EdITORIAL
the South African Yearbook of International Law (SAYIL) is an annual publication, published by Juta Publishers and administered by the Department of Public, constitutional and international law at the university of South Africa.
As a Yearbook, SAYIL is, by definition, published retrospectively.
in other words, the volume for a particular year is published only the following year. for this reason, the current 2017 volume (volume 42) is published in 2018.
the Yearbook publishes contributions in english in any area of international law. we encourage articles and notes on current issues and those that look back on developments that took place during the year of the volume. Although we publish articles in any area of international law, the editors particularly welcome submissions that have a South African or broader African relevance. A style guide appears at the back of this volume.
Submissions are accepted in the following categories:
• Articles of 9 000 to 12 000 words;
• Notes of 6 000 to 9 000 words;
• Judicial Decisions (case notes) of 4 000 to 9 000 words; and
• Book Reviews of 1 500 to 4 000 words.
the word counts indicated above serve as a guideline only. the editors reserve the right to make the final determination whether a particular submission is published as an article or a note. in making this determination the word count of the submission is taken into account, but is not necessarily decisive. Authors affiliated to South African institutions must take note that book reviews will not attract subsidy from the Department of higher education and training (Dhet).

upon the submission of a manuscript, the author(s) must give an express assurance that the manuscript has not – in whole or in part or in substance – been published or offered for publication elsewhere.
the editors reserve the right to make the changes they consider necessary or desirable in order to bring the manuscript in line with the house style of SAYIL; to correct spelling and language mistakes;
to eliminate ambiguity, illogicality, tautology, circumlocution and redundancy; to produce or improve accuracy and coherence; and to avoid possible criminal or civil liability.
it is the author or authors’ sole responsibility to ensure that before submitting a manuscript for publication:

• The manuscript is properly edited for spelling, punctuation, syntactical and other mistakes or omissions;
• all third-party material has been properly acknowledged and accurately referenced;
• the formatting and references in the submission comply strictly with the house style of SAYIL, which appears at the back of every volume; and
• the contribution made by others in the production of the manuscript is properly acknowledged.
Manuscripts that do not accord with the house style of SAYIL will be returned to authors immediately.
to ensure quality, submissions are subject to double-blind peer review. we wish to particularly thank those individuals who have given their time to peer review the articles published in the current volume.
