MINUTES OF THE MEETING OF THE DEVELOPMENT ASSESSMENT UNIT HELD AT HILLS SHIRE COUNCIL ON TUESDAY 2 MARCH 2021 The minutes of the Council meeting of the Development Assessment Unit held on 23 February 2021 are confirmed. These concerns have been addressed in the report and do not warrant rejection of the application.
The proposal has been assessed against the provisions of the Hill Development Control Plan (THDCP) especially;. Concern was raised that an unauthorized secondary residence already exists within the garage of the main residence. During the inspection of the site it was confirmed that there is no other secondary residence on the site.
The proposed cumulative footprint of the existing shed and the new proposed shed totals 155m2 in accordance with the DCP. The questions raised in the submissions have been dealt with in the report and do not warrant rejection of the application. No work (including excavation, earth filling or soil transformation) may be carried out before the Building Certificate is issued, where a Building Certificate is required.
The plans submitted with the Construction Certificate must be amended to incorporate the terms of the Development Consent.

Bushfire Requirements
A hose of not less than 19 mm diameter, fire hydrant and suitable fittings to connect to the pump shall be provided. New construction on the north and west aspects of the secondary dwelling must comply with Section 3 and Section 7 (BAL 29) of Australian Standard AS3959 "Construction of buildings in areas exposed to bushfires" and the additional construction requirements contained in sections, where applicable) , and 7.6 (where applicable) of the Bush Fire Protection Planning 2019. New construction on the eastern and southern aspects of the secondary dwelling must comply with section 3 and section 6 (BAL 19) Standard Australian AS3959 'Construction of buildings in bushfire -prone areas' and additional construction requirements contained in Sections where applicable, and 7.6 (where applicable) of Bushfire Protection Planning 2019.
Landscaping for the site must comply with the principles in Schedule 4 of Planning for Bush Fire Protection 2019. Grasslands/mown lawns/or ground cover plantings provided in the immediate vicinity of the building. Limit planting in the immediate vicinity of the building which, over time and if not properly maintained, may come into contact with the building.
Planting should not provide a continuous canopy on the building (ie, trees or shrubs should be isolated or placed in small groups); When considering landscape species, consideration should be given to estimated plant size at maturity;

The DKP requires that the dwelling width is a maximum of 75% of the allotment width at the building line. To ensure that new development is sensitive to the landscape setting, site constraints and established character of the street and location. The design and construction of the engineering works listed below must be provided in accordance with the Council's Design Guidelines Subdivisions/ Developments and Works Specifications Subdivisions/ Developments.
All building work must be carried out in accordance with the provisions of the Building Code of Australia. All requirements of the waste management plan submitted as part of the development application must be implemented, except where contrary to other conditions of consent. Any material removed from the site must be transported in accordance with the requirements of the Protection of the Environment Operations Act 1997 and only to a site that can legally be used as a waste disposal facility.
The service must be organized no earlier than two days before occupancy and no later than seven days after occupancy of the development. This amount shall be adjusted at the time of the actual payment in accordance with the provisions of Section 7.12 Hills Contribution Plan. A copy of the building plan approval and receipt from Sydney Water Tap in™ (if not already provided) must be submitted to the Lead Certifier on request prior to commencing works.
Before work begins, submit written notice of the main contractor's (builder's) name, address, telephone number, email address and license number to the Chief Certifier. No later than two days before work commences, the Council must have received written details from the Chief Certifier in accordance with Clause 103 of the Environmental Planning and Assessment Regulations 2000. A sign must be erected in accordance with Clause 98A(2) of the Environmental Planning and Evaluation Regulations 2000.
The sign must be put up in a prominent place and show – a) name, address and telephone number of the main certification company for the work, .. b) name and out-of-hours contact telephone number of the main contractor/person responsible for the work. The exterior of the building may not be filled in, unless otherwise stated in the approved plans. Before building work can commence, the Principal Certifying Body must give notice of these inspections under section 103A of the Environmental Planning and Assessment Regulation 2000.
Dust emission should be controlled to minimize disturbance to the occupants of the surrounding premises. Dust debris should be raised around the perimeter of the site and kept in good condition for the duration of the construction work.
