53. (1) Offences. Any person who contravenes or fails to corl1ply with any provision of these Regulations shall be guilty of an offence.

(2) Where any person under the authority of these Regulations directs anything to be done or forbids anything to be done by another person then if that other person fails to do the thing directed to be done or, as the case may be, does the thing forbidden to be done, that other person shall be guilty of an offence against these Regulations.

(3) General Penalty. Any person guilty of an offence against any provision of these Regulations shall be liable to a penalty not exceeding two hundred dollars.

(4) Daily Penalty. Any person who, being convicted of an offence against these Regulations that consists of a contravention or failure to comply of such a nature that it may be committed from day to day, thereafter continues that offence, may be prosecuted from time to time for an offence against these Regulations that consists of the same contravention or failure to comply and is liable to a penalty of ten dollars for each day during which it is continued as from the date on which he was last convicted thereof until the date on which he is convicted or on which the default is rectified, whichever date is the earlier.

104 Regs. 54-56 REGULATIONS PART IX-GENERAL

54. Authority to enter engine room. A person (other than a person directly employed therein) shall not enter any engine room while the machinery is in motion unless authorised by the owner to do so.

55. Size of boilers. In computing the size of a boiler for the purposes of determining the fees payable under these Regulations and for the purposes of determining the required certificate of competency for an operator, the following rules shall be observed:-

(a) "Heating Surface" shall mean that surface of a boiler which has water on one side and heat on the other and includes water tubes but excludes superheater and economiser.

(b) For electrically heated steam generating boilers the heating surface shall be determined by multiplying the electric energy input in kilowatts per hour by O· 08.

56. Fees. ( 1 ) The fees set forth in the First Schedule to these Regulations shall be the fees payable with respect to the purposes and circumstances respectively set forth in such Schedule.

(2) Such prescribed fees shall be paid to the Chief Inspector at his office in Brisbane: Provided that it shall be sufficient compliance with this Regulation if such fees are paid to an inspector at his usual office.

FEES 1. FEES TO BE PAID TO THE CmEF INSPECTOR:-

A For the periodical inspection of machinery-

(1) For every single steam boiler which does not exceed 5 square metres of heating surface

For every single steam boiler which-

Exceeds 5 square metres but does not exceed 14 square metres of heating surface

Exceeds 14 square metres but does not exceed 70 square metres of heating surface

Exceeds 70 square metres but does not exceed 140 square metres of heating surface

Exceeds 140 square metres but does not exceed 280 square metres of heating surface

Exceeds 280 square metres but does not exceed 930 square metres of heating surface

Exceeds 930 square metres, the sum of $162.50 plus $17.50 for each 93 square metres of heating surface or part thereof by which the total heating surface exceeds 930 square metres.

For every portable plant where the boiler and engine are combined, the fee for inspection of the boiler shall be fifty per centum (50%) more than for a single boiler of the same dimensions which is not combined with an engine; such fee shall include the inspection fee for the engine of such portable plant and all attendant machinery being driven by such engine:

Provided that in the case of a boiler that is heated electrically the fee payable shall be calculated on the basis that one kilowatt equals 0·08 square metres of heating surface.

For the visit for the purpose of inspecting a boiler which is not ready for inspection on arrival of an Inspector-a fee of one half of the applicable prescribed fee as set out above plus any travelling expenses incurred by the Inspector but in any case the total fee payable shall not exceed $33.00.

(2) For every unfired pressure vessel the capacity of which- Does not exceed 0·14 cubic metres
