Except as otherwise specified in the BDS, the Bidder may subcontract portions of the Goods to the extent that may be approved by BULACAN STATE UNIVERSITY and declared in the BDS. In the event that any subcontractor is found by BULACAN STATE UNIVERSITY to be unsuitable, subcontracting of such portion of the Goods is not permitted.
Clarification and Amendment of Bidding Documents
The tenderer is expected to be aware of the changes and/or additions to the tender documentation discussed at the pre-tender conference. No statement at the pre-tender conference may change the terms of the tender documents, unless such statement is specifically marked in writing as a change thereof and issued as a supplement/tender bulletin.

The ranking of the total bid prices as calculated from low to high. The determination will be based on an examination of the documentary evidence of Bidder's qualifications submitted in accordance with ITB provisions 12 and 13, as well as other information that BULACAN STATE UNIVERSITY deems necessary and appropriate, using a non-discretionary “pass /wrong" . If the BAC determines that the bidder with the lowest calculated bid meets all post-qualification criteria, it will declare the said bid as the lowest calculated responsive bid and recommend to the Head of BULACAN STATE UNIVERSITY to award the contract to the said Bidder at the offered price or the calculated bid price, whichever is lower.
A negative determination will result in the rejection of the Bidder's Bid, in which case BULACAN STATE UNIVERSITY will proceed to the next Lowest Calculated Bid to make a similar determination of that Bidder's ability to perform satisfactorily. Within a period of not more than seven (7) calendar days from the date of receipt of the recommendation from the BAK, the Head of the BULACAN STATE UNIVERSITY shall approve or disapprove the said recommendation. If the physical and economic conditions have changed significantly to make the project no longer economically, financially or technically feasible as determined by the head of the BULACAN STATE UNIVERSITY;. ii).
If the project is no longer necessary as determined by the head of the BULACAN STATE UNIVERSITY; and. iii). If the source of funds for the project has been withheld or reduced through no fault of the BULACAN STATE UNIVERSITY.
Award of Contract 31. Contract Award
Signing of the Contract
At the same time that BULACAN STATE UNIVERSITY notifies the successful bidder that its bid has been accepted, BULACAN STATE UNIVERSITY will send the contract form to the bidder, which contract is provided in the bidding documents, which contain all agreements between the parties. . Within ten (10) calendar days of receipt of the notice of award, the successful bidder shall post the required performance bond, sign and date the contract and return it to BULACAN STATE UNIVERSITY. BULACAN STATE UNIVERSITY will enter into a contract with the successful Bidder within the same period of ten (10) calendar days, provided all documentation requirements are met.
Performance Security
Notice to Proceed
The effective date of the contract shall be stated in the BULACAN STATE UNIVERSITY Notice to Proceed, which date shall be not later than seven (7) calendar days from the issuance of the Notice to Proceed.
Protest Mechanism

The performance security will remain valid until the Certificate of Final Acceptance is issued by the BULACAN STATE UNIVERSITY. The performance security may be released by the BULACAN STATE UNIVERSITY and returned to the Supplier upon the issuance of the Certificate of Final Acceptance subject to the following conditions:. The BULACAN STATE UNIVERSITY will promptly notify the Supplier in writing of the identity of any representatives retained for these purposes.
Delivery of the goods and/or performance of services shall be made by the supplier in accordance with the schedule prescribed by BULACAN STATE UNIVERSITY in Section VI. BULACAN STATE UNIVERSITY shall terminate this contract for breach when any of the following conditions accompany its implementation:. Before recovery can be made, the loss must be established under oath by the supplier to the satisfaction of BULACAN STATE UNIVERSITY before recovery can take place.
All decisions recommended by the CTRC must be approved by the Head of BULACAN STATE UNIVERSITY; and. h). The supplier will deliver the goods in accordance with the conditions set out in sec. The Goods remain at the risk and title of the Supplier until their final acceptance by the Bulacan State University.
Scope of Work / Technical Specifications
