The Bidding Documents shall, among other things, clearly and adequately define: (i) the objectives, scope and expected outputs and/or results of the proposed contract; (ii) the participation requirements of Bidders; (iii) the expected contract duration; and (iv) the obligations, duties and/or functions of the winning bidder. Where repetition of a subject is unavoidable in other parts of the document prepared by the contracting authority, care should be taken to avoid contradictions between clauses dealing with the same issue. Specific details, such as the “name of the procuring entity” and “address for submitting bids”, must be provided in the Instructions for Bidders, the Bidding Data Sheet and the Special Contract Conditions.
The cover should be modified as required to identify the Tender Documents in relation to the names of the Project, Contract and Procuring Entity, in addition to the date of issue. For guidance on the use of tender forms and the procurement of externally assisted projects, these will be covered by a separate publication of the Government Procurement Policy Board. If the Contractor does not provide the drawings and/or manuals by the dates mentioned above, or they do not receive the approval of the Representative of the Procuring Entity, the Representative of the Procuring Entity may withhold the amount stated in the KVK from the payments due to the Contractor. NOTE: The duration of the contract will be calculated from the start date and not from the effective date of the contract.
