The interview processes have accordingly been conducted through the applicable labour legislation, i.e. involvement of organized labour.

Necessary arrangements and agreements in relation to the existing and viable Local labour Forum have also been considered and upheld throughout the interviewing processes.

1.4.Temporarily- employed Staff

During the said municipal financial year, it could be established that there are 68 (sixty eight) temporary employees in various departments within this Municipality of whom the majority emanates from the Community Services Department’s Parks and Cemetery Section.

During the Municipal Budget preparatory process, a provision for the appointment of the affected employees (temporary) with intent to place them on permanence was made viz, 2007/2008 financial year.

1.5. Relocation of staff

Due to work operational requirements, restructuring and other inevitable work-related necessities, some employees happened

to be relocated from one work station to the other, within the municipal jurisdiction.

No officially sanctioned reimbursement has occurred.

However, upon the transfer of some three officials (Mr. S.J.

Mugovhoro, Mr.M.J.Mokobi and Mr.M.W. Malema) from the Elandskraal satellite office to Marble Hall office; whereupon each was paid R6000.00 through unauthorized means by a senior official within the municipality, a dispute ensued.

Organized labour (Imatu and Samwu) demanded that same be applicable to other affected officials. The matter is still being dealt with by the two parties (Municipality Management and Organized labour).

1.6.Employees Cases

Disciplinary hearings were conducted against the following officials during the said period:

1.7. Arbitration

Ms.S.J. Molala vs. Greater Marble Hall Municipality

During the said period, one of the temporary employees, Ms.J.T.

Molala (a temporary secretary to the Unit Manager for Technical department) has lodged a matter with the CCMA, after the appointment of a secretary other than herself.

She asserted that she was the most suitable and qualified

candidate for the post and that the appointed incumbent did not meet the minimum requirements for the post.

Case number LPD 060616 was subsequently registered with the CCMA.

The Arbitrator for the same case was Mr. Maake.The final award in this regard was in favour of the Greater marble Hall

Municipality.

Ms.J.T. Molala’s allegations were ruled unfounded and that proper procedures have been followed by the municipality up to the level of final appointment.
