAD Specialist, and 1 – Finance Specialist

Note: All must be licensed or registered in their own profession from a Government Regulatory Board and Government recognized umbrella organization of Consultants.

c) Description of procedures in conducting the design process and planning methodology for Master Development Plan (i.e. the team should have a pool of trained Technical/Managerial expertise) – 25%

d) Adequacy of quality assurance mechanism in the conduct of operations – 10%

4.5 Due Diligence. Each interested proponent shall be solely responsible for its own due diligence of all matters relating to this TOR which may, in any matter, affect the content and/or nature of the interested proponent’s proposal. The Procuring Entity shall not be responsible for any erroneous interpretation or conclusion made by the interested proponent out of the data furnished or indicated in this TOR and proposal forms, including addenda or amendments issued by the PROCURING ENTITY-BAC, if any. Failure on the part of the interested proponent to so examine and inform itself of any or all matters related to this Tor shall be at its sole risk and no relief for error or omission shall be given.

4.6 The interested proponent shall carefully examine and understand all information provided by this TOR and additional information provided during pre-bid conferences to allow the interested proponent to make a competitive proposal. The interested proponent, by the act of submitting its proposal, acknowledges that it fully understands all conditions and information pertaining to the item for bid.

4.7 No verbal agreement or conversation with, or any verbal clarification from, any officer or employee of Procuring Entity, the PROCURING ENTITY-BAC or any of their advisers/consultants shall affect or modify any of the terms and conditions contained in this TOR. Only amendments, supplements or clarifications to this TOR that are set down in writing and circulated as Proposal Bulletins to interested proponents by the PROCURING ENTITY-BAC shall be relied upon as authorized. Neither the Procuring Entity, the PROCURING ENTITY-BAC nor any of their advisers/consultants may make any representation or warranty concerning any matter affecting this request for Proposals except for the representations and warranties of the Procuring Entity that shall be set out in the document of this RFP.

4.8 The interested proponents shall be responsible for having taken steps to carefully examine this TOR, including its attachments, and deemed to have become familiar with all existing laws, decrees, ordinances, acts, rules and regulations which may affect this TOR.

5.0 PROJECT SCOPES OF WORK, DURATION AND DELIVERABLES

The project must be completed within Two Hundred Forty (240) calendar days. The scope of services of the engagement shall include the following:

7.0 TEAM DUTIES AND RESPONSIBILITIES

Technical/Managerial Staff

Duties and Responsibilities 7.1 Team Leader/Regional

Planner

Provide overall supervision of technical and administrative work of all team members as well as guide the general direction and focus of the master development planning process given the general and specific policy thrust and physical characteristics of the project area in relation to the university and the host communities.

7.2 Physical

Planner/Architect

Undertake land utilization and site analysis and formulate a future land use framework plan based on the academic mission and the physical environment consistent with the best and highest use principle and recommend physical planning guidelines to achieve this purpose.

7.3 Finance Specialist Undertake an analysis of the strategic development program and budgets and recommend an estimate of financial resources needed to implement site development program including general policy for alternative modes of revenue generation.

7.4 GIS/CAD Specialist Prepare site maps for the existing land utilization and future land allocation as contained in the Master Development Plan in accordance with technical references and coordinates of the project areas as well as review existing maps and submit recommendations on future mapping activities.

7.5 Institutional Specialist Undertake an analysis of the existing organizational structures in the management of the campus property in relation to the university administration as well as look into the organizational arrangements for the presence and location of private sector entities and informal settlers in the project area and submit recommendations for their rationalization.

7.6 Infrastructure Specialist/Engineer

Undertake an analysis of the existing buildings, infrastructure and utilities in the project area and evaluate sufficiency and conditions in relation to accepted standards and formulate recommendations on road network, utilities and circulation based on demands and in support of the master development plan.

8.0 ENGAGEMENT FEE

8.1 Financial proposals shall not exceed the amount of Pesos: Six Million Pesos (PhP6,000,000.00) and shall be deemed to include the cost of professional fees and all taxes,

8.2 Transportation, meals, accommodations and all other charges, if any, shall be for the account of the Procuring Entity.

8.3 Payment of the total price quoted shall be made in five (5) installments upon completion of each of the following milestones and submission of the required deliverables, to wit:
