Bidders must submit, as part of their bid documents, supporting documentation for all functional requirements as indicated below. The Bid Evaluation Committee (BEC) responsible for scoring the respective bids will evaluate and score all bids based on their submissions and the information provided. The value scored for each criterion is multiplied by the specified weighting for that criterion to obtain the points scored for each criterion.

These points will be added and expressed as a fraction of the best possible score for all criteria. Functionality will be evaluated based on the supporting documentation provided by the bidders in accordance with the below functionality criteria and values. At the first stage, bids will be evaluated on functionality, at the second stage will be the presentation and testing of technical compliance, while at the third stage, evaluation will be done in accordance with 80/20 preference points system as detailed below.

4General Conditions of Contract

1.12 "Force Majeure" means an event beyond the Supplier's control and which is not the fault or negligence of the Supplier and is not foreseeable. 1.13 "Fraudulent Practice" means misrepresentation to influence a tendering process or the performance of a contract to the detriment of a tenderer, and includes collusive practices between tenderers (before or after submission of a bid) to fix bid prices at artificially non-competitive levels and to deprive the bidder of the benefits of free and open competition. 1.15 "Goods" means any equipment, machinery and/or other materials which the supplier is required to supply to the buyer under the contract.

1.16 “Imported content” means that part of the bid price represented by the cost of components, parts or materials which have been or will be imported (whether by the supplier or its subcontractors) and which costs include the costs abroad, plus freight - and other direct import costs such as landing costs, dock fees, import duty, sales tax or other similar tax or levy at the South African place of entry as well as transport and handling costs to the factory in the Republic where the supplies covered by the bid will be manufactured . 1.17 “Local content” means that part of the bid price which is not included in the imported content, provided local manufacturing does take place. 1.18 "Manufacturing" means the production of products in a factory using labour, materials, components and machinery and includes other related value adding activities.

1.19 "Order" means an official written order issued for the supply of goods or works or the rendering of a service. 1.24 “Services” means those functional services ancillary to the supply of the goods, such as transport and any other incidental services, such as installation, commissioning, provision of technical assistance, training, catering, gardening, security, maintenance and the like.

Such rejected stocks will be held at the expense and risk of the supplier, who will promptly remove them at its own expense upon call-off and immediately replace them with stocks that do meet the requirements of the contract. If the supplier does not deliver the replacement supplies immediately, the buyer may, without giving the supplier any further opportunity to replace the refused supplies, purchase the necessary supplies at the supplier's expense. The details of shipment and/or other documents to be provided by the supplier are specified in SCC.

The supplier further warrants that all goods supplied under this contract will be free from any defect arising from design, material or workmanship (except when the design and/or material is required by the buyer's specifications) or from any act or omission of the supplier, which may develop under normal use of the delivered goods in the conditions prevailing in the country of final destination. Such notice, in the original bid or later, shall not relieve the supplier of any liability or obligation under the contract. As soon as practicable after receiving the supplier's notice, the buyer will evaluate the situation and the supplier may, at its discretion, extend the supplier's time for performance, with or without the imposition of penalties, in which case the extension will be ratified by the parties by amendment will be of contract.

If the supplier does not respond within the specified fourteen (14) days, the buyer may consider the intended penalty as unopposed and may impose it on the supplier. Unless otherwise ordered by the buyer in writing, the supplier shall continue to perform its obligations under the contract to the extent reasonably practicable and shall seek all reasonable alternative means of performance not prevented by the force majeure event.
