A BAC RESOLUTION DECLARING TWO FAILED BIDDINGS AND RECOMMENDING _FOR NEGOTIATED PROCUREMENT

RESOLUTION NO. 270, S. 2017 (CIVIL

WHEREAS,

in

compliance

with the

provisions

of

RA 9184,

the

Kalinga State University ^(KSU) published in the PhiIGEPS website

the

lnvitation to Bid ^(lB)for the conduct of public bidding for Design and Build Construction of 2 Units Potable Water Systems at Bulanao Campus ^(Ref.No.264004010100018)

with

an Approved Budget for the Contract ^(ABC)amounting _{to Two}Million, Nine Hundred Twelve Thousand, Six Hundred Twenty-

one

Philippine Pesos (Php2,9'12,621.00) and posted the same at the KSU website

(lrgg4ksg€lgph),

and conspicuous place at the premises of the University continuously for seven days;

WHEREAS, in response to the said advertisement, neither bidders came during February 17,2017 Pre-bid Conference nor submitted their proposals on March 1 ,2011 Receipt and Opening of Bids, and the BAC declared a failure of bidding pursuant to Section 35.1(a) of the Revised IRR of RA 91g4;

WHEREAS, upon request of the BAC, the TWG revised the terms, conditions and specifications in the Bidding Documents to attract prospective bidders;

WHEREAS, an lnvitation to Bid for Design and Construction of tr,rro units potable Water System at Bulanao Campus

with

the same ABC was re-adveftised at the required sites on March 4-27,2017 which

was

responded

by three

(3) contractors, namely: Jep Construction_March

g,20]7,

_Hanging_Stone

Construction-March 10,2017, _andPG Velasco Construction-March 12,2017

through the

Document Request List ^(DRL)of PhilGEpS;

WHEREAS,

during the

Pre-bid Conference conducted

on March

15, 2012,

the

Area ^project supervisor of PG Velasco construction came and inquired regarding the

projec!

WHEREAS,

on

March

27,2017

Receipt and Opening

of

Bids,

no

one among

the

bidders has

submited

its proposals;

WHEREAS, based on the

two

unsuccessful biddings conducted and upon request of the BAC, the TWG, Secretariat and end-user recommended the following terms, conditions and specifications:

1-

The BAC should resort to Negotiated Procurement through Two-Failed Biddings modaliry as

provided by Section 53.1 of the IRR of RA 9184 to fast-tracr the implementation of the project.

2-

That design and construction

ABC be increased to at leasttwenty percent (2Wo). The 2@6 increase in ABC shall coverthe consulting services for the fol lowi ng :

^WaterResource Plan Design.

b.

^Conduct^ofsub-surfacewater exploration to establish the most feasible underground source and locations.

c.

^Provisionof signed and sealed report and calculations relative to the subsurface water exploration.

d.

^Provisionof signed and sealed structural analysis, structural details, drawings, ^plans and specifications.

e.

^Provisionof detailed cost estimates.

Depending on budget allocations, l(SU may possibly integrate Solar panel system or windmill

as a form of alternative electrification for the operation of this proposed

two

units potable water system.

Whether

with the

design and construction

this water system

jointly

separately, the ^BACshall invite at ^leastthree ⁽³⁾contractors or consultants, including those contractors appeared in the DRL of PhiIGEPS, for negotiations to ensure effective competition.

Bids and Awards Committee, exercising prudence, good faith and transparency, after duly considering

the

recommendation of the TWG, Secretariat and end-user, hereby RESOLVE AS lT lS HEREBY RESOLVED:

to

declare

a

second failure

of

biddings

for the

Design

and

Construction

of two

units Potable Water System at Bulanao Campus considering that there were

no

prospective bidders

who

submitted their bids after

two

publications pursuant

to

Section 35.1(a)

of

the Revised IRR of ^RA9184;

to recommend a Negotiated Procurement

FATLED BIDDINGS as provided

by sedion

53.1 of the 2016 IRR of R.A. 9184

for

the above-mentioned project; and

to

recommend

for

approval

by the

President

of

the Kalinga State University

of the

foregoing _findings.
