PACKAGING: The SUPPLIER must provide such packaginE of

the

goods as is required to prevent their damage or deterioration dur"ing transit to their final destination, as indicated in the contract and in accordance

with

existing industny standards.

3"

\TARRANTY:

A warranty shall be

required

from the

SUPPLIER

in

order

to

assure

that

defects either patent or iatent shali be corrected by

the

latter.

The obligation

for

the warranty shall be covered by

either

netention money in an amount

*quivalent to at

ieast

one

percent

(1%) of every

progress payment,

or a

special bank guarantee equivalent

to at

least one percent (1o/o) of the

totai

contract price at the cption of the SUPPLIER"

The said amounts shall

only

be released

after the

lapse

of the warranty

period

or

in the case of Expendable Supplies, after consurnpti*n anci in case of Non-Expendable, after one {1} year from the delive ry thereof. Provided, however,

that

the supplies delivered are fi'ee from patent and latent defects ancl all the conditions imposed under the contract have been

fully

met.

4. If the

goods

or

equipment furnished found

to

h'e defective during

the

warranty period as when they are unfit or cannot be utilized for the use for which

it

is intended, the SUPPLIER

shall immediately repair

or

replace the same which shall not be later than seven

(7)

days

from the notice or as requlred.

Otherwise,

the INTITY can undertake the repair

or replacement of the defective goods but at the SUPPLIER.'s expense which can be deducted

to

any acc$unts payable of

the

iatter.

However,

this provision shall not apply to ordinary wear and tear of the goods

or equipment.

5.

The

$UFPLIER

represents and warrants

that it

has

all the

necessary

permits,

licenses,

registrations and all other government requirements relative to the

manufacture, praduction or supply nf the goods

cr

serviees.

6.

SpARE

PAkTS is

referred

to

as

an extre c*rEp*nent,

equipment,

tools,

inctruments or parts of rnachinery or apparatus

that

repiace the ones

that *re

damaged or worn out. The SUFFLIER

is

required

to

provide

any or all sf the

following materials, notifieations, and information Bertaining

to

spare parts manufaetured or distributed hy the Supplier:

1.

Such

spare parts as the

Procuring

Entity may *lect t+

purchase

frtm the

supplier, provided

that

this election shall not reliev* the supplier of any

warrailty

obligations under the contract;

2. Such spare parts that the

Procuring

Entity may be able ta

purchase

from

other suppliers/manufacturers but are cornpatible with the goods procured; and

3.

In

the event of termination of production of the spare parts:

a. Advance notification

to the

Procuring Entity of

the

pending termination, in sufficient tirne

to

permit

the

Procuring Entity

to

procure needed requirernents; and

b.

Following

such termination, furnishing at no cost to the

Prccuring

Hntity

the blueprints, drawings, and specifications of the spare parts,

if

requested.

The supplier is likewise required

to

issue a Certification

that

spare parts, particularly those

that are

product-specific, shall continue

to

be manuf*ctured by

them within a

period of time of three

years from the date of complete delivery.

ARTICLE

3,

RIG}ITS AND OBLIGATIONS OF THE EHTITY
