SHORT TITLE

1. These Regulations may be cited as "The Sewerage, Water Supply, and Gasfitting Regulations of 1949."

MEETINGS

2. ( 1) A meeting of the Board shall be held at such time as the Board directs.

(2) Notice of the time and place of meeting, and of the business to be transacted by the Board thereat, shall be given to all members at least seven days before the date of the meeting.

(3) The chairman shall preside at every meeting at which he is·

present.

( 4) The business transacted at every meeting shall be that specified in the notice.

( 5) Any four members of the Board shall form a quorum.

( 6) A special meeting for any particular purpose may be called by the chairman at his discretion or when he is requested by two members to call such a meeting.

If the chairman fails to call a special meeting after such a request the remaining members of the Board may call such meeting by a notice signed by themselves. Such notice shall state the time and place of meeting and the business to be transacted thereat, and shall be given to members at least seven days before the date of such meeting.

The business transacted at any special meeting shall be that specified in the notice.

(7) At any meeting of the Board, if a quorum is not present within fifteen minutes after the notified hour of meeting, that fact and the names of the members present shall be recorded by the secretary in the minute book.

( 8) All powers vested in the Board may be exercised by a majority of the members present at any meeting duly held, and all questions shall be decided by a majority and by open voting.

Upon every question, the chairman shall have a vote and, if the numbers are equally divided, he shall have a second or casting vote.

If any member refuses to vote, his vote shall be counted for the negative.

(9) The chairman shall give effect to any resolution, regulation, minute, or report which has been passed or adopted by the Board.

( 10) During such time as the chairman is prevented by absence, illness, or otherwise from performing the duties of the office of chairman,

the Board may appoint an acting chairman.

( 11) The acting chairman shall have all the powers, authorities, and responsibilities, and shall perform all the duties of the chairman.

(12) The members present at any meeting may from time to time adjourn such meetin~ any subsequent time.

ORDER OF BusiNEss

3. ( 1) The first business at a meeting of the Board shall be the confirmation of the minutes of the preceding meeting of the Board, and discussion prior to the confirmation of the minutes shall not be permitted thereon except as to their accuracy. Such minutes when confirmed shall be signed by the chairman of the meeting at which they are so confirmed.

(2) After the signing of the minutes as aforesaid the order of business shall be as follows:-

( a) Matters arising from the minutes of the preceding meeting;

(b) Correspondence;

(c) Consideration of applications for examination;

(d) Consideration of licenses;

(e) Committee reports;

(f) Other business.

MINUTES

4. ( 1) The Board shall cause to be kept and recorded full and accurate minutes of each meeting of the Board. Such minutes shall record the business definitely transacted at such meetings and the decisions made by the Board.

( 2) A copy of the minutes of each meeting of the Board shall be despatched by the secretary to each member as soon as possible after such meeting.

(3) The minutes of a meeting shall be confirmed at the next meeting of the Board.

5. The secretary shall keep minutes of meetings of the Board, ~ssu~ notices of meetings, conduct correspondence, keep records of exammat10ns and of the issue, cancellation, and suspension of licenses, and perform such other duties pertaining to the business of the Board as the Board may direct.

EXAMINERS

6. The Board may appoint or approve of the appointment of examiners to conduct the examination of candidates for licenses.

TIMES OF EXAMINATIONS

7. Examinations for licenses shall be held at such times and places as the Board approves.

Notification of the time and place of holding such examinations shall, at least two months before the date of holding of the examinations, be published in a daily newspaper circulating in the locality in which the examination is to be held and in such other newspapers as the Board may direct.

MANNER OF EXAMINATION

8. The Board shall determine the manner of the examinations conducted by it and may determine that oral, written, or practical tests, or any or all of these, shall be employed.

APPLICATION FOR EXAMINATION

9. A candidate desirous of sitting for any examination conducted by the Board in Brisbane shall make application to the Board for examination at least twenty-one days before the date of holding the examination.

A candidate desirous of sitting for any examination conducted by the Board at any centre outside Brisbane shall make application to the Board for examination at least forty-two days before the date of holding the examination.

Applications shall be in or to the effect of Form 1 in the Schedule hereto. Each application shall be accompanied by the prescribed fee.

APPLICATION FOR LICENSE BY PERSON WHO HAS SATISFIED EXAMINATION REQUIREMENTS OF TECHNICAL COLLEGE SYLLABUS

10. ( 1) Any person who has satisfied the examination requirements of a trade course for plumbers as outlined in any Technical College Syllabus for the State of Queensland applicable to such person and has had at least five years' practical plumbing experience and who desires to be granted by the Board a Plumber's License shall make application to the Board therefor and such application shall be in or to the effect of Form 2 in the Schedule hereto and shall be accompanied by the prescribed fee.

(2) Any person who has satisfied the examination requirements of the third year of a trade course for plumbers as outlined in any Technical College Syllabus for the State of Queensland applicable to such person and has had at least three years' practical plumbing experience and who desires

to be granted by the Board a Country Plumber's License shall make application to the Board therefor and such application shall be in or to the effect of Form 3 in the Schedule hereto and shall be accompanied by the prescribed fee.

( 3) Any\)?erson who has satisfied the examination requirements of the second yeaiEpf a trade course for plumbers as outlined in any Technical College Syllabus for the State of Queensland applicable to such person and has had at least three years' practical plumbing experience and who desires to be granted by the Board a Water Plumber's License shall make application to the Board therefor and such application shall be in or to the effect of Form 4 in the Schedule hereto and shall be accompanied by the prescribed fee.

( 4) Any person who has satisfied the examination requirements of a trade course for drainers as outlined in any Technical College Syllabus for the State of Queensland applicable to such person and has had at least one year's practical drainage experience and who desires to be granted by the Board a Drainer's License shall make application to the Board therefor and such application shall be in or to the effect of Form 5 in the Schedule hereto and shall be accompanied by the prescribed fee.

(5) Any person who has satisfied the examination requirements of a trade course for gasfitters as outlined in any Technical College Syllabus for the State of Queensland applicable to such person and has had at least three years' practical gasfitting experience and who desires to be granted by the Board a Gasfitter's License shall make application to the Board therefor and such application shall be in or to the effect of Form 6 in the Schedule hereto and shall be accompanied by the prescribed fee.

APPLICATION FOR LICENSE BY PERSON WHO HOLDS SUBSISTING CERTIFICATE OF COMPETENCY FROM RECOGNISED AUTHORITY

11. ( 1) Any person who is the holder of a subsisting certificate of competency as plumber from any of the authorities specified in section 11

(1) (iii) of "The Sewerage, Water Supply, and Gasfitting Act of 1949"

and has had at least five years' practical plumbing experience and who desires to be granted by the Board a Plumber's License shall make application to the Board therefor and such application shall be in or to the effect of Form 7 in the Schedule hereto and shall be accompanied by the prescribed fee.

(2) Any person who is the holder of a subsisting certificate of competency as Sewer Plumber from the New South Wales Examination Board for Plumbers, Gasfitters, and Drainers or of such other equivalent qualifications as the Governor in Council has approved for the time being by Order in Council made on the recommendation of the Board and has had at least three years' practical plumbing experience and who desires to be granted by the Board a Country Plumber's License shall make application to the Board therefor and such application shall be in or to the effect of Form 8 in the Schedule hereto and shall be accompanied by the prescribed fee.

( 3) Any person who is the holder of a subsisting certificate of competency as Water Plumber from the New South Wales Examination Board for Plumbers, Gasfitters, and Drainers or of such other equivalent qualifications as the Governor in Council has approved for the time being by Order in Council made on the recommendation of the Board and has had at least three years' practical plumbing experience and who desires to

be granted by the Board a Water Plumber's License shall make application to the Board therefor and such application shall be in or to the effect of Form 9 in the Schedule hereto and shall be accompanied by the prescribed fee.

( 4) Any person 'who is the holder of a subsisting certificate of competency as Drainer from the New South Wales Examination Board for Plumbers, Gasfitters, and Drainers or of such other equivalent qualifications as the Governor in Council has approved for the time being by Order in Council made on the recommendation of the Board and has had at least one year's practical drainage experience and who desires to be granted by the Board a Drainer's License shall make application to ·the Board therefor and such application shall be in or to the effect of Form 10 in the Schedule hereto and shall be accompanied by the prescribed fee.

( 5) Any person who is the holder of a subsisting certificate of competency as Gasfitter from the New South Wales Examination Board for Plumbers, Gasfitters, and Drainers or of such other equivalent qualifications as the Governor in Council has approved for the time being by Order in Council made on the recommendation of the Board and has had at least three years' practical gasfitting experience and who desires to be granted by the Board a Gasfitter's License shall make application to the Board therefor and such application shall be in or to the effect of Form 11 in the Schedule hereto and shall be accompanied by the prescribed fee.

LICENSES

12. ( 1) Plumbers' Licenses granted by the Board shall be in or to the effect of Form 12 in the Schedule hereto.

(2) Country Plumbers' Licenses granted by the Board shall be in or to the effect of Form 13 in the Schedule hereto.

(3) Water Plumbers' Licenses granted by the Board shall be in or to the effect of Form 14 in the Schedule hereto.

( 4) Drainers' Licenses granted by the Board shall be in or to the effect of Form 15 in the Schedule hereto.

( 5) Gasfitters' Licenses granted by the Board shall be in or to the effect of Form 16 in ·the Schedule hereto.

Subject to t~e f\.ct and these Regulations, licenses granted by the Board shall remam m force from the date of the granting thereof until the thirtieth day of June next ensuing.

LosT, ETC., LICENSES

13. If any license is lost or destroyed, the holder, or some person having

knowle~ge o~ the facts and circumstances, may make a statutory declaratiOn with respect thereto; and the Board, if satisfied with such declaration, may issue a fresh license to the person entitled to hold the same, on payment of the prescribed fee.

Such certificate. shall be endorsed with a memorandum setting out the reasons for the Issue thereof; and thereafter such certificate shall be available as if it were the original certificate.

REGULATIONS Reg.14 177 FEES

14. In connection with the holding of examinations and the issue of licenses, the following fees shall be payable:-

$

(a) For issue oflicense 2.00

Provided that a fee of twenty-five cents only shall be charged in respect of the granting by the Board of a license as plumber, water plumber, or drainer to any person who proves to the satisfaction of the Board that he was the holder, at the coming into operation of the Standard Sewerage By-laws and/or the Standard Water Supply By-laws, of a license as plumber, water supply plumber, or drainer, as the case may be, issued by a Local Authority and subsisting under the By-laws of such Local Authority then in force:

Provided further, that a fee of twenty-five cents only shall be charged in respect of the granting by the Board of a license as gasfitter to any person who proves to the satisfaction of the Board that he was the holder, at the coming into operation of the Fourth Schedule to the Act, of a license as gasfitter issued by a gas company;

(b) For reissue of license after suspension 2. 00 (c) For issue of any fresh license on loss or destruction

(i) In the case of licenses the expiry date of which

conducted in centres other than Brisbane, the Board may increase or decrease the amount of the fee dependent upon the expenses incurred in conducting such examinations;

15. ( 1) Interim Plumbers' Licenses granted by the Board shall be in or to the effect of Form 17 in the Schedule hereto.

(2) Interim Country Plumbers' Licenses granted by the Board shall be in or to the effect of Form 18 in the Schedule hereto.

(3) Interim Water Plumbers' Licenses granted by the Board shall be in or to the effect of Form 19 in the Schedule hereto.

( 4) Interim Drainers' Licenses granted by the Board shall be in or to the effect of Form 20 in the Schedule hereto.

(5) Interim Gasfitters' Licenses granted by the Board shall be in or to the effect of Form 21 in the Schedule hereto.

Subject to the Act and these Regulations, interim licenses granted by the Board shall remain in force from the date of the granting thereof until such time as the Board may determine. The date of expiry thereof shall be shown on such license.

RENEWALS OF LICENSES

16. Applications for the renewal of licenses shall be made to the Secretary on or before the 31st May next preceding the expiry of such license and such application shall be accompanied by the prescribed fee. Renewal licenses shall be in or to the effect of Form 22 in the Schedule hereto.

Any licensed plumber, country plumber, water plumber, drainer, or gasfitter who, at the first day of July in any year, has not paid his renewal fees for the preceding two years or longer, shall be notified by registered letter addressed to him at his usual or last known place of abode that, if the fees are not paid within one month from the date of such letter, the Board may remove his name from the register of licenses.

If any such licensed plumber, country plumber, water plumber, drainer, or gasfitter fails to pay his renewal fees within such period of one month, the Board may remove his name from the register of licenses:

Provided that, upon payment of all renewal fees owing by him, the Board shall restore his name to the register.

LICENSES TO BE NUMBERED CONSECUTIVELY RECORD TO BE KEPT

17. The licenses granted by the Board shall be numbered in consecutive order, and a record of the issue in each case shall be kept by the Board in a register of licenses.

PROOF OF HOLDING LICENSES

18. A certificate purporting to be signed by the Secretary and to certify that-

( a) On a specified day or days or during the whole of a specified period a particular person was or was not a plumber, country plumber, water plumber, drainer or gasfitter licensed under the Act; or

(b) On a specified day the name of any particular person was removed from the register of licensees kept pursuant to Regulation 18; or

(c) As from a specified day the license of a particular person was suspended for a specified period,

shall, without proof of the signature of the person purporting to sign such certificate or that he was the Secretary, be prima facie evidence of the matters certified in and by such certificate.

PROOF OF APPRENTICESHIP

18A. A certificate purporting to be signed by the Secretary of the

"Apprenticeship Executive" appointed under and in pursuance of the provisions of section eleven of "The Apprentices and Minors Acts, 1929 to 1948," and to certify that on a specified day or days or during the whole of a specified period a particular person was or was not an apprentice as defined by "The Apprentices and Minors Acts, 1929 to 1948," shall without proof of the signature of the person purporting to sign such certificate or that he was the Secretary, be prima facie evidence of the matters certified in and by such certificate.

LICENSEES TO NOTIFY BOARD OF CHANGE OF ADDRESS

19. Every person to whom a license has been granted by the Board shall notify the Board of any change of his address. Any person who fails to comply with this provision shall be liable to have his name erased from the register of licenses.

SERVICE oF NoTicE

20. Any notice, order, or other document under or for any of the purposes of this Act required or authorised to be given or served to or upon any person may be given or served by forwarding the same by post in a registered letter addressed to such person at his usual or last known place of abode and in such case the production of a receipt purporting to be the registered receipt for such letter, together with oral testimony by the officer posting such letter as to the contents of such letter, shall be sufficient proof of the giving or service of such notice, order or other document.
