DIRECTIONS DATED 09 MAY 2011

The Chief Justice has issued the following directions in this matter:

1. The appeal against the judgment of the Supreme Court of Appeal of 22 February 2011 is set down for hearing on Thursday 4 August 2011 at 10h00.

2. The record, properly paginated and indexed, must be prepared by the applicant and lodged on or before Friday 24 June 2011.

3. The record shall consist, without duplication, only of those portions of the record relating to the hearing before the High Court, Supreme Court of Appeal and papers filed in this Court that are necessary for the determination of the appeal.

4. In addition, the applicants are required, not later than ten days before this hearing, to

(a) lodge one copy of a supplementary volume to the record, consisting of all documents filed in this Court which do not form part of the record already lodged, but not including the parties’ written argument;

(b) number these documents consecutively beginning with the page immediately after the last page of the record already lodged; and

(c) provide an updated index which includes the supplementary volume(s).

5. Written argument on the merits of the appeal, must be lodged by—

(a) the applicants on or before Tuesday 5 July 2011; and (b) the respondents on or before Tuesday 12 July 2011.

6. Not later than 5 July 2011 the parties are directed to lodge a statement of agreed facts that are necessary for this Court’s determination of the appeal.

Should the parties fail to agree, each party is directed to lodge –

(a) a statement of the facts the party considers necessary for the determination of the appeal, indicating which facts are common cause and which are disputed;

(b) the portions of the record evidencing the fact or facts in issue;

(c) the reasons why the party contends the fact has been established.

7. Further directions may be issued in due course.
